Arbitration is a legally recognized alternate litigation for the resolution of civil disputes. The parties agree, either before or after a dispute arises, to submit that dispute to an independent third party for resolution. The decision of that third party is binding on the parties. A decision of an arbitral tribunal, typically referred to as an "award," cannot be reviewed by a court except on very limited grounds, such as fraud. See, e.g., Va. Code 8.01-581.010. Indeed, an arbitral award is typically less subject to judicial review than the decision of a trial court, whose decisions are almost always subject to appellate review as a matter of right. Arbitration is typically the result of a contractual agreement between the parties to submit disputes to arbitration. On occasion, arbitration can be required by statute. For example, the California Department of Transportation requires the arbitration of all disputes arising under its contracts. Public Contract Code, Article 7.1 (§§10240-10240.13). There may be a question whether statutorily required arbitration is truly arbitration or an administrative law disputes resolution procedure. The significance of the difference is that the decisions of administrative law bodies are typically reviewable by a court of law as a matter of right while, as set forth above, arbitral awards are almost never reviewable.

"The detection of leakage is a recognized problem in the safe and economic distribution and use of natural gas. Natural gas is practically odorless and therefore lacks he property of indicating significant leakage by the sense of smell, the means most widely used by gas employees and consumers for detecting leaks of the more odorous types of fuel eases. In view of the recognized value of the odor of gas for indicating leakage at the time of occurrence the Bureau of Mines has studied' the possibility of adding small amounts highly odorous substances to types of fuel gas (such as blue water gas and natural gas) that lack warning properties. These studies revealed that the mercaptans were promising substances to accomplish this purpose, not only for odorizing fuel gases but for other purposes° where it was desired to give warning through the sense of smell.Since completing the studies mentioned, the Bureau of Mines jointly with the American Gas Association has conducted further investigations dealing with the use of warning agents for fuel gases. The results of this work will be published later.The Bureau of Mines had been desirous of observing the practical use of ethyl mercaptan for detecting leakage of natural gas, particularly to determine whether the odor would permeate the ground and give indication of lea's in underground pipes. Opportunity for making these observations was recently given by E. A. Munyan, manager, gas department, Union Gas t Electric Co., who requested the bureau's cooperation in making leakage surveys of the company's distributing systems at Franklin and Middletown, Ohio."

Data on the occident experience of the pebble-phosphate industry in Florida for 1937 and 1938 are combined in this report with statistics for the 7-year period 1930-36, inclusive, which were published in Information Circulars 69174/ and 69685/. The periodic publication of such data enables the pebble-phosphate industry, as well as other industries, to consider relative hazards, compare experience, and thereby help to prevent accidents. Accordingly, the supply of minerals will increasingly be affected by social and political factors.

Mining, waste is growing problem both physical accumulation and increasing toxic uncertainties it presents in the long run. Its value ?zero? is strictly calculated by economy. This mining model begs the question: What is the value of waste & what does it represent to the mining industry? Waste is widely accepted as a ?by product? generated as a consequences of the mining process. The abundant waste accumulation affects society, as receptor, in many ways and the waste piles of materials has no use and no destiny. In reality, this waste is monument of imperfection of the extractive industries worldwide. Our planet is finite and has strict limitations, which mining has traditionally ignored. It is time to design a new system, in which clearly, waste design must be integrated in whole mining process; it has no room to postpone. This paper presents a concept in waste design by which toxic mining waste not only can be rendered inert but also act as nutrient to help balance the ecosystems. This concept calls for extractive industries to pursue EQUILIBRIUM with nature (Geomimic). Also, this concept offers countless gains and opportunities fro the industry and by converting liabilities into assets; mining engineers become the managers and stewards of nature. Also, waste design offers new solutions for proper and sustainable waste management of the mining industry.

