The human element in large measure dictates success in contracting relationships. Because of our professional backgrounds, we view contracts primarily as either engineers, contractors or owners. A beneficial contractual environment--one in which decisions, risks and benefits are shared--demands equal consideration of all three points of view. Most of the older cities in the United States, for example, suffer from bad contracts--generalized, patched-together documents that represent an accumulation of modifications originally written to compensate for specific situations that have occurred over the years. Because such documents lack coherence, they often present conflicting instructions which lead to defensive, ultimately destructive attitudes among the parties involved in the day-to-day administration of the project. Good contract development begins with a strong central philosophy to which the details of the contract can be related. First, the owner should establish a comprehensive philosophy in which risks between the parties are identified. Following this, a specific contract document can be written to satisfy this established philosophy. The contrast between two opposed contractual situations, NYC Water Tunnel Number Three and the Seabrook Nuclear Power Plant Cooling Water Tunnels, illustrates how comprehensive, well-written contracts--contracts which share both risks and benefits--provide the basis for achieving quality construction that will reward engineer, contractor and owner.

I am indeed honored to be the 1991 recipient of the Daniel C. Jackling Award. To be voted this honor by my peers in the Society for Mining, Metallurgy, and Exploration and AIME means more to me than I can truly express. Daniel Jackling's position and prominence in the mining industry first came to my attention in the fall of 1949 when I transferred from Wisconsin Institute of Technology, then a three-year school, to the Missouri School of Mines to complete my last year for a bachelor's degree in mining engineering. I played basketball in the Jackling gym and ran track on the Jackling field. I didn't know a lot about Jackling then, except he was an honored graduate of the school and, obviously, supported the school financially. Over the years, Jackling's name kept coming up. He was a man with a reputation for being a doer, a mining leader who was always a step ahead, a mining engineer who knew how to motivate men in the working place, to organize mining systems, to finance and organize corporations. to open up new, low-grade ore bodies for exploitation. If Jackling were alive today, I would expect he would bean excellent candidate to apply practical rock mechanics to his projects. Looking over the list of Jackling Award recipients, I have known many, have met many personally and had a few who were dear friends that affected my own professional life. Ab Shoemaker, '58, and I consulted at the White Pine Copper Co. on mining problems in the 1960s. We arranged for our visits to the mine to coincide so that we could collaborate on our ideas. I would rent an auto and drive for Ab. He said he was the only mining engineer in the country that had a PhD for a chauffeur. James Boyd, '67, was my mentor as regards the White Pine Rock Mechanics Program that we organized in 1963. Only through Boyd's forsight. leadership, dedication and willingness to spend money on research and development did the Practical Rock Mechnics Program at White Pine succeed. He never wavered in his support to that program or to me personally. Tom Howard, '75, was my predecessor in 1970 as Director of Mining Research for the US Bureau of Mines. When I joined the Bureau in August 1970, he had the research centers up and running. Any successes I may have had with the Bureau of Mines were due in great part to Tom's leadership and organization throughout the 1960s. Gene Cameron, '68, was my teacher at the University of Wisconsin and I remember him fondly. He was the one professor who lectured in a manner that made me welcome going to his classes each day, a truly remarkable educator. If you have come today to listen to me talk about instrumentation, rock properties, stress-strain relationships, rock mechanics theory, etc., you will be disappointed. Large volumes of data have been collected by well qualified theoreticians to define stress-strain conditions in mines. Unfortunately, very little of this data has been used by industry due to the lack of initiative and understanding by the researchers to the true problems of implementation in the industry. I hope my remarks will assist future investigators to work through the maze of operational problems so they will experience the satisfaction of seeing their research used. I fully realize that the Jackling Award is given by the Society for Mining, Metallurgy, and Exploration and is primarily offered for accomplishments in hardrock mining. I have found it impossible to separate hardrock and coal mining when I talk about "Applied Rock Mechanics." There is too much overlap and the same mechanics principles are applied to both. For example, coal mine designs have been applied to salt, trona and potash. Also, the original layout and design of White Pine Copper Mine was based on coal mine designs. "The Mine Improvement and New Emergency Response Act (MINER Act) of 2006 established the Office of Mine Safety and Health (OMSH) within NIOSH and provided authority for awarding contracts related to the development and implementation of new mine technology and equipment. Subsequently, Congress provided additional funding to NIOSH to initiate and continue the program. OMSHR has fulfilled this Congressional mandate through annual Broad Agency Announcement (BAA) solicitations, directed Requests for Proposals (RFP) and Inter-Agency Agreements (IAA), and has further expanded the program through capacity building BAA contracts with U.S. university mining departments in the areas of mine ventilation and ground control. This paper describes the extramural funding program and broadly examines the results of the 150+ contracts issued to date, grouped into key focus areas. INTRODUCTION The Mine Improvement and New Emergency Response Act (MINER Act) of 20061 established the Office of Mine Safety and Health Research (functioning as the Office of Mine Safety and Health Research or OMSHR) within the National Institute for Occupational Safety and Health (NIOSH), and provided authority for awarding contracts related to the development and implementation of new mine technology and equipment. The OMSHR external contracts program was formed in accordance with the MINER Act and has since issued over 150 contracts focused on worker health and safety. Initial funding for this program was provided by Congress through two Emergency Supplemental Appropriations (ESA) and was focused on emergency oxygen supply, communications and tracking, and refuge chambers (also referred to as refuge alternatives). Since the MINER Act, Congress has continued to fund the program through the annual NIOSH mining appropriation. The program was supplemented starting in 2009 with an academic capacity building program directed toward developing university tenure-track faculty and facilities and supporting graduate students in the area of mine ventilation; ground control was added as an additional focus area in 2011. A short synopsis of each contract is published on the NIOSH Mining website2 and final reports are available in digital form on request. A summary of the progress OMSHR has made over the 10-year period since the Act was published previously.3"

