Thank you very much for that introduction. I spent part of my early career in the coal industry here in Colorado, and I am always happy to return. In such a beautiful setting, it seems out of place to talk about "Improving the Climate". But in our work-a-day worlds, we know the climate for the coal industry is something less than picture perfect. But unlike Mother Nature's climate, there are some things we can do about the climate for coal. Today, I want to talk to you about sonic of the activities that we are engaged in... and that you can support... to improve that climate. A number of challenges and opportunities face our industry. I will try to set the stage for this conference by briefly describing the current climate for coal - which is indeed very challenging. I will then outline some of the steps we are taking to broaden our base to include our allies in the rail and electricity industries and the public at large.

DR. BANOWSKY: Thank you very much. That was the shortest introduction that I have had lately, and I didn't have time to get my coat on. But I appreciated it, and I'm delighted to be here with an industry with which 1 feel strong affinity. At the University of Oklahoma we have an energy history. We are a little more currently involved in oil and gas, and those of you who know the history of our state would be aware we have an early coal development back really before the turn of the century in the southeast part of our state what we call Little Dixie. How many of you have spent anytime in Oklahoma or are from the state of Oklahoma? I'm not going to ask how many are from OSU or the University of Colorado. We did send you a football coach here from Oklahoma, and 1 see you have exchanged him. Several of you were only interested in the lobby in asking about our football team this year. 1 would like to go somewhere where we can talk about something besides football. I'm just trying to build a University that our football team can be proud of. We're going to be strong again. 1 can assure you. We've got the best football team money can buy. It's not quite as bad as the college president who called the coach in and said, "Coach we're in trouble, you're losing games and the alumni is very unhappy." "What can we do?" the president asked. The coach said, "Well the football team is flunking the admissions test. We can't get them in with the standard achievement and SAT tests." The president said, "What can we do?" The coach said, "Well the coaching staff has substituted for the American College Test the simple fill in the blank questionnaire." The president said, "Let's use it. We have got to get the team in." The first question was, Old MacDonald had a (-). And a couple of the big tackles were taking it and one of them said, "Hey, what did Old MacDonald have?" His friend said, "Stupid, Old MacDonald had a farm." "Well how do you spell farm?" He said, "Stupid, e i e i 0." Now the gentleman who met me at the registration line from Lakewood, Colorado, was asking me about one of our great big tackles; and he is doing well. We call him Doctor Death; he is also a wrestler and that gentleman said, "1 don't know how bright he is." 1 said, "He is bright enough for our academic tutoring that he is going to get through all right." So I'm delighted to see you and be here with my very dear friend, Carl Terzian. Carl and 1 were in Los Angeles together for 10 or 12 years when I was president of Pepperdine University. He and I are exactly the same age. Born in 1935 and 1 a month or two later in 1936. Fewer children were born in that period than in any other period of time in this century. For those of you who remember anything about that period, you will know why no one was having babies during that period. But Carl called and said, "Bill do you know where Vail, Colorado is?" Well when you live in Oklahoma, you learn where Colorado is in a hurry. 1 not only know this beautiful area, but have made too much of an investment here at a place called Beaver Creek. The real estate is cheap over there. 1 play regularly in the Gerald Ford Invitational Golf Tournament here. Hope you will visit Beaver Creek. It's just 10- 12 miles to the west. The sight of the 1976 winter olympics until the people of Colorado voted them out. And now Vail Associates and I are good Oklahoma families. Bass family, Harry Bass of course, many of you know this story, who is chairman of the Board of Vail Associates, is making quite an investment in that year-round resort area. On suggestion of Mr. William Littlejohn, the President appointed a special resolutions committee, consisting of Messrs. P. J. Quealy, R. L. Hair and William Littlejohn, to draft resolutions protesting against the granting of a franchise for piping natural gas into Salt Lake City, to be sent to the City Commissioners of Salt Lake City, with carbon copy to the Utilities Commission of Utah. The Committee submitted resolutions which, upon motion of Mr. Littlejohn, and seconded by Mr. Butler, were adopted and sent by telegraph to the Utilities Commission and the City Commissioners.

