Under the title, Labor-Saving Appliances in the Works-Laboratory, I published a paper1 in which mas described how multi-manipulations in a works-laboratory and in the furnace-room of an assay-laboratory, can be condensed into single manipulations by applying the proper mechanical devices. For example, I now deposit ill, or withdraw from, a muffle a set of 48 cupels as one unit. The front row (8) of these are blanks or heaters; the other 40, when they have attained the proper temperature in the muffle, are charged simultaneously with the 40 lead-buttons. Three manipulations here accomplish an operation which by the generally customary method requires 136, and this number is only limited by the size of muffle and cnpels. This operation is an enlargement of what I have already described in my former paper, and Fig. 1 shows the improved implements. In the paper referred to I described a gold-silver bead parting-bath, which is the last of the devices used in regular sequence in practice. This bath mas designated as being convenient, but mas not a labor-saver properly. Fig. 2 of the present paper shows a new device. Instead of the original tray, there are now sectional holders for the test-tubes, each having a wooden handle on either end, so that the holders ma?-be removed from the boiling bath, and the acid or water poured oE from each set of tubes (in this case, 7) without waiting to cool. The tubes, held in place by clutches, as shown in Pig. 3, rest in holes in the base-strip, having a smaller diameter than the tubes. Each holder is stamped at either end with a number, so that the bath becomes further useful by permitting several men to use it at the same time without interference. Apart from the handles, the holders are made of sheet-copper.

Six or seven years ago the United States Bureau of Mines started development of instruments for the purpose of accurately measuring the vibrational movement of the earth in the vicinity of quarry blasts. For this work a new type of seismometer has been developed. A number of these have been constructed, the accessory field equipment has been assembled, and approximately 200 field tests of actual quarry, blasts have been made. The results of some of these tests have been published 2/ and others are the subject of two manuscripts now in preparation. So far the attention of the investigation has been centered on ascertaining the characteristics and behavior of the ground vibrations. Occasionally, when opportunity arose, measurements of the vibrations occurring in houses or other structures caused by-quarry blasts were made, but without any attempt at direct correlation or interpretation. During 1936 the National Bureau of Standards conducted some experiments to determine the normal vibrations to which the wells and floors of buildings are subject. Cooperation of the Bureau of Mines was requested in measuring the displace-ment. This afforded an opportunity to study the affect of mechanically induced vibrations end make limited comparison with previous records of vibrations from blasting. This paper deals with the experiments made in cooperation with the Bureau of Standards and includes some comparisons with effects from quarry shots. The results are in the nature of a progress report only, and are not intended to draw definite conclusions. These tests were concerned with the determination of the maximum amplitudes of vibration possible in the floors and walls of a typical dwelling when subjected to commonly experienced vibrations. The dwelling tested was obtained by the National Bureau of Standards. It was a large four-story stucco building, 41 ft. south of the southerly curb of Park Road, in Washington, D.C., which was constructed about 1900 and was supported on overburden. The basement floor elevation was approximately that of the pavement of Park Road, Park Road runs east and west; the front door of the house faced north.

The exact date of man's first use of coal is lost in antiquity. The discovery that certain black rock would burn was undoubtedly accidental and probably occurred independently and many times in the world over thousands of years. It is quite likely that these independent discoveries were made when primitive man chanced to build camp fires on exposed ledges of a black rock, then was amazed when it caught fire. The Chinese recorded the use of coal 1100 years before the Christian Era and from the Bible we learn that King Solomon was familiar with coal in what is now Syria. In Wales, there is evidence that the Bronze Age people used coal for funeral pyres, and it is known that the Romans used this fuel. There are other ancient references. So the knowledge that coal would burn, and even some uses of that knowledge, go back thousands of years. However, practical and consistent use of coal seems to date to England in the Middle Ages. COAL IN AMERICA In the Americas, there is evidence here and there of occasional use by the Indians. However, the first recorded discovery of coal, in what is now the US, was by French explorers, who reported an outcrop exposure on the Illinois River in 1679. Following this, other discoveries were made by French and British explorers, but the first recorded actual usage was in Virginia in 1702, where a French settler was granted permission to use coal for his forge. Earliest recorded commercial mining was in 1750, from the James River coalfield near Richmond, VA, a deposit now abandoned. Besides local consumption from this field, shipments were made to Philadelphia, New York, and Boston. During the Revolution this coal was of importance in the manufacture of shot and shell; so important, in fact, that the British sent an expedition in 1781 to destroy the iron works and

