The Annual Meeting of The Rocky Mountain Coal Mining Institute was called to order by the President, John T. Atkins, at 2:00 p.m. Tuesday, June 26, 1984 in the Colorado Ballroom of the Marriott's Mark Resort in Vail, Colorado. There were 36 members in attendance. It was moved by Bob Diederich, seconded and carried to dispense with the reading of the 1983 Annual Meeting minutes as printed on pages 105 thru 109 of the 1983 Proceedings. In keeping with the printed agenda in the convention program/ticket booklet, the President called for reports of standing committees as follow: 1. Bylaws & Resolutions - Loren Linville, Chairman Linville noted that the committee had been working for two years on bylaws changes and concluded a corporate lawyer specializing in nonprofit organizations be engaged. He then introduced Mr. Peter B. Nagle of the Denver law firm of Sherman and Howard who outlined the major changes in converting the Institute's current status of 501(c)(6) to 501(c)(3). He pointed out that such a conversion would give the Institute a proper legal status, would give individual contributors to the scholarship or other programs a personal income tax deduction, would qualify the Institute for the postal nonprofit mailing rate and the Institute would achieve the advantage of limited liability inherent in a corportion and would insulate its members, officers and directors from liability for corporate obligations. Copies of the Articles of Incorporation as well as the Bylaws were available for all members. A discussion ensued and the following resolution was moved by Bob Diederich, seconded and carried: RESOLVED, that the unincorporated association known as the Rocky Mountain Coal Mining Institute be, and hereby is, dissolved and in its place, and to carry out its objectives, shall be formed a nonprofit corporation under the laws of the State of Colorado, which corporation shall also be known as The Rocky Mountain Coal Mining Institute, and to which shall be transferred all of the assets and liabilities of this association. FURTHER RESOLVED, that the proper officers of this association are authorized and directed to execute and file with the Colorado Secretary of State, Articles of Incorporation in a form substantially similar to those prepared for this association by its counsel, and the names of the individuals identified in such Articles of Incorporation as the initial Board of Directors of such corporation, which names were proposed and recommended by the Nominating Committee of this association, are hereby approved. FURTHER RESOLVED, that the proper officers of this association are authorized and directed to do all acts necessary or convenient to carry out the terms of the preceding resolutions. (Articles of Incorporation and Bylaws as adopted are printed following these minutes.) Additional resolutions were read by Linville as follows: Item 1: WE RESOLVE herein that in the year since the last convention of the RMCMI, the Institute and the coal industry have suffered the loss, through death, and the services of: Lloyd W. Taylor Charles T. Holland THEREFORE, BE IT RESOLVED, that we record in the minutes of the RMCMI, recognition of the passing of these members who have so greatly contributed to the advancement of the industry, both nationally and in the Rocky Mountain area, and that a copy of this resolution be sent to the next of kin as evidence of the sincere sympathy and deep regard of the members of the Institute. Item 2: RESOLVED, that in recognition of their long and faithful service to the coal industry that the status of Life Member be conferred upon: Bernard Bernstrom Roy Coulson Shirl C. McArthur Item 3: RESOLVED, that we commend and express our gratitude to our Executive Secretary, officers, chairmen and committees for an outstanding job in presenting. the 80th RMCMI meeting. Item 4: RESOLVED, that the RMCMI express its gratitude to K&P, INC. of Golden, Colorado for their generous donation of office facilities and furniture for the RMCMI office and to K&P SALES ENGINEERS, INC. also of Golden, Colorado for their assistance in telephone answering, other office procedures and the use of certain office equipment. Item 5: RESOLVED, that six scholarships be awarded annually to advance the education program of the Institute to worthy students pursuing career paths in mining or other related industry in the six states in which the Institute generally operates and has members and in accordance with the criteria set forth by the Scholarship Committee. Coal mining as an occupation, is hazardous under the most, ideal conditions. Confronted with this inescapable fact, every possible emphasis is placed by the Phelps Dodge Corporation, at the Dawson mines upon the employment of every means available for safeguarding its employes from the dangers attending their vocation. Accidents have a human aspect and a direct bearing upon the well-being of the workmen themselves. They cause a loss of wages, suffering and often privation of the employe and those dependent upon him. In case of death, his children are often forced into the wage earning class without preparation to fight the battles of life, with the result that the efficiency of the next generation is lowered. Dr. Jones, formerly of the war industries board, is responsible for the following statement. "Accident prevention as it is now conducted is principally a matter of education and not merely one of protection against physical hazards as frequently believed. In fact, the last ten years experience in accident prevention has demonstrated conclusively two things: 1. That three-fourths of all deaths and serious injuries in industry can be prevented. 2. In the industries doing the most efficient work, two-thirds have been accomplished thru organization and education as against one-third accomplished by means of mechanical safeguards or equipment. Experience in the past decade has conclusively proven that the work of accident prevention is not a "one man job" that satisfactory results can be secured only thru the highest measure of co-operation between the employer and employe, and this by means of organization. The employer must be vitally interested in the work if he expects to educate his men to share the responsibility with him. The men must be given a part to perform in it, if their interest is to be aroused and maintained. It is only thru organization that this is possible. In this connection it is interesting to note the results obtained by the Old Dominion Co. of Globe, Ariz., in reducing accidents after the organization of their safety department. The O. D. Co. are pioneers in the adoption of the workmens safety committees and and the results obtained by this, company after their safety work was well organized are truly wonderful. For the years 1913 to 1916, inclusive, at which time the safety work was not well organized, there were a total of 18 fatal accidents, the years 1917 to 1920, inclusive, was a period of intensive safety work, during which time there were only three fatal accidents, none having occured during 1919.

