"Environment and the economy are interwoven irrevocably. They need to be publicly discussed, and discussed often so that new approaches can be understood and developed - approaches which are complimentary, not confrontational.Discussion on the environment is timely, from the perspective of mining engineers and developers, from that of bankers and from their shared perspective as people concerned with enhancing the quality of life, the environment and the economy.This paper will touch on how what is called the ""environmental economy "" that has evolved has become entangled with regulatory and financial issues in a way that is dangerous for all of us. It will also look at some of the promising possibilities that a world-wide and continuing concern for the environment holds out for us.For many decades, British Columbia has provided some of the key examples of the intertwining of environmental and economic issues, and, very importantly, providing the people prepared to do something about them.Canada's first environment minister, the late Jack Davis, came from British Columbia. He led this country's delegation to the Stockholm Environment Conference in 1972, a conference that laid the groundwork of principles necessary to establish some international certainty as to the legal liability for causing trans-national environmental damage.Another British Columbian who was also a national environment minister, John Fraser - now the Speaker of the House of Commons - was one of the first to dramatize the importance of acid rain and force it into the international public arena.Some 20 years ago, British Columbians made Vancouver and their province one of the major centres of opposition to the Alaska Pipeline and Tanker System - with some justification, it now seems.That a British Columbian , then MP David Anderson, was given legal recognition to sue in a United States' court against a system that was either in U.S. territory or international waters was an important precedent in, and of, itself in terms of environmental law. That old controversy is now a very current case study - in terms of dealing with the question of liability.-"

"One of the most significant developments in environmental law has been the development of mandatory project review processes, at both the federal and provincial levels.FederalWhile, in the past, project review processes have, f or the most part, been spelled out in guidelines, the guidelines have not had the force of law. All that has changed, particularly at the federal level, with the Federal Court decisions commonly referred to as the Old Man River and Alameda and Rafferty Dam cases. These decisions, taken as a whole, are authority for the proposition that the Environmental Assessment and Review Process Guidelines Order, SOR 82-487 is a law of general application, not a mere guideline which may or may not be applied. This federal environmental assessment process first provides for a screening, and, depending upon the results of the screening process, the possibility of a public review. This federal process only applies, however, when the proposal is being undertaken by a federal department, or where the Government of Canada makes a financial contribution, or where federal lands are involved, or where a federal licence or permit is required.Bill C-78, the Canadian Environmental Assessment Act, will replace the Federal Environmental Assessment and Review Process Guidelines Order once it has been passed by Parliament. Currently the bill is being widely discussed, both between governments as well as public interest groups.ProvincialOn the provincial scene, there are three project review processes, one concerned with new mines, the second with energy projects and the third with all other major projects. The most recent initiatives taken by British Columbia are twofold. First, the Mine Development Review Process which was in the form of a guideline, has been replaced by the Mine Development Assessment Act. Second, the Major Project Review Process has been formulated and is to apply to four main categories of major projects:1. Pulp and paper production;2. Mineral smelting and refining;3. Chemical products; and4. Major ports and marinas.Energy projects are governed by the Energy Project Review Process which is legislatively mandated under the Utilities Commission Act."

"The State of the EnvironmentRecent data from a State of the Environment report prepared in January 1991 and released in April (see references) , indicates that the physical and biological environment across Canada is deteriorating in some important ways. For example: • emissions and atmospheric levels of CO2 are rising at a rate more than 50% of the U.S. increase; global temperature continues to rise, especially during the last decade;• while S02 emissions have been falling since 1984, NOz has declined only slightly since that time; N02 in Canada rose 43% during 1970-87, compared with a 7% rise in the U.S.;• municipal discharges of phosphorus and BOD (biochemical oxygen demand) to fresh water have been rising steadily since 1983);• pulp and paper mill discharges to fresh and Pacific coastal waters have been rising, 1970-87;• migratory game bird populations (Prairie Mallard, Northern Pintail) have been declining for the last 20 years;• total per capita energy use continues to climb.The State of the PublicSimilarly, data from recent public opinion surveys shows that public concerns about the environment are either rising, or are remaining at a high level despite the competing claims of the economy and political events for attention.For example, Professor Reginald Bibby's national survey this year shows that Canadians rank our top three issues as theeconomy, the environment and government incompetence.An Angus Reid survey commissioned by the Mining Association of Canada and other mining organizations in 1989 showsthat, despite general support for its economic benefits:• 67% of the general public perceive the mining industry to be a major source of pollution and environmental contamination;• 68% believe that a new mine should not be developed if it will disturb local wildlife;• 52% would prohibit a new mine if it required a road through a national park;• 49% would disallow mine development if it took as much land as an average farm in an agricultural area or if it limited sports fishing in a local lake."