Prof. G. W. MAYNARD, New York City (communication to the Secretary): Prof. Christy, in his admirable paper on "The Growth of American Mining Schools," has overlooked the work done by the Rensselaer Polytechnic Institute in its department of mining and metallurgy. This oversight is naturally due to the fact that the department was, for lack of money, discontinued in 1871. It was organized by the writer in 1867, starting with ten students, who had already completed the first two years of the civil engineering course in the Institute. The course covered two years, specifically devoted to mining, metallurgy and assaying, which, in connection with the two years' drill in the civil engineering department made a four years' course. During the four years of the existence of the department, thirty-five students took the course, of whom twentyfive graduated; and of this number eight have been members of the Institute of Mining Engineers, and the majority of them have occupied high positions in the profession. The equipment of the department was, at that time, second only to that of the Columbia School of Mines. As Prof. Christy has cited other institutions which are not distinctively mining schools, but in which the ruining course was subordinate to other courses, it seems to me that the work in this line carried out by the oldest engineering school in the country may very properly be referred to. In addition to the regular mining course, a special course in assaying was given; and many young men were here prepared for positions in the mines and metallurgical works of the west. PROF. George F. Swain, Boston, Mass.: I have listened with great interest to Prof. Christy's valuable paper, but there is one conclusion at which he arrives that appears to me entirely unjustifiable, and to which I desire to take exception. Prof. Christy finds that of the total wage-earners in the United States in 1880,10.41 per cent. were employed in " trade and transport;" 20.24 per cent. in " manufactures and mechanics," and 1.83

THE need for a practical method of deciding upon new alloy steel analyses to widen its markets was the problem facing the Chrome Steel Works at the beginning of 1927. In addition to determining the physical properties of the alloys under consideration, it was necessary to test their value in service. Small melts of steel in a crucible, from which test specimens could be made, were insufficient to determine more than physical properties, therefore actual castings and ingots had to be made before the products could be placed in service. Furthermore, to save further experimental work, it was desirable that these heats should be made on a "pilot" basis; that is, actually duplicating regular open-hearth furnace practice. Therefore a one-ton (2000-lb.) acid open-hearth furnace was built. FURNACE DESIGN There are no special features in the design of this furnace. Standard acid open-hearth practice is followed, with the reproportioning of the dimensions necessitated by its small size; notably, a considerably increased length in proportion to width in order to get proper flame propagation. After the first heat was made it was found that the checkers were insufficient. The checker chambers were increased in size and the checker openings were made much smaller. The furnace was started late in March, 1927, and made 65 heats. Experimental work was then stopped until the data accumulated could be worked up and summarized. The run was resumed in November and the furnace is still operating, having made at this writing 60 additional heats. For the last series of runs, there was some rebuilding of both the furnace itself and the checkers. Slag pockets were added. Fig. 1 shows details of construction; Fig. 2, the, general appearance. All designing was done by the operating and engineering staff. Construction materials were those available around the plant. The reversing valve is a standard butterfly type taken from an old furnace.

The power plant of the Burro Mountain Copper Co. is located near Tyrone, N. M., at 5,950 ft. elevation. It is interesting because it uses the largest stationary Diesel engines in the United States. The general layout of the plant is shown in Figs. 1 and 2. The building is of steel-frame construction with hollow-tile walls and corrugated-iron roof; the floor is concrete and all windows have steel frames, making a fireproof building. The building is made to accommodate one more electric generator unit which is being installed; also two 4,000-cu. ft. air compressors direct-connected to three-cylinder engines with the same size cylinders as the electric units. The power plant consists of two 815-kva., 60-cycle, three-phase, 6,600-volt, 180-r.p.m. generators, direct-connected to five-cylinder, two-cycle Diesel engines; the necessary circulating pumps for cooling water, cooling towers and oil storage tanks. A portion of the power is used in the same building as the generating units to run one of two 200-kw. rotary converters delivering 260-volt direct current, and a 2,500-cu. ft. air compressor, delivering air at 95 lb. pressure, direct-connected to a 400-hp., 6,600-volt, three-phase synchronous motor. The remainder of the power is used to run a 1,500-ton concentrating mill 3 ½ miles from the power house, various hoists, pumps and motors about the mines and the lighting and water-works of the town of Tyrone. The direct current is used for electric traction in the mine, also to run hoists and motors that were installed before the new power plant was built. Due to the large hoists that take starting peaks of 250 kw. and the 10-ton electric locomotive that takes at times 150 kw., the load is extremely variable, as shown in. Fig. 3.