Based on optimization using response surface methodology designed by Box- Behnken, to study the interaction of wet industrial salt with moisture drying temperature (50-90 ); duration (10-50s); and the weight of the materials (20-60g). The results show that: the experimental parameter conforms to the quadratic equation model to influence the moisture content and the dehydration speed., in analyzing the significance and the interaction of various factors, the optimum by the Design Expert software conditions for drying with microwave radiation include temperature of 90 , duration of 10s, and sample mass of 26g. Verified by experiment, the moisture content after drying is less than 0.25% and the dehydration rate reached 1.37g/min, between the predicted value and the actual value confirmed good fitting degree.

Société le Nickel (SLN) exploits the Dôme lateritic nickel orebody at its Tiébaghi operations in New Caledonia. The site geology has an obvious bearing on recovery and metallurgical performance, and the controls are extremely complex at all scales: lithology, oxidation-reduction conditions, mineralogy, and multivariate geochemistry. In that context, establishing an adapted recoverable resource estimation method that is efficient and transparent proves an interesting challenge. The method must address the key notions of: ? Support effect: the exploration data-set can only warrant the estimation of large panels 20×20×3 m3, which are much larger than the selective mining units (SMUs) of 5×5×3 m3 ? Information effect: the selection at production stage uses estimates based on information much denser than that available for mine planning. The problem is rendered more complex in this type of deposit by the fact that the additive variables used for any estimation process (metal accumulation and ore tonnage) are not the ones used to establish the selection at mining stage (i.e. the nickel grade of SMUs, which is the ratio of accumulation on tonnage). Eventually, the selection criteria involve not only Ni grades but also other constituents such as Al2O3, Fe2O3, MgO, and SiO2. The solution presented in this paper is the construction of a platform of SMU multivariate simulations in the saprolitic horizon, together with efficient post-processing aimed at producing the multivariate recoverable resource estimates. The efficiency constraints imposed by the number of blocks to be simulated (1.5 million) lead to resorting to direct block simulations. The underlying multivariate discrete Gaussian model (DGM), the validity of which is tested beforehand, is put to good use to mimic the selection process at the mining stage, by offering the ability to simulate in each block a composite value located at random within the block. Finally, the paper presents the application of a scenario reduction algorithm to pick a representative subset of a few simulations to help appraise the risk attached to the downstream phases (reserve optimization, mine sequencing) of the project. The implementation presented here is for the first generation of the Scenario Reduction plugin built in Isatis software, where measuring the distance between the initial set of scenarios and the reduced set is based on Ni quantities only. Research is under way to adapt the measure to the true multivariate nature of the problem.

IN A DISCUSSION of use of any material of ?construction in the mining industry, two points of view must 'be kept in mind - that of the producer or manufacturer of mining and metallurgical equipment, and that of the maintenance and operating staff of the mining plant. In the first case, the choice of material of construction is up to the manufacturer and the user of the equipment has little direct say in the matter. However, if materials are badly chosen and the equipment does not function properly, wears out rapidly, or costs too much, repeat orders ?will likely go to a different manufacturer, so that, in the end, the consumer or mine operator does have the final voice. In the case of materials for maintenance work and plant operations, however, .the mill personnel have direct control over purchases and it is then that a well-balanced knowledge of materials, their properties, and their costs, can be directly useful. With all materials of construction, the final criterion is unit cost versus service performance, so that the lowest possible total operational cost will be obtained. Sometimes this means using the cheapest material available, sometimes the most expensive, but in any case careful analysis of service performance, replacement cost, and material cost is essential to determining the material that produces lowest total cost.