I welcome this opportunity to give a Congressman's birdseye view of a subject which I believe holds great potential for the future in helping meet the needs of people, with minimal adverse impact on the environment. All mankind, not just the people in this great nation, faces the need for additional usable space. In some parts of the United States the problem arises from rapid urbanization of the surface and little utilization of the subsurface. Everywhere there is an increasing problem of insufficient space arising out of the increasing population crush and growing demands for open space, housing, water, transportation, communication, and social service. You are the technicians to whom we look for assistance in finding answers. We look to you also to provide guidance for broad policy decisions concerning underground space. I prepared for a career practicing law, but since 1952 I have been a member of the House of Representatives. In this latter capacity I deal with programs designed to help solve all kinds of problems. But, naturally, I am especially interested in the water scarcity and other environmental problems of my home state of Arizona and the arid and semi-arid areas in the West. This North American Rapid Excavation and Tunneling Conference has as its theme: "Tomorrow's Tunneling Technology Today." I have a very great interest in this potential of our underground space resource. The Central Arizona Project now getting underway in my state will consist in part of tunnels and underground pipelines to convey life-sustaining water from the Colorado River to people and lands across Arizona to the Phoenix and Tucson areas.

Comparatively recent Tasmanian legisla tion established a series of rigid control standards for environmental protection just as ma spectacular expansion of the mining industry was nearing completion. Upgrading existing protection to obtain the necessary licence to operate under these new regulations required further major works and involved a considerable outlay of non- productive capital at a time when escalating costs and falling metal prices were straining economic efficiencies to the limit. Late in 1974 a major environmental protection scheme was commissioned by the Electrolytic Zinc Company of Australasia Limited at Rosebery on the West Coast of Tasmania. This 4 million dollar project was specifically developed by the Company ahead of and to meet the new standards for control of total effluents discharged from its zinc-lead -copper-pyrites mine and concentrator.

Stringent environmental benchmarks imposed by governments and successful legal challenges in the country of origin have changed the risk profile for all mining companies over recent years. In developing countries, however, where high government standards may not always be in place, direct community action has often made worthless substantial investments in otherwise viable mining operations. Real limitations are therefore imposed from these risks on all areas of mining activity, wherever they may be. Thus, the bar has been raised for all companies developing or operating mines. This paper argues real financial and global industry reputation benefits accrue when all known environmental risks, where practical, are managed. In response, among major international mining companies, as the industry moves towards greater global consolidation, senior management teams have increasingly adopted corporate governance standards including æTriple Bottom LineÆ (shareholder/government/community) sustainability reporting. Sustainability reporting is encouraged by improved international stockholder and financial investor perceptions by contributing to lowered social, community and geopolitical risk which lowers the cost of access to funds as well as improving staff morale and productivity. New mines must not only be primarily financially viable but must operate throughout in a sustainable way. Case studies of some recent mining operations, who have not foreseen or proactively managed major environmental risks, demonstrate the dire financial and personal implications for managers, directors and shareholders from not identifying and managing these environmental risks. Merely having a corporate policy statement on environmental standards or high level Government approvals process for a mining activity does not preclude mining operations from the risk of direct action by local populations or future adverse legal implications from risks which were perhaps identified but not mitigated effectively. Methods and processes for the identification and active management of environmental risks in the global arena are discussed to add a practical element to sustainability, based on the authors recent strategy development processes with governments and major mining houses such as BHPBillition, Rio and Xstrata. Emphasis is placed on proactive, innovative yet practical solutions which, where possible, show positive contributions firstly to the financial bottom line but also the community at large.