NlCHOLAS, Melbourne, Australia (communication to the Secretary) : * Professor Young deals with quite a variety of machines and methods, but, strangely enough, makes no mention of the work done by me, although he concludes with the remark that the " thin-cake continuous filters are a decided improvement over the thick-cake filters." As those interested in slime-treatment may consider that I did nothing more than to patent a process, I submit Fig. 1, showing the working-drawings of a machine, made, tested, and proved to work satisfactorily by me early in 1905. This time is prior to any work done in slime-filtration with rotating filters by E. L. Oliver or others. I maintain that a number of appliances now in use for slime-filtration infringe my patents. And after most exhaustive inquiry, I know of no machine or process, prior to my description in 1899,1 that embodied getting rid of the residues by holding them on the cloth with the vacuum, and then discharging them with back-pressure, so as to form a cycle of the operation, the result being continuous treatment. IT, HAS been my privilege to be Chairman of Engineering Council for very nearly three years, during which time Mr. A. D. Flinn, the. Secretary, and myself, have seen the organization develop until it is functioning smoothly and accomplishing what it can with the money at its disposal. The earliest attempt at what may be called an Engi¬neering Council, of which. I have any knowledge, was made six or seven years ago when the four Founder Societies each appointed two men, who occasionally met to discuss matters submitted to them which were of importance to, the, profession as a whole. I was one of the representatives of the American Institute of Mining Engineers.

IT will be recalled that the first professor of metallurgy in the United States, appointed in 1855, never really gave any instruction in metallurgy and gradually turned into a professor of mineralogy. Metallurgy was included with mining in the early curricula, two students who took the B.S. in mining engineering from the Polytechnic College of Pennsylvania in 1863 wrote their graduation theses on the metallurgy of copper and zinc, respectively. Even after Columbia School of Mines established, in 1868, a separate curriculum leading to the Ph.B. degree in metallurgy, very few students elected it,* preferring to take the mining degree, since they received in its curriculum nearly all the metallurgical instruction they would have in the metallurgical curriculum. For many years a large proportion of the men who attained prominence in metallurgical enterprises had taken mining rather than metallurgical degrees. METALLURGY Clifton Sorby's study of thin sections of rocks under the micro- scope, beginning in 1850, and its subsequent development by Zirkel and others, had made microscopic petrography a recognized department of, geological research as early as 1873. It was inevitable that the idea of studying polished metal surfaces under the microscope by reflected instead of transmitted light would occur to investigators. Sorby himself did it in 1864, and Adolph Martens and Floris Osmond may be especially named ', among the many European workers who, by the late eighties, had so developed the necessary techniques that they were able to photograph polished metal surfaces at magnifications as high

R301 is a clad aluminum alloy, composed of a core of a duralumin-type alloy clad with a magnesium silicide alloy. It differs from other well-known clad alloys in that the cladding and the core respond to the same heat-treatments. and therefore the cladding contributes appreciably to the mechanical properties of the material. In Table I are reported the compositions of the core and cladding alloy for the material used for the experiments. This fact is well known and many investigations have been conducted to determine the features of this diffusion. Most of those investigations cover materials clad with pure aluminum; the present investigation covers a material clad with an alloy. Since the cladding thickness on R~OI varies with the gauge, as shown in Table 2, several gauges were investigated. Material and Procedure he material used was sheet of the following gauges: o.o2~, 0.040, 0.064, 0.102, 0.170 Cut in pieces approximately 3 by 5 in., it was in the cold-rolled state and was soaked for increasing times at the following temperatures: glo°F., 940°F., 970°F. A Lindberg cyclone furnace was used for the experiments. The procedure was as follows: The furnace was started empty with controlling pyrometer set at the determined temperature. After the furnace had reached that temperature, it was run for some 20 to 30 min. empty, in order to allow the temperature inside to become stabilized. Then the first samples were introduced. A load thermocouple, with recording pyrometer, was connected with the sample of the heaviest gauge. About 10 min. was required for the material to reach temperature and the soaking time was counted from that point. After zoo min. soaking, the second group of samples was introduced without stopping the furnace. After 200 min. more, the third group of samples was introduced, and so on, until the last sample had been introduced. Every time the furnace was opened and new samples were added, a drop of temperature was registered by the thermocouple connected with the material

USE of gold leaf goes back to biblical and even to prehistoric times. Both gold and silver, as well as other metals, were employed in illustrating or illuminating manuscripts. The medieval monks also used bronze powders. Metals were subdivided as finely as possible by mechanical methods, or by granulation and then were pounded into finely divided flakes. Substances such as honey have also been employed, since early times to keep the flakes of metal apart during grinding. Stearic acid is a more modern agent used in flaking aluminum and other metals. Finely divided "blue powder" is a by-product in retorting zinc ores, and contains from 78 to 90 per cent of zinc metal. This has been used as a precipitant for precious metals in the cyanide process and for chemical reduction processes. The making of zinc dust by atomizing is a step well known in electrolytic zinc plants. The Thermit process of Goldschmidt also requires the use of finely divided aluminum.