Drilling activity increased in Illinois in 1935. There were 34 com-pletions as compared with 26 in 1934 and 18 wells were drilling at the end of 1935. Some large blocks of acreage were leased in Marion and Clay counties near the central part of the Illinois structural basin. Production of oil in the state totaled 4,305,000 bbl., a decrease of 4 per cent from that of 1934 There was some curtailment of production in the early part of 1935 but none after April 30 as shown in the following table. Likewise, its iconic yellow bulldozers are at mine sites the world over — the company recently announced the sale of its 40,000th large dozer. And since its acquisition of Bucyrus in 2011, Caterpillar has positioned itself to become a worldwide leader in the underground mining sector as well.But don’t think that the company is resting on its reputation. As evidence of its commitment to the global mining sector, as well as its confidence in the future of mining, Caterpillar invited mining trade press, including Mining Engineering, to its Tinaja Hills Training Center near Tucson, AZ in November to introduce the latest editions to its mining portfolio. The two-day event focused mostly on the newest electric drive haul trucks, the Cat 796 AC, which will operate in the 326-t (360-st) class, and the 798 AC in the 360 t (400 st) weight class.Caterpillar representatives also spoke about new offerings in the underground space as well as the newest version of the D11 large dozer.“It has been 10 years since we launched the F Series,” Jean Savage, Caterpillar’s vice president, surface mining and technology said. “Since then, we have been on a journey to serve our mining customers and we wanted to have trucks in every application. Today, we are launching two new trucks that will allow us to fill out our portfolio.”While Caterpillar previously offered the broadest range of off-highway haul trucks to the mining industry, it was noticeably absent from the 326-t (360- st) and 360-t (400-st) weight classes."

The effect of grinding media performance on milling and operational behaviour was demonstrated under different selected conditions of calcium carbonate slurry milling. A variety of grinding media materials and bead sizes, along with two different stirrer tip speeds, were used in the grinding process to generate a particle size reduction of the calcium carbonate (CaCO3). To determine the optimum milling parameters the collected test data were used to calculate and evaluate specific energy as well as stress intensity under different milling conditions. When asked to lecture at Bendigo on the geological factors that determine the depths of ore deposits, I hesitated for a little before agreeing to lecture on the theory of deep ores in the city world famous as the pioneer of deep gold mining. If there be one place, wherein the conditions of deep-seated ore deposits should be sufficiently well understood, it is the city where the 180 mine made its bold plunge to previously neglected depths; and where the record of that famous mine has been broken by the skill of the managers, and the pluck of the proprietors, of the New Chum Railway and Lazarus mines.In the face of such practical triumphs, theoretical discussion may seem a waste of time, especially since it is often dedared that the existence of such deep-seated ores was denied by geological theory. This assertion is, however, startling since the oldest and best supported geoiogical theory of ore deposits, has taught for more than a century tliat ores must descend far below the regions of practical mining. This charge against Victorian geologists is generally based on opinions attributed to the late Sir Fredrick McCoy. It has been repeatedly affirmed that he declared that gold cannot occur pelow a depth of 300 feet. But so far I have not been able to discover that McCoy ever made any such assertion or ever held such a view.

WEDNESDAY night, by long tradition, is al- ways set aside for the annual dinner, even when, as it was this year, it is Ash Wednesday. Whether the somewhat smaller attendance than last year is attributable to that cause, the unexpectedly long persistence of business depression, or whatever may have been the reason, it was a joyous occasion, and the grand ball-room of the Commodore Hotel was as completely filled With diners as * was consistent with com- fort. In the half hour before the dinner was actually served the guests assembled in an adjoining room and not only exchanged greetings but proceeded along the receiving line to greet the guests of honor. The number present was so large that hardly more than half of them had been able to do this before the summons to the dining room sounded and a hearty and immediate response was made to it. Toy balloons at each plate, inflated and directed at the heads of companions or nearby friends, but which were just as likely to carom from the nose of a hurrying waiter, successfully broke the ice as well as not a few plates. It would be interesting to know whether the pleasure the guests derive from these de- vices is in part based on the all-too evident annoyance of the waiters, and what the relative quantitative relationships are.