With respect to the present situation in mining and to the further technical development as well, a several times higher exploitation may be in this region expected, especially in the deeper .eated parts of the deposit. When solving the tasks of a complex economic exploitation over the whole region, consi- derable attention is paid to regional relations and impact studies (due to expected exploitation and ore dressing but also to very difficult problems of dewatering (drainage pro- blems-). It will be first of all necessary to find there an equilibrium between the consequences resulting from the re- naissance of mining industry and environmental requests un- dispensable for the city of Banska 9tiavnica and the other neighbouring towns in the vicinity of mining plants.

Anthropological diggings have revealed that the American Indians carried on intertribal trade in flint, obsidian, ochre, and other mineral commodities, indicating that mining was practiced before the arrival of the white man from Europe Carbon datings from the native copper pits on Isle Royal and Keweenaw Peninsula, Michigan, have yielded dates as early as 5555 BC for this mining. As early as Pliocene time, Eolithic-man fashioned artifacts of stones probably found on the surface, but by late Quaternary, Neolithic man was sinking shafts and mining underground for flint. Because placer gold was easily recognized and easily worked, it was used for ornamental purposes by nearly all cultures before other metals were discovered The Chaldeans hammered copper objects approximately 4500 BC and copper was used in India and China about 3000 BC. An ancient trail from the Nile to the Sinai led to the mines of copper and turquoise Paintings and bas-reliefs of Egyptian tombs dating around 3000 BC depict maps, mining, and smelting in this area. It is interesting that despite this widespread and long history of mining, Agricola records that the first mining laws were developed by the Greeks at Laurium about 700 BC. All of the base metals are known to have been produced in small quantities during the Colonial period in America, but perhaps the first commercial production was the iron ore shipped from Virginia to England in 1608, followed by lead in 1621. Among the earliest companies formed in America that still survive (according to the standard reference yearbooks), were: the Jackson Mining Co., predecessor of Cleveland-Cliffs Iron Co. on the Marquette Range, Michigan, in 1844; the Sussex Zinc and Copper Mining & Manufacturing Co., fore-runner of New Jersey Zinc Co. in 1848 (although the Franklin-Sterling body was discovered in 1640); the five companies, Pittsburg and Boston, Quincy Mining, Pewabic, Huron Mining, and Minesota all formed in the decade (1844-1855) that followed the rediscovery of Keweenaw copper, were combined into Calumet and Hecla; and Vermont Copper Mining Co. in 1853 Although southeast Wisconsin lead-zinc was discovered in 1690, Mine La Motte in southeast Missouri in 1720, placer gold in California in 1848, Comstock Lode in 1859, Leadville in 1860, Cripple Creek in 1891, no surviving companies of those early mining periods exist. It was thought by some . . . in the Middle Ages that burning coal filled the air with dangerous poisons. So great was the concern that in 1306 King Edward I of England passed the first and unquestionably the harshest, air pollution legislation edict that history will record. His proclamation declared the use of coal an act punishable by death." As related to coal mining the air pollution problem is primarily that of its customer when using the fuel. Thus the major impact relates to markets for coal rather than the actual mining operation itself. In the vicinity of the coal mine the problem is principally related to fugitive dust from roads, transfer facilities, loading facilities, crushers. etc., and particulate matter (dust or fly ash) from thermal dryers and air cleaning tables. FUGITIVE DUST Most state air pollution regulatory agencies now have rules and regulations requiring control of fugitive dust. This refers to dust generated from normal processing operations. We report Hitachi's approach to establish the recycling process for rare-earth metals in magnet. We have developed a process to disassemble the used electric products to collect the magnets, a process to remove the surface plating film of the magnet, and processes to separate rare-earth metals from the magnet. All processes are operated without chemical solutions in order to minimize the environmental impact due to the waste water emission. For the disassemble process, we have developed an equipment to generate continuous shock on the electric products to loosen screws. A sand blast technique is applied for the plating removal process. Rare earth metals in the magnets are extracted by immersion of the magnets in molten magnesium. The extracted rare-earth metals are separated from Mg by evaporation of Mg. The overall yield of recovery is 86.8 %. The purity of the final rare-earth metal is 98.8 %.