The fact that coal is a complex organic material and heterogeneous in composition has made its study extremely difficult, particularly in regard to obtaining a fundamental concept of the processes involved in the formation of coke. It has been stated1 recently that coals are natural polymers and that in a complex reaction such as occurs during carbonization the differences between coals are quantitative and not qualitative. Such being the case, it would be expected, therefore, that a series of coals subjected to exactly the same conditions of coking would produce results that should be related quantitatively to the chemical analyses of the individual coals. In the past, however, this fact was not generally recognized and consequently many empirical test methods were devised for testing coals. The interpretation of the results obtained depended upon comparing a set of data with other data on coals of known characteristics. The testing procedure had to be conducted in precisely the same manner each time and not the least requirement in making the interpretation was experience. The test methods varied from those utilizing a gram of coal to the plant-scale tests in which one or more ovens were charged with the test coal. The aim had been principally to find some simple, inexpensive means by which the coke-making and other properties of coal could be predicted. It is not necessary to emphasize the importance of these endeavors, for anyone acquainted with the problems involved in the selection of coals for making coke is well aware of the time and expense involved in making a series of definitive tests. Several attempts have been made to derive formulas for such predictions. The relations of both ultimate and proximate analyses to coke physical properties and byproduct yields have been studied. Lowry and co-workers1 correlated statistically the U. S. Bureau of Mines-American Gas Association assay test results with coal analyses, using 90 coals and coal blends. Parry,² Spooner,3 and Gabinskii and Krym4 made similar correlations. Lowry concluded that there were definite relationships between the proximate analyses of the coals and the yields and properties of the products. Although this statistical study was made on test results from carbonizing coal in a cylindrical steel retort, the conclusions are important and provided one of the first steps in the simplification of this complex subject. Studies should be made of other references on this subject just cited. Studies of the coking process reported in the literature frequently were confined to a small number of coals, and very few have included coals from various ranks. It would seem logical, however, that a program for studying factors involved in the formation of coke should be based on a number of coals selected from each of the various classes or types of coking coal. It is, perhaps, more important to put on record the particulars of experiments that are derided failures than those that are successful, as those of the latter class are certain to live, while the former may be lost sight of in a short time, and repeated by others. TO this end, I propose to give the particulars of a straight or no-bosh furnace just tried at the Chester (New Jersey) works, which was such a decided failure as to leave no doubt of the plan being wrong, and determining the necessity of a bosh of some kind, as of old. Some experiences during the past year led me to suppose that the bosh or belly of a furnace was unnecessary, and that the contraction of the walls toward the bottom for the stock to wedge in, in its descent, facilitated dirty walls and scaffolding; hence, irregularity and high fuel. I concluded, however, that a very shallow bosh for a skew-back support to the stock would be necessary, and that the proper place for this was in the tuyere-section, beginning just below the tuyeres and ending just above them, where there is nothing in the solid state but fuel, which is consuming, and no slipping or travel of stock takes place. The cubical capacity of a furnace of this design would necessarily be much less than in the old style, unless it was made very much higher. But I assumed that the loss of room for reduction could be overcome by making the size of the ore and stone charged much smaller, so that the gases would act more quickly. The next point was, what should be the size of the shaft, crucible, tuyere-circle, and tunnel-head for a given quantity of air? My first design was 12 feet diameter of shaft for 7000 feet of air, with a 9-foot crucible and 8-foot toyere-circle. This I soon reduced to 8-foot shaft diameter, which I concluded was large enongh for economical work, if regular travel of the stock on the walls could be maintained. I consulted with a number of experienced furnacemen and furnace-engineers, and the plan was well thought of by many of them; and, as I had also some offers of financial aid from them toward the risk of trying the experiment, my firm concluded