The Tuesday Morning session opened at 9:00 a.m. and was presided over by Mr. E. C. DeMoss, Vice President, Utah Construction & Mining Company, San Francisco, California. Mr. DeMoss introduced Mr. C. Howard Hardesty, Jr., Senior Vice President, Con¬tinental Oil Company, New York, N. Y. Mr. Hardesty spoke on the "Relationship of Coal to Progress in Oil Industry." Mr. Hardesty was born in Fairmont, West Virginia, 1922. He is an attorney by profession; he attended Mercerburg Academy in 1939 and received a Bachelor of Science degree from Duke University, 1943. He then served three years in the U. S. Navy and returned in 1946 to obtain his LL.B. from West Virginia University in 1949. Mr. Hardesty has had an outstanding professional career which started as a partner of the law firm of Furbee & Hardesty, Fairmont, West Virginia. He subsequently was West Virginia's State Tax Commissioner and President of the West Virginia Bar Association. In 1963 lie became General Counsel of Consolidation Coal Co., Pittsburgh, Pennsylvania; in 1964 he was made Vice President, Secretary and General Counsel, Consolidation Coal. In 1966 he was elected Executive Vice President of Consol, and, shortly after it was merged with Continental Oil Co., he was made Senior Vice President of Continental. He is married to the former Doris Wilson; they have two children and reside in Greenwich, Connecticut.

The Bituminous Coal Industry has for the past year been faced with a most serious problem. I am sure that you have had your own individual and local problems, as do we all. In my thirty years of practical experience with coal mining, I have never found an operating man nor a coal mine without problems. The very nature of mining, with so many unknown factors involved, precludes the absence of problems. But they are not insurmountable, and one should not dwell on them interminably. They should be recognized as a challenge to our ability and ingenuity to solve them, and once the proper solution is found, it should be applied and the problem dismissed. However, we find ourselves at the moment in the midst of a serious challenge to our very existence. In the early thirties, many in the industry welcomed the re-establishment of Unionism as a balance wheel, in the belief that the stabilization of wage scales would also stabilize prices and eliminate disastrous price cutting practices. The ultimate effects of having twenty-six years of benevolent paternalism in the administrative branches of Federal and State Governments with their labor courting policies, could hardly have been anticipated. And so with wages spiralling under government sponsorship, we have finally reached the point where competitive fuels, such as natural gas and oil are more attractive to the consumer, from the economic angle of cents per BTU cost, than coal.

Oren Bridwell, Chairman of the Resolutions Committee, gave the following report: Resolved: That the members of the Rocky Mountain Coal Mining Institute in convention assembled, hereby ratify and confirm all official actions of the officers, the Executive Committee and other committees of the Institute between June 29, 1960, and the present time.

Thank you, Tom, I appreciate that generous introduction - and your generous welcome. When Doris Finnie asked me to speak here today, my decision to join you couldn't have been easier - for two reasons. First, I can't say no to an opportunity to return to Steamboat Springs. My family has wonderful memories of skiing here. And this time of year, golf in the mountains is so good you almost don't miss the skiing. The second reason this was such an easy decision is that The Rocky Mountain Coal Mining Institute is such an important forum for the coal industry, and it's certainly important to Peabody. We have mines in five western states - Arizona, Colorado, Montana, New Mexico and Wyoming. Last year, our western mines produced more than 110 million tons of coal. That's about two-thirds of our total domestic production. So western states are obviously critical to us. A couple of weeks ago, the west became even more significant to Peabody. Of course, I'm speaking of PacifiCorp's planned acquisition of The Energy Group - including Peabody - announced the middle of this month. Admittedly, when I agreed to speak here - some months ago - I had no idea just how much change Peabody would face in this relatively brief period. Still, not knowing then about the PacifiCorp announcement, I chose change as the subject for this talk. I'll update you on our recent news. But, first I want to establish a broad context for the PacifiCorp/Energy Group announcement and other change in the electricity business, change here in the United States and all over the world. ? We'll see how change is driven by two major trends - privatization in emerging