The soil covering this earth is only a very thin outer layer, varying in thickness from a few inches to a few feet and covering the rocks and minerals lying beneath the surface. The wise use of this valuable commodity is the responsibility of everyone. Many everyday activities disturb the earth's surface. Examples are highway construction, housing and commercial developments, agriculture, and surface mining. This chapter discusses the relationships of the environment to land as it applies to surface operations ill the coal industry. Mining by surface methods disturbs, for a brief period of time, thousands of acres of land annually. In addition, refuse piles, slurry ponds. abandoned mine structures, unprotected mine openings, and unsightly cleaning plants can also adversely affect land unless properly handled. ACTIVE SURFACE MINING OPERATIONS Mining by surface methods includes rock quarries; sand and gravel pits; huge open pits to extract iron, copper, phosphate, and other ores: and coal mining. Production of coal by surface methods is now approaching 300 million tons annually, amounting to almost 50% of the total coal output. Surface coal mining can be classified into the following four broad categories: Open pit mining is practised where the coal beds are extremely thick, as in some western states, or where the coal beds are sharply pitching, as in the anthracite region of the eastern United States. Water is a most remarkable substance. It is essential for life of all kinds. Not only can no one live without water, but man has always needed water for farming, raising animals, manufacturing, transportation, and recreation. When our country was young and inhabited by few people, the streams, rivers, and lakes were able to provide all the clean water needed by man and take away all the wastes created by man. However, with our growing population and our ever-increasing demand for goods and services, the public, industry, and government at all levels have become aware of the need to more efficiently manage the water resources of this nation. Coal has helped this nation to become the greatest industrial nation in the world. Coal has generated our electricity, run our railroads, and helped arm our nation during wartime. The result has been the highest standard of living in the world, a time of widespread prosperity, and a national defense potential that has delivered the hardware during four wars in this century. The use of water in coal mining is somewhat different than in most industries. With the exception of the small amount of water used in cleaning plants and for fire protection, most of the water encountered in coal mining operations is unwanted since it serves no useful purpose. In other words, it must be removed, otherwise it will interfere with mining operations by flooding. In the past, removing water from working areas of most mines was usually a fairly simple matter. Pumps with piping were installed at sumps or low spots in the mine and the water was pumped to the surface. Advancements in tunneling technology and underground construction, plus rapidly rising costs of land, and a higher priority being placed on urban esthetics, make tunnels a more attractive option for certain portions of the highway construction program. Recent emphasis placed on fuel conservation reinforces the need for tunnels as a means of shortcutting circuitous routings designed to avoid potentially undesirable environmental impacts on any given area. Larger and more complex tunnels which have been constructed in recent years attest to this greater interest. More than 100 major highway tunnels are in operation in the United States. Highway tunnels commonly have much higher initial cost compared to surface routes. Where extensive cut and cover is involved, temporary disruption of the surface area may prove costly. In exchange for these costs, certain environmental advantages result. The purpose of this paper is to discuss some of the environmental advantages of highway tunnels and some of the unsolved problems related to obtaining maximum use of highway tunnels and research underway to help solve these problems.

Many disputes related to environmental issues in mining are resolved through often-antagonistic negotiations in a regulatory context or through litigation. These approaches are certainly the best choices for resolving certain disputes. However, just as no single remediation technology is the right fit for every site, so no single dispute resolution process is the best choice for every situation. This paper introduces a range of dispute resolution alternatives (from collaborative decision making through mediation, arbitration, and litigation). Especially when money is tightest, cost-effective dispute resolution(and the outcomes that can accompany it) can have an impact on the bottom line.