The curriculum presented here is an outgrowth of discussions by the Committee on Geophysics Courses of the A.I.M.E. in previous years. It had to be a compromise between the desires voiced by employers of geophysicists, professional geophysicists and the possibilities at an average college. There one has to face the questions of the available teaching staff, the inertia of administrators and teachers set in their ways, and the red tape involved in modernizing antiquated curricula. It is, of course, not ideal to have colleges and universities lag Io years behind the times. Rather, instead of being prodded by industry, they should be ahead of industrial needs. There should also be a certain amount of leeway for the student in any college curriculum. All these points had to be considered in drawing up a curriculum, which, instead of being narrowly termed "geology" or "geophysics" was rather called "earth science." It gives the student a chance to specialize in one of the various branches represented by teachers on the faculty of The Pennsylvania State College, giving as options Geology (with subdivisions of Mineralogy and Paleontology), Geophysics, Geography, and Meteorology. Table iA represents the option of geophysics in the curriculum that envisages that a student may want to make his career in any of the fields encompassed by the American Geophysical Union or in geoexploration. This is, of course, only the start of an education that in most cases will have to be followed by graduate work for complete professional training. The outlined curriculum is definitely of an engineering type and is identical for all of the four options mentioned for the first two years. Specialization will start in the junior year but even thereafter the branches are kept as closely allied as feasible in order to permit a student to change from one tO the other (e.g., because of a different aspect in the mployment situation) with a minimum of additional work. Table IB shows the geophysics option according to subject matter, indicating the considerable amount of work in the fundamentals of mathematics, physics and chemistry with a liberal number of geology courses, and some engineering. The courses in the field of geophysics are limited—just two lecture courses as a general introduction and one field course, to permit the student a visualization of the correlation between mathematically analyzed physical data and the geological realities. Thesis work is considered essential to teach the student, while he is still in college, some things S. F. Kelly has mentioned as desirable: (I) following of instructions for somewhat independent work; (2) organizing of material, and (3) producing a readable report. This, together with the personal contact with the advising faculty member, will help in forming a student's personality. The seminar course attempts to get the student into the habit of reading current literature, so that he can keep abreast of the times.

It had to be a compromise between the desires voiced by employers of geophysicists, professional geophysicists and the possibilities at an average college. There one has to face the questions of the available teaching staff, the inertia of administrators and teachers set in their ways, and the red tape involved in modernizing antiquated curricula. It is, of course, not ideal to have colleges and universities lag 10 years behind the times. Rather, instead of being prodded by industry, -they should be ahead of industrial needs. There should also be a certain amount of leeway for the student in any college curriculum. All these points had to be considered in drawing up a curriculum, which, instead of being narrowly termed "geology" or "geophysics" was rather called "earth science." It gives the student a chance to specialize in one of the various branches represented by teachers on the faculty of The Pennsylvania State College, giving as options Geology (with subdivisions of Mineralogy and Paleontology), Geophysics, Geography, and Meteorology. Table IA. represents the option of geophysics in the curriculum that envisages that a student may want to make his career in any of the fields encompassed by the American Geophysical Union or in geoexploration. This is, of course, only the start of an education that in most cases will have to be followed by graduate work for complete professional training. The outlined curriculum is definitely of an engineering type and is identical for all of the four options mentioned for the first two years. Specialization will start in the junior year but even thereafter the branches are kept as closely allied as feasible in order to permit a student to change from one to the other (e.g., because of a different aspect in the employment situation) with a minimum of additional work. Table IB shows the geophysics option according to subject matter, indicating the considerable amount of work in the fundamentals of mathematics, physics and chemistry with a liberal number of geology courses, and some engineering. The courses in the field of geophysics are limited-just two lecture courses as a general introduction and one field course, to permit the student a visualization of the correlation between mathematically analyzed physical data and the geological realities. Thesis work is considered essential to teach the student, while he is still in college, some things S. F. Kelly has mentioned as desirable: (I) following of instructions for somewhat independent work; (2) organizing of material, and (3) producing a readable report. This, together with the personal contact with the advising faculty member, will help in forming a student's personality. The seminar course attempts to get the student into the habit of reading current literature, so that he can keep abreast of the times.