Performing risk analyses on tunnel projects has become common place and on many projects it is required from an owner or regulatory perspective. After the project is planned, designed and constructed, the data concerning identified risks, assumptions, costs, probabilities and mitigations is generally long forgotten and buried in some file somewhere. A study was performed comparing predicted risks versus actual events on several recently constructed tunnel projects. Probabilities and costs for selectively common risks on tunnel projects have been studied and re-evaluated. Conclusions are presented that can guide future projects and the veracity of the tunnel risk analyses performed.

"The Vietnamese economic growth of more than 5% per year leads this country to an enormous demand for raw materials. In the duration of ongoing expansion, the big challenge in the coming decades will be to make this process as sustainable as possible when it comes to economic, environmental and social objectives. Risk management especially in occupational safety and health (OSH) in enterprises is one of the most important tools to achieve this aim. But until now, this has not been taken into priority by Vietnamese coal mining enterprises. Main reasons for this situation can be found in deficient legislative conditions and in non-synchronized risk management systems. In contrast, Germany has implemented an adequate legal system and the German mining industry has gained lots of experiences in risk management, especially in occupational safety and health. This paper seeks to point out specific challenges how to improve occupational safety and health in Vietnam by transferring and applying German methods and standards."

Bulkheads, also known as hydraulic seals, are used to seal abandoned workings and protect adjacent active mines from explosion and control unwanted inflows of water from poorly sealed shafts, water-bearing strata, and abandoned mine areas or gobs (1). At coal seam outcrops, bulkheads have typically been used to prevent access and to control acid mine drainage. Bulkheads have also been installed at outcrop openings located within the footprint of an embankment dam, or within the reservoir of an impoundment, to prevent stored water or slurry waste from flowing into active or inactive underground mine workings (2). Components of MICON Bulkhead Seal MICON bulkhead seals in mining applications refer to seals designed to impound liquids or slurry. The MICON bulkhead seal is comprised of two concrete block walls set in the front and back and a polyurethane/aggregate core (Figure 1). The two walls are usually dry-stacked, surface-bonded walls constructed with solid load-bearing concrete blocks (ASTM C90) or concrete building brick (ASTM C55). The surface bonding material used in the wall construction must be MSHA-approved. The type of stone, if any, used to fill the space between the walls is not essential. However, MICON generally uses No. 57 limestone in 50 lb. bags, specified to moisture control, shrink-wrapped and palletized. The polyurethane foam used in the construction of the bulkhead seal is engineering specified and formulated by density based on the optimization of cost, seal core thickness, required adhesive strength, the use of stone filler and other required physical properties.