Ladies and gentlemen, I appreciate this opportunity to be with you, and to share my outlook on the future of Federal coal leasing. I'm told that you wanted the best speaker on this subject in the world. Perhaps it's a reflection of these trying financial times, but I'm glad you finally agreed to settle for the best speaker your budget would afford. I have been asked to give you some insight on the status of Federal coal leasing, and how the budget problems facing the Department will affect the coal program. So I've polished up my crystal ball, and I'll try to give you a peek at the future. Before I do that, however, let me first go back in time - to when this Administration took office in 1981. We had a coal program then, after a hiatus of ten years. But that program was untested and - for reasons well known to all of you - did not work well in practice once we began operating the program. We went back to the drawing board and redesigned the program so that it can do what it is intended to do. We've made the program more predictable. That means that when future lease sales are scheduled, those sales will be reflective and reactive to the need to lease coal. On February 26, Secretary Hodel unveiled a framework for resumption of Federal leasing program activities, ending a more than two-year suspension of regional coal sales. The new program will provide the opportunity to satisfy market demand for acquiring and developing new leases, assure the government of fair market value for its coal reserves, and provide a stable supply of coal for this country's energy needs. The new program grew out of the Department's response to recommendations of the Linowes Commission and the Office of Technology Assessment, coupled with a supplemental environmental study. The Linowes Report, issued in 1984, contained 36 recommendations and three Judgments on leasing levels, tract selection, sale procedures, appraisal methods, key statutory and related factors, and organization and management of the leasing program. Major changes in the new leasing program reflect these concerns. We have developed a definition for captive tracts and devised procedures to appraise their value to the adjacent coal or mine owner. Other steps include a coal lease appraisal guide which describes our appraisal methodology and is available to the public. Improvements have also been made in the gathering of lease assignment information to help in estimating the value of potential lease tracts. To improve market analysis, a three-tiered system will be used to ensure that steps of the lease sale decision process are undertaken in the context of coal supply and demand. Regional Coal Teams will thus have the advantage of long range, regional and tract specific market studies to help them determine whether sufficient demand is expected first to warrant the initiation of activity planning, then to set regional leasing levels, and finally to actually offer specific tracts for lease sale. Sale procedures will also be improved in many ways to encourage competition, improve the chances for receiving adequate bids, and to evaluate whether bids represent fair market value. We made additional modifications to the program in response to the OTA recommendations. Regional Coal Teams have been given a larger role in recommending key decisions concerning the amounts of coal to be studied and the actual selection and scheduling of tracts for lease sale. These recommendations will be accepted unless the Secretary can cite an overriding national interest factor, or a governor's request to modify the recommendations. Smaller, more frequent sales will be held, to better judge market conditions and prevent over- or under-leasing. Public participation guidelines have been written, to document all opportunities for the public to comment at various stages in the planning process. We also decided that resource management plans prepared after the passage of FLPMA in 1976 must be completed, in order for a new round of lease sale planning to begin. The BLM will also beef up its procedures for consulting with affected Federal agencies during the planning process, to assure that the purposes and values of those agencies are considered and factored into land use decisions. To assure consistent use of an adequate data base in coal lease decision-making, Regional Coal Teams will develop standards and guidelines for data adequacy, and document the use of these standards. These procedures will also be applied to the unsuitability criteria screening process. Thus, the new leasing system announced by Secretary Hodel: is fully responsive to recommendations made by the Linowes Commission and the Office of Technology Assessment for improving environmental planning and fair market value procedures; gives the regional coal teams a major say in determining leasing levels, and on the timing,