The objective of this paper is to identify the components of income above that necessary to keep a mine in production and relate those components to the profits of a mining firm. This is a discussion of "Economic Rent". Economic rent is the payment to the factors of production -- capital, labour, entreprenuer and the owner of the mineral deposit -- above the minimum necessary to keep all of these factors cooperating in the production of minerals from a particular deposit. THE SOURCE OF ECONOMIC RENT IN THE MINING INDUSTRY In the mining business each mine has a unique cost of production unrelated to any other mine. The cost of production is developed from many factors such as the technical characteristics of the deposit: depth of deposit, depth of overburden, areal extent, and type of deposit. Furthermore, there are locational factors which also alter cost of production. For example, identical mineral deposits located in Zambia or in the southwest U.S.A. would have different capital and operating costs. These differences occur because of different qualities of labour, ease of acquisition of operating supplies or investment capital and other similar factors. To explain the source of rent, we shall use ideas developed by Alfred Marshall and Kenneth Boulding. Suppose a meteorite with special qualities exploded over earth and sent showers of small meteorites to the ground in various places. At some point in time, people learned of the special qualities of these meteorites and a demand arose and one mine was started. Suppose further that the cost of production to produce these meteorites was different for each deposit. Probably the lowest unit cost mine would commence production because if a higher unit cost mine started-up, eventually someone would discover a deposit that had a lower unit cost of production. The lower unit cost mine would take over the market and the high unit cost mine would cease production. The cost curve for the first mine would look like the following Figure 1. [ ] The output for the first mine is on the horizontal axis with the cost per ton on the vertical axis. The curve labelled AC I is the average total cost of production over the range of possible production that could occur at the property. The total costs are composed of variable costs, which are dependent on output and fixed costs, which are dependent on time. For example, the cost of operating supplies would be a variable cost and normal profit would be a fixed cost.1 The opportunity cost of the investment would also be part of the fixed costs. In our example, all factors of production, are receiving the minimum necessary payment that will keep the mine operating. The average total cost curve is U-shaped because at zero output, the meteorite mine has no variable costs, only fixed costs which, on a unit basis, obviously are very high. A rather detailed description of the entire plant and leaching process was given in a paper recently presented to the Institute,I so this paper will cover briefly only the crushing practice of the New Cornelia Copper Co. for the year 1918. The ore, which is mined by steam shovels and loaded in side-dump cars, passes through two crushing plants. These crushing plants were constructed to crush the ore required by a leaching plant of 5000 tons daily capacity, during a crushing period of 16 hours. The primary plant reduces to less than 3 in. (76 mm.) and the secondary plant, to 1/4 in. (6.35 mm.), which is sufficiently fine for satisfactory percolation of solution through the ore in the leaching tanks, and to give-good extraction. The ore is then conveyed to the leaching tanks by a system of 28-in. (71-cm.) belt conveyors. On the way to the leaching tanks, it passes through an automatic sampling plant, where a 1-per cent. sample is taken. From the primary crushing plant, the ore is conveyed by two 36-in. (91-cm.) belt conveyors to a 10,000-ton steel storage bin, with a reinforced-concrete flat bottom. The ore discharges from the bottom of this' bin onto four 20-in. belt conveyors, which deliver it to the four units of crushers in the secondary crushing plant. There is no storage bin between the mine and the primary crushing plant. The ore breaks very coarse, is very hard, and contains a great many boulders, some as large as 4 1/2 by 4 1/2 by 10 ft. (1.3 by 1.3 by 3 m.). Jams form in the bowl of the coarse crusher in the primary crushing plant, as a consequence, and are freed by means of an immense steel hook operated from a 40-ton electric traveling crane. Water laws important to the mining industry are those which govern or affect the right to use water, to dispose of water after using it in mining or milling, and to discharge waste material into water-courses. They include statutes and court decisions having general applicability, as well as others that pertain specifically to mining. THE INDUSTRY'S CONTRIBUTION TO WESTERN WATER LAW Despite sharp differences of opinion, the water law the Spaniards brought to the Southwest appears to have included some form of appropriation of water. The Mormons, who settled in Utah in the mid-nineteenth century, also developed a system of appropriative water titles. But by far the most profound impact on western water law was made by the gold- seekers who flocked to the Sierra Nevada foothills of California after the discovery of gold in 1848. Much of the gold was extracted from the ground by hydraulic or placer mining, and so the-miners' rights to the use of water became fundamentally important. Since there was no organized government in the foothills and no laws other than those made by the miners, they helped themselves to the land, the gold, and the water needed to work their claims.' They established and enforced regulations governing the acquirement and holding of mining claims and their rights to the water they needed.'In 1879 Justice Field, former Chief Justice of the California Supreme Court, spoke for the U. S. Supreme Court in saying that the miners were "emphatically the law-makers, as respects mining, upon the public lands in the State.""