Dump truck operators are exposed to whole-body vibration (WBV) levels that exceed the International Standard Organization (ISO) 2631-1. The WBV level measured by RMS acceleration value, for operator comfort, and long-term health and safety is under 0.315 m/s2 by these standards. However, fundamental research by Frimpong and Aouad (2009, 2012) and field experimental study by Kumar (1999) have shown that operators are exposed to extreme WBV levels exposing them to injuries and musculoskeletal diseases in the long-term. These extreme WBV values in the vertical direction are equal to 3.56 m/s2, 1.12 m/s2 and 0.87 m/s2 for the operator?s seat, lower-back and cervical regions, respectively. In recent years, Computational Fluid Dynamics, CFD, has been commonly utilized in the mining industry to model the fluid flow behavior in underground mine workings. This paper uses CFD modeling to simulate the airflow behavior in underground crosscut regions, where brattice sails are used to direct the airflow into these regions. Brattice sails are cost effective ventilation control devices for temporary or permanent use in underground mining. They can be used to deflect air into the unventilated areas such as crosscut regions. Their design and installation is a fundamental issue for maintaining a sufficient supply of fresh air and achieving effective air circulation and contaminant removal. At the same time, they should have little impact on the mine ventilation system. This paper presents the results of a two-dimensional CFD model, which examines the effects of brattice length on fluid flow behavior in the crosscut regions. The results of this study will assist in understanding the ventilation air behavior and in determining the optimum size of brattice curtain (sails), which provide a highly effective contaminant removal from the unventilated mine areas. This, in turn, helps the mine ventilation designers to meet the mine safety requirements.

It is an honor to present the lecture in honor of Daniel C. Jackling, the developer of the technology of copper mining that we continue to use 100 years later. He made a dramatic breakthrough in the early part of this century in the development of bulk-mining methods for large, low-grade porphyry copper-sulfide ore bodies. At Magma Copper, we are particularly proud that the Jackling Award states we have "made significant contributions to technical progress." Before Jackling's time, copper mining had exploited with primitive equipment very high-grade underground ore bodies and high-grade open pits. During the 20th century, the situation changed. Three significant innovations occurred within about 10 years around the turn of the century. In 1903, Jackling's concept of large-scale mining with steam shovels and rail haulage was implemented at the Bingham Canyon mine in Utah. Eighty years after the introduction of rail haulage, the mine converted to truck haulage with large-capacity high-efficiency haul trucks and reduced the stripping ratio from 3.5:1 to less than 1:1.

Underground mining has yet to see an industry wide solution for control of their ventilation systems due to the complexity and sensitivity of the underground environment. Complexity arises from multi-level, multi-zone operations and sensitivity is associated with the impact that changes in equipment status and output have on air flows and quality throughout the mine. Our approach to solving this challenge incorporates system modeling and industrial control systems in a unified architecture. Although this approach can be applied to other processes and industries, this paper will cover the theoretical and practical aspects of an integrated model-control system (MCS) as it applies to underground mining ventilation.

Microorganisms are directly or indirectly involved in many chemical alterations and in the decomposition of minerals required for their growth. Microbial dissolution of sulfide minerals under acidic conditions can produce over 1,000 times more Acid Rock Drainage (ARD) than chemical action alone. Microbial actions can cause precipitation of minerals, adsorption or release of metals, and formation/destruction of organic-metallic complexes. Soluble minerals can serve as oxidizing substrates, electron donors/acceptors in redox reactions, and can be directly involved in cell metabolism. Microorganisms and microbial oxidation-reduction reactions and their contribution to mineral mobilization and stabilization will be discussed.

Improvements in miners? safety and health, as reflected by injury and illness statistics, have reached a plateau and even been reversed. Research into miners' OSH is a necessary adjunct to regulatory enforcement. Under the National Occupational Research Agenda (NORA) mining experts have come together to draft a national agenda for this research. The Mining Sector Council, one of ten NORA Sector Councils, has produced a draft national research agenda to guide all mining research entities: academia, government, and industry. The agenda has seven major objectives, each of which has a sequence of sub-objectives: Reduce the likelihood of disasters in mines; Improve mine disaster response; Improve the health of miners; Improve atmospheric control (ventilation) in mines; Improve health and safety through behavioral research; Improve mine design, systems operations, and management performance to enhance mine health and safety; Apply ergonomics, human factor engineering, to increase health and safety. Long-term maintenance of the Mining Research Agenda requires input from the public, both here and abroad, monitoring of the impact of research results using OSH data, and partners who will translate the research to practice.

A model of a new laboratory magnetic separator has been conceived to cater the needs of process engineers and mineralogists world over engaged in mineral characterization and beneficiation. It would be essentially a laboratory instrument for the separation and concentration of various ferro and non-magnetic minerals. Based on the basic concept of Frantz Isodynamic Magnetic Separator, the new separator conceived would not only speed up the work of a process mineralogist and save the energy, but it would effectively separate and sequentially produce about fourteen fractions at a time. In the present paper, the probable operational procedures and the design have been discussed in detail for the various mining companies to assess its economic feasibility. If it could be fabricated, it would have a worldwide market The concept has been patented in author?s name in India.