From time to time the question of shearing or vertical cutting of rooms and entries especially as an adjunct to the usual horizontal cuts, has cropped up in the literature of coal mining and in the discussions of mining men. Exact and definite data based an thorough tests have usually been lacking however and the present article is written to supply as far as possible this deficiency. The tests given below were made over a period of 90 days in the summer of 1921 and the object was to investigate the general .economics, if any, that might result from the introduction of vertical cutting as a standard practice into the Clear Creek mines. The machine used was the Oldroyd Universal coal cutter and comparative tests were made against the Goodman Straight- face machine and the 35 B Jeffrey Shortwall. The tests however should be held to apply only to the various methods of cutting and not as a study in the relative merits of the various machines. The first series of tests were made in the 2nd East district of No. 3 mine, where only entries were being driven at the time, the tests therefore cover only entry work. The presumption was that the entry width would be 12 feet but the oxerrun in some cases was marked enough to make the work comparable to rooms. The first test made was to determine the time necessary to shear as well as cut the places, and the results were reduced to the time necessary to cut a ton of coal. The time for shearing in the table includes the time necessary to revolve the cutter bar to the vertical position.

Coal is the basic necessity of our present-day civilization, and those engaged in the industry, whether miner, day-man, pit boss, tipple boss, superintendent, salesman or operator, have a direct responsibility to the public at large. Our country is blessed with a great supply of Bituminous coal, upon which it must largely depend for its industrial prosperity. Anthracite coal, in its relation to our economic situation, is a small factor, as its ratio of production to Bituminous coal is only about one-sixth. However, within the last ten years, electricity and oil have largely displaced the use of coal in industry, so that the use of Bituminous coal is decreasing, relatively, and the potential production of Bituminous coal has largely increased since the war. High wage scales and high freight rates make the delivered price of coal to the consumer so out of proportion to the cost of electricity and oil -and strikes make the supply of coal so uncertain-that industry is rapidly turning to electricity and oil. The energy in a ton of coal can be transported, by electric current, a distance of 250 miles for 78% of what it costs to ship the coal in bulk, by rail, in the East-and, for about 60% of what it costs in our section of the country. The use of fuel oil, distillate and gasoline, in industry, has increased by leaps and bounds. Especially was this noticeable during the strike this year, as the large packing plants in Kansas City, Omaha and Sioux City (that formerly used nothing but coal) are now practically all using oil. This also supplies to other industrial plants throughout our territory in Texas, Oklahoma, Kansas and Nebraska. Many railroads are using oil, as are also the smelters, cement plants, etc., etc. Ten years ago, 100% of the threshing in the state of Kansas was done with coal-today not over 25% of it is done through that means-and so it goes all along the line. The use of our coal is being yearly more restricted in industry. In the case of domestic consumption, the circle is also ever decreasing.' In small towns and on farms, kerosene, gasoline and wood are largely utilized for cooking. For the past four years, along any country road, it is a common occurrence to hear a buzz-saw cutting old fence posts or timbers taken from creek bottoms. Many thousands of tons of coal are displaced each year through the use of corn and cobs. In larger towns, gas plants have been installed, and many housewives use gas-in communities contiguous to natural gas, that is used for industrial and domestic purposes. The time has gone when industrial and domestic consumers or dealers are satisfied to buy anything that is black-competition among the coal-producing states is keen, and will become more so. Eastern and southern fields are turning out splendidly prepared coals of high quality, and with their lower freight rates to competitive territory, will entirely nullify the use. of our Western coal unless-

Hair and William Littlejohn, to draft resolutions protesting against the granting of a franchise for piping natural gas into Salt Lake City, to be sent to the City Commissioners of Salt Lake City, with carbon copy to the Utilities Commission of Utah. The Committee submitted resolutions which, upon motion of Mr. Littlejohn, and seconded by Mr. Butler, were adopted and sent by telegraph to the Utilities Commission and the City Commissioners.

The Bituminous Coal Industry has for the past year been faced with a most serious problem. I am sure that you have had your own individual and local problems, as do we all. In my thirty years of practical experience with coal mining, I have never found an operating man nor a coal mine without problems. The very nature of mining, with so many unknown factors involved, precludes the absence of problems. But they are not insurmountable, and one should not dwell on them interminably. They should be recognized as a challenge to our ability and ingenuity to solve them, and once the proper solution is found, it should be applied and the problem dismissed. However, we find ourselves at the moment in the midst of a serious challenge to our very existence. In the early thirties, many in the industry welcomed the re-establishment of Unionism as a balance wheel, in the belief that the stabilization of wage scales would also stabilize prices and eliminate disastrous price cutting practices. The ultimate effects of having twenty-six years of benevolent paternalism in the administrative branches of Federal and State Governments with their labor courting policies, could hardly have been anticipated. And so with wages spiralling under government sponsorship, we have finally reached the point where competitive fuels, such as natural gas and oil are more attractive to the consumer, from the economic angle of cents per BTU cost, than coal.