President Lien presented Mrs. Holmes with the first of speaker appreciation gifts presented by his firm Amax Coal West, Inc. These were books by Rand-McNally entitled The Executive Golfer Guide. Following the coffee break, Clark Moseley presented the first annual Institute Safety Achievement Awards for the safest mines in the eight member state region. The awards were based on: 1. The Bureau of Mines investigated the conversion, at both laboratory and pilot plant scale, of a low-grade ilmenite to chlorination-grade feedstock that could substitute for imported rutile used to produce titanium tetrachloride. The concentrate was derived from the Tahawus, NY, lode deposit of ilmenite-magnetite in rock that contains anorthosite and gabbro. Charges of the ilmenite concentrate, containing 46.6 wt pct Ti02 blended with soda ash, were carbothermically reduced in an electric arc furnace, which separated most of the iron and left a high-titanium slag. However, the slag contained Ca, Mg, and Mn constituents that rendered the material unsuitable for continuous chlorination by causing plugging problems. After being ground and pelletized, the slag was reacted with S02 and air at 7000 to 9000 C, which selectively converted the harmful impurities to soluble compounds that were removed in a subsequent water or dilute HCI leach. In laboratory tests, the combined levels of harmful impurities were decreased from 5 to as low as 0.5 wt pct in leached slags. In pilot plant tests, leached slags sulfated at a rate of 10 lb/h averaged 85.5 wt pct Ti02 with pertinent impurity levels averaging 1.86 wt pct. The leached slag was successfully chlorinated in a laboratory fluidized-bed reactor at 9500 C to extract titanium as TiCI4.

The engineering profession generally does not accept vibro-driven piles as bearing piles unless their capacities can be verified by restriking with an impact hammer, which significantly reduces the economic benefits of vibratory driving. In part, the concern for capacity development in piles driven by vibration arises out of observations that vibro-driven piles do not develop capacities equivalent to those driven by impact (e. g., Mosher, 1987). Nonetheless, if capacities are predictable, vibratory installation may be more cost effective than installation by impact, due to savings in time of installation, even if capacities are lower than those of impact-driven piles. Throughout the past few decades, a number of attempts have been made to develop capacity prediction methods for vibro-driven piles, mostly along the same lines as methods for impact-driven piles. That is, (1) totally empirical formulae, (2) power balance / power transfer formulae, and (3) "time domain-nonlinear" (TDN) computational procedures such as the wave equation. Some of the formulae have been based partly on field experience, but the majority have been developed from simple theoretical models with parameters evaluated from laboratory studies. Neither these formulae nor the TDN solutions have been systematically checked (or modified) by recording appropriate field data over a variety of site

THE Synthetic Liquid Fuels Act (30 U.S.C., 321-325, and amendments) become law April 5, 1644, and a period of intensive research and development in this field was begun by the Bureau of Mines. As part of this program bulletins were published on a pressure hydrogenation,3 the Fischer-Tropsch synthesis,4 and oil shale.5 The Bureau also has published a short bibliography on coal gasification,6 mostly of a theoretical nature. Because coal gasification is prerequisite to Hither the Fischer-Tropsch or coal-hydrogenation processes, publishing this sizable, collection of technical information in this form will be valuable. The material is presented in three parts, as follows: I. United States Patents. II. United Kingdom, Australian, Canadian, and South African Patents. III. Belgium, French, German, Italian, and Swedish Patents. The domestic patents for this bulletin were collected between 1963 and 1955. Some of the Foreign Patents were collected at the same time and a few of them later in 1961. Part I was published in 1960; Part II was published in 1962.

To exploit an underground mine effectively and safely, it is important to have a good understanding of the geotechnical behavior around underground excavations made in the mine. The aim of this study was to investigate the geotechnical behavior around a tunnel excavated in a metal mine in China at the three-dimensional level. Using the information available on lithology, geological structures, in-situ stress measurements, physical and mechanical properties of intact rock, discontinuities and interfaces between different rocks, a three-dimensional numerical model was built by using the 3DEC software to simulate a tunnel excavation under a high in-situ stress condition. Effect of the discontinuity network, possible intact rock and discontinuity parameter variability, representation of rock masses as discontinuum or continuum material and rock support system on the deformation, stress, failure zone and stability around the tunnel was investigated. A very good agreement was obtained between the collected field deformation monitoring results and the results of the conducted numerical stress analyses.