markets and deregulation in mature markets, In turn, those two trends will cause ever-increasing consolidation - in both the coal industry and the broader power industry. ? After outlining those trends, I'll discuss the change that will dramatically affect Peabody following the announcement a week ago that PacifiCorp and The Energy Group intend to join forces to create one of the world's largest international integrated energy companies - an event that adds considerable credibility to the prophesies I'll outline in my remarks today. ? Finally, I will discuss an issue that threatens our industry's future - and, indeed, the economic future of all Americans. That issue is the inappropriate response to the unproven possibility of global climate change. Let's set the stage for change. And let's begin with the first trend I mentioned - the trend to privatization in developing economies. What drives the trend to privatization? Economics. It's all about the supply and demand of capital. And the engine that drives the supply/demand ratio is growth in electricity demand - tremendous growth in demand in developing economies. The U.S. EIA projects worldwide growth in electricity demand at 63 percent between 1990 and 2010, most of it in developing countries. This strong growth means that a new 500 MW power plant will be needed every three and one-half days until the year 2010. Now, if we say that a 500 MW plant will cost about $500 million dollars, we're talking about a bill of about $1 billion dollars a week - through 2010. That voracious demand for capital drives the trend to privatization. It means countries in Eastern Europe and the former Soviet Union want to sell generating assets. And Asian countries - for example, India, Indonesia and the Philippines - want to find private investors to build power plants. Privatization already is well underway. In the future, it will grow, with countries in South America, Central America, and Africa joining the trend. Bottom line: The privatization trend means rich new opportunities for companies willing to think beyond "business as usual." Meanwhile, developed economies face a different but no less fundamental change. Western European countries, the United States and Australia face deregulation. Why does deregulation represent such a big change? Consider a few basic facts about the U.S. electricity market to see what a big change -

Pictured on these pages are seven of the eight RMCMI Scholarship Award Winners for the 1993- 94 year followed by a brief profile. Seven of the eight winners were present as guests of the Institute at the June convention in Snowmass Village, Colorado to receive recognition at the Institute Awards Luncheon Monday, June 27, 1994. Due to another conflict. Jason T. Dale of Wyoming was unable to attend. Each state vice president sewed as the host for the collegiate winner. In addition to receiving a plaque from the Scholarship Chairman. Alan Czarnowsky, each winner receives $750 tuition credit for the coming academic year, as well as transportation, hotel lodging and meals at convention as guests of the Institute. Because this is a continuing award, the winners from the previous year will receive another $750 for tuition credit in their senior year if they have maintained good academic standing and are recommended by their university. A resident from each of the eight RMCMI member states is selected from among Board approved institutions. Criteria for these awards to be made in the spring annually is (1) That the award be made to a sophomore student and used as tuition during the junior year. (2) That the recipient be both a U.S. citizen and a resident of the member state. (3) That the recipient have good academic standing, be pursing a degree in a mining related field and have an expressed interest in Western coal as a possible career path. The scholarship program includes curricula other than those in the mining departments, but in engineering disciplines, such as geology, mineral processing and metallurgy. Contributions to this worthy project are tax deductible to each individual RMCMI member or his firm. Through annual donations of $100 or more, the Patrons of the Institute fund the scholarship program and the various vice presidents contribute the travel expenses to convention for these outstanding young collegiates. She is majoring in Mining Engineering at the University of Arizona in Tucson, Arizona, but recently is considering switching to Environmental Engineering with emphasis on mining. She told the Scholarship Chairman that if she wasn't part of the solution, she was part of the problem. Christy has received numerous awards during school including being on the honor roll and university chapters of Society of Mining Engineers. Besides her academic activities, which includes