Thank you very much for that introduction. I spent part of my early career in the coal industry here in Colorado, and I am always happy to return. In such a beautiful setting, it seems out of place to talk about "Improving the Climate". But in our work-a-day worlds, we know the climate for the coal industry is something less than picture perfect. But unlike Mother Nature's climate, there are some things we can do about the climate for coal. Today, I want to talk to you about sonic of the activities that we are engaged in... and that you can support... to improve that climate. A number of challenges and opportunities face our industry. I will try to set the stage for this conference by briefly describing the current climate for coal - which is indeed very challenging. I will then outline some of the steps we are taking to broaden our base to include our allies in the rail and electricity industries and the public at large.

The Annual Business Meeting of the members of The Rocky Mountain Coal Mining Institute held during the 83rd Regular Meeting of the Institute was called to order by the president, Bernard Bernstrom at 2:50 p.m. Tuesday, June 30, 1987 in the Janss Auditorium of the Snowmass Conference Center in Snowmass Village, Colorado. Thirty-one were present and a quorum was established. The president outlined the purpose of the meeting was to inform the members of the status of the affairs and activities of the corporation during the preceding year. It was moved by Leon Jeannot, seconded and carried to approve the minutes as published in the 1986 Proceedings. The chair called for reports of the various committees and these reports will by placed on file in the RMCMI Office. Bylaws and Resolutions. Chairman Loren V. Linville reported there were no bylaws revisions. He further reported that the Board had adopted three resolutions: (1) Noting the passing of members since the last convention-Benton Boyd, E. A. Hare, E. S. Moran, Jr. and Edward Prostel. (2) Of appreciation to the Executive Secretary, officers, chairman, Diamond Jubilee chairman and committees and convention committees for an outstanding job in preparing for the 83rd Regular Meeting of the Institute. (3) To recommend to all RMCMI members that, on an individual basis, they each oppose replacing coal fired generation with natural gas generation. Membership. Chairman Leon Jeannot reported that at the beginning of the 1986 fiscal year, there were 881 active or dues-paying members. During the year, 219 members were dropped for a variety of reasons such as non-payment of dues, transfer, employed elsewhere, change of address. Ninety-six new members have been recruited for an active total of 758. In addition there are 55 Life Members, 20 senior members, six scholarship winners and seven supporters for a net total of 846. The budget of RMCMI calls for 1,000 active members and we must address and plan for those short-term prospects as they will certainly impact our membership. A full report is on file in the RMCMI office. Patrons of the Institute. Chairman Ira McKeever reported that only 59 Patrons renewed their support during 1986-87. Program. Chairman Bill Balaz announced that the convention program theme "This is OUR Life", as presented in "Past", "Present" and "Future" segments was very well received. He called for additional helpers another year and suggested that next year's program format be changed to a hard hitting one. Publicity. Chairman Tom Egan reported that of the three newsletters sent members during the year, that the most effective one was the newspaper format one and recommended its use next year. RMCMI hired Bob Jacob who heads his own public relations firm to solicit advertising for the Proceedings on a contract/ commission basis. He attended the convention for this purpose and to solicit business card ads. A full report is on file in the RMCMI office. Scholarship. Chairman Keith McGinnis reported that five of the six scholarship recipients were present at the convention. Each was introduced to the membership at the Tuesday morning Scholarship Breakfast, presented a plaque and responded. The input from each winner was most favorable to the program. Each was appreciative of the many contacts made and the educational seminars and programs. The selection process started in March and was completed in May, except for one university which had difficulty in providing a candidate. It is suggested that the initial contact with the institutions be made in December and completed by April 1. This year, for the first time, three of the six universities were visited for the purpose of interviewing the candidates. They were Colorado, Utah and Wyoming. A very positive feedback was received from these schools and it is recommended that the practice continue. CONVENTION COMMITTEES Convention Arrangements. Doris Finnie presented the following report: As a professional meeting planner, this Diamond Jubilee convention was indeed a great challenge. One meal was added to the package and thus increased the individual cost. Snowmass Resort Association is unique in that they utilize a conference coordinator who acts as the middle man between myself and the usual persons we deal with, like AV personnel, the chef, the banquet director, the steak fry personnel, the Sunday tour etc. so the office had to become creative. For instance, we learned early on we could not deal with the local florists. It cost us lots less to buy our flowers wholesale in Denver, have my husband drive them up and our West Virginia daughter to arrange them! But, finally her floral arrangement class at CSU paid off! This was truly a Finnie family orchestrated convention. Our Lakewood daughter acted as Scholar-