Drillability of rocks by mechanical means is closely related to the physical properties of the respective rocks, Various approaches by previous investigators on rock drillability are presented, as well as recent techniques studied by the Bureau of Mines. The studies show drillability concepts based on (1) theoretical drilling equations derived from laboratory drilling experiments extended to field drilling results and on (2) a statistical method where multiple regression analysis is used to develop a prediction equation for drillability.

An important problem in mine operations is the classification of material as waste, low-grade stockpile, and ore. This classification must often be made with blasthole data that are widely spaced and that have sampling errors. Geo-statistical simulation techniques combined with basic economic principles allows a procedure for classification that maximizes expected profit. Geostatistical simulation methods (Gaussian, indicator, or annealing-based) allow the integration of hard and soft data in the creation of alternative, equally-probable, realizations of the mineral grade(s). At each location, for each realization, we calculate the "profit" if the block were to be classified as ore or waste The optimal classification is the one that maximizes expected profit (a Maximum Profit Se-lection (MPS) procedure). We discuss the theoretical justification of the method and implementation details. The use of blasthole data from different types of mineral deposits, that is, different levels of continuity, is considered. We also show the efficacy of the procedure with different levels of sampling error. The increased revenue due to the MPS procedure and improved sampling is shown. We show the geostatistical simulation procedure and the uncertainty in block grades that result from incomplete and imperfect sampling. The optimal classification is presented. Optimal block classifications are transferred to realizable dig-limits by hand-drawing polygonal boundaries. We compare the results of the proposed method to classification based on kriging. Limitations and areas of future work are identified.

By integrating field observations, OSHA data analysis, systems mapping, and a hierarchical occupational health pyramid, this framework identifies site-specific hazards while addressing broader socio-cultural dynamics. The approach improves upon existing safety programs by suggesting actionable, locally sensitive solutions that prioritize higher-order controls such as hazard engineering interventions and administrative controls. This study contributes to enhanced worker safety, efficient environmental restoration, and engagement in marginalized communities with abandoned mine lands.

Entrapments are a huge risk in underground mines. This happens when miners (or any other persons who have entered underground) survive the initial event of an accident, become trapped or lost in unknown and life-threatening locations after evacuation, and remain unaccounted for. At this point, every second counts, and emergency response is highly desired for any chances of saving survivors. The survival chances of the missing persons depend on how quickly they can be located. Rescue teams are often deployed to search for the missing persons underground. However, the rescue teams are forced to search in random and presumed areas of the mine. This is due to the unavailability of information pertaining to the whereabouts of the missing persons. Not only the provision of accurate locations, but various other types of information such as post-accident two-way communication can enhance the survival chances of the missing persons. This information can be provided by a fit-for-purpose missing person locator system. A wide variety of missing person locator systems are already commercially available, some are in testing phases and others in prototype and development phases. This includes tracking, tracing, location detectors and post-accident two-way communication systems. These systems have unique functionalities, capabilities and limitations; making it difficult for mines to select the most effective, applicable and suitable system specific to their mine. In this study, the user requirements for a fit-for-purpose missing person locator system were developed. The purpose of the user requirements was to provide a guideline to facilitate the system selection process. The user requirements can also be used as a tool to measure and evaluate the performance of the selected missing person locator system. The user requirements were also used to predict the success of the selected system under different missing person incident scenarios. The development of the user requirements showed a potential for many other benefits for missing person locator systems.

The World Bank Group (WBG) believes that extractive industries can make significant contribution to sustainable development and poverty reduction, providing that environmental, social, and corporate governance issues are properly managed. The WBG recognizes that stakeholders have legitimate concerns about the impact of extractive industries, and management proposals are built around the central theme that investments and policy advice in the extractive industries should lead to poverty reduction. To help governments create appropriate policy and regulatory frameworks, this paper focuses on the linkages between overarching policies and laws and the management / governance of extractive industries at the local communities. It encourages the use of new instruments designed to help ensure that local communities benefit from extractive industries.

Coal is currently cleaned with the minimum of size reduction, fine particle processing, recovery, and tailings disposal are major problems. Adequate water resources are not always available. For example, two thirds of China's coal is located in arid areas. Hence, dry separation provides an alternative approach. Of the dry coal separation methods available, air dense-medium fluidized beds have been used to separate 50~6mm coal efficiently. However, excessive bubbling and back mixing of the separated solids in the air-dense media fluidized bed causes the high lower size limit of 6mm for the feed material, this affecting the preparation efficiency. Based on prior study on air-fluidized dense media for 6~50mm coal preparation, this paper presents methods and test results on the fine coal dry classification, static electricity beneficiation of 0~0.5mm coal, and magnetically stabilized fluidized beds for separating 0.5~6mm coal.