being a member of Student Council, Christy is quite an athlete and enjoys basketball, softball, tennis, golf, and soccer. Last summer, she worked as a safety assistant/laborer for the Magma Copper Company. This summer, Christy is working in the safety department at Magma Copper Company's Pinto Valley Mine in Arizona. FEBRUARY 20TH. MORNING SESSION: The fourteenth regular meeting of the Rocky Mountain Coal Mining Institute was called to order in the Magnolia Room of the Albany Hotel. Monday, February 20th at 11 o'clock A. M., with the President, Mr. R. M. Magraw, in the chair, sixty-two members being present. The first number upon the program was the reading of the minutes of the previous meeting by the Secretary. There being no corrections or alterations, the minutes were approved as read. As Mr. Dan Harrington was unavoidably absent, his paper, subject: "Coal Mine Accidents and State Mining Law" was, by request of the President, read by Mr. J. Q. Lalor. Following this was a short discussion. There being no further business the meeting adjourned. AFTERNOON SESSION: The meeting was called to order in the Magnolia Room of the Albany Hotel at two-thirty o'clock P. M. with President R. M. Magraw presiding, fifty-eight members being present. Mr. Ben Shubart and Prof. J. C. Roberts were appointed a committee to draft and telegraph a message of condolence to Mr. E. S. Brooks of Rock Springs, Wyoming, on account of the recent death of his daughter. The com¬mittee submitted a copy of the following telegram, which was read by the Secretary: "E. S. Brooks, Rock Springs, Wyoming. We extend to you and your family our sincerest sympathies in your deep affliction. (Signed) THE ROCKY MOUNTAIN COAL MINING INSTITUTE." In this very interesting paper, Mr. Harrington mentions a considerable variety of materials suitable for use in the rock dusting of coal mines; this suggests that you may possibly be interested in same purely theoretical figures tending to show the superiority of gypsum for this purpose. Some of the gentlemen present have found difficulty in applying a thick, adherent coating of dry gypsum to the ribs and roofs of their workings, for which reason pulverized gypsum will perhaps be chiefly useful for the loading of barrier troughs. In view of the function that rock dust is expected to perform in case of a coal-dust explosion, it seems obvious that the most efficacious dust will be the one that can absorb the most heat and absorb it most rapidly. The customary rock dusting materials differ considerably in this respect, depending principally upon the facility with which they can be decomposed at the temperatures encountered in a coal-dust explosion. Such stable materials as silica, anhydrite and flue-dust vary but slightly in their heat-absorbing capacities, the specific heats of minerals in general ranging between 0.19 and 0.22; on the other hand, gypsum and limestone, as well as certain argillaceous materials such as shale, adobe, etc., are capable of absorbing additional heat through their chemical dissociation, although, as will appear later, it is questionable whether the amount of heat thus absorbed, in the case of limestone, shale, and adobe, is large enough to have any practical value. As to the temperature developed by a coal-dust explosion, the Bureau of Mines reports one test in which gold foil was melted, and others in which silver foil was melted, but not gold; hence 1832° F. (1000° C.) seems a reasonable figure to assume for purposes of calculation. Normal temperature is taken as 68° F. (20°C.). The other fundamental data required for the computations as cited by various authorities, are as follows: [Specific heats Gypsum : 0.259 Calcium sulphate, anhydrous. . .190 Limestone 0.216 Lime 0.239 Clay, shale, silica, etc. usually not exceeding 0.220 Carbon dioxide .:0.217 Steam (at atmospheric pressure)0.500 Heats of formation CaSO4+2H2O-4.606 Kg-cal. per gram molecule, or 48.2 B:t:u.' per pound of gypsum.- CaO +C0,42.5 Kg.-cal. per gram molecule, or 765 B.t.u. per pound of limestone. Latent heat of vaporization of water. from and at 100°C.. 535.9 Kg.-cal. per kilogram (964.6 B.t.u. per pound).] Computations will be based on the Fahrenheit scale and British thermal units, as probably more familiar in the coal industry. First as to the inert materials: their heat-absorbing capacity per pound is simply the product of their specific heat, say 0.22, multiplied by the assumed rise in temperature, 1764° F., or 388 B.t.u. per pound. Gypsum, CaS0, 2H.0, though apparently perfectly dry, contains 21% of combined water. When gradually heated it will have liberated three-quarters of its water freely by the time it reaches 250° F.; the remaining one-quarter is retained to a somewhat higher temperature, but the last of it will have been expelled at 482° F.
