It seems to be a matter of general understnading that title extraction or use of ground water may not be used as the basis of a depletion deduction under the United States Revenue Code And indeed, I have been unable to find any precedent upon which to base such a deduction. It is for this reason that the Shurbet case, which is the subject of my discussion and is now before the Court, may well become a precedent as authority for the allowance or disallowance of a depletion deduction for income purposes. It is well known that the law recognized that capital is consumed in the process of extracting minerals, oil and has, other natural deposits, and timber (underscoring supplied). This exhaustion, or depletion, is likened to the using up of raw materials in manufacturing. The law, therefore, provides a deduction for depletion which is intended as compensation for the exhaustion of assets consumed in the production of income through severance of minerals, oil and gas, other natural deposits, and timber.

While investigating methods for determining the best temperatures for hot-working experimental stainless steels, the Bureau of Mines Albany Metallurgy Research Center developed a machine in which hot-twist tests could be made in a few minutes. This machine is similar to some used previously except that specimens are heated by induction instead of by radiation, and their temperature is measured by a calibrated radiation-detection unit instead of by a thermocouple. In. developing the technique for using the new machine, tests were made on specimens of medium-carbon steel, mild steel, and AISI (American Iron and Steel Institute) type 304 stainless steel. Tests also were made on as-cast specimens and preworked specimens of experimental AISI type 202, low austenitic stainless steel, and as-cast specimens of AISI type 301 experimental stainless steel. The optimum hot-working temperatures were determined for all types of steel tested. Also, data were gathered on the effects of test speed and temperature on torsional strength and the effect of twisting on tensile stress in the specimen.

At our annual meeting in St, Louis, Mo. in February 1961, we presented a comprehensive paper (No. 61-B-22) on the subject of "Blending and Handling of Materials for Agglomeration". In that paper you will find a discussion on the difference between "blending" and "mixing". With regard to "blending" we brought out the facts of its usefulness for the preparation o materials in an agglomerated mass to attain controlled chemical and physical uniformity. "Mixing" was discredited as not being useful for the attainment of uniformity of any kind.

Phase equilibria of the zinc-rich portion of the Zn-Fe-A1 system containing up to 20.0 wt pct Fe and Al have been investigated at 600°C (1112°F), 450°C (842°F), and room temperature by metallographic and X-ray diffraction techniques. The phase relationships were found to involve only those phases present in the three binary systems. THE presence of small quantities of aluminum (approx. 0.2 wt pct*) in zinc galvanizing baths is known to suppress the formation of Zn-Fe alloy layers within the coating.' As part of an extended investigation of this suppression effect and the alloy reactions involved, the zinc-rich corner of the Zn-Fe-A1 equilibrium system containing up to 20.0 pct Fe and Al was determined at 600°C (1112°F), 450° F (842° F), and room temperature. The present paper reports the findings of this study. The constitution of the Zn-Fe system has been reported by Raynor2 based mainly on the work of Schramm3-3 and Truesdale et a1.6 The solid solubility of iron in zinc is extremely small and lies between 0.0009 and 0.0028 pct in the range 150° to 400°C (302°to752°F). Within the temperature and composition range of interest, a eutectic reaction involving nearly pure zinc, liquid = Zn+FeZn13, is observed at about 419°C (786° F) and 0.018 pct Fe along with a peritectic reaction, FeZn7+ liquid e FeZn13, at 530°C (986° F) and 6.2 pct Fe. The latter reaction is sluggish due to the large proportipn of solid phase involved in the transformation. Halla et al.,7 identified the compound FeZn13 as monoclinic with a = 13.68, b = 7.63, c = 5.07, and B = 128°44'. The structure of FeZn7 was reported by Bablik, et al.,8 to be of hexagonal symmetry, belonging to either the C6v = C6/m mc or D46h = C6/mc space group. Divensions of the unit cell are a = 12.81A and c = 57.6a. The Zn-A1 diagram as composed by Raynor9 and later Gebhardt10 is characterized by a eutectic decomposition, liquid 382°C (720°F) and 95.0 pct Zn and a eutectoid decomposition, at 275° (527°F) and 78.0 pct Zn. The eutectoid reaction cannot be suppressed permanently by quenching. Above 275° (527° F), a and a' co-exist in a closed miscibility gap between 31.6 and 78.0 pct Zn. Both phases are fcc and have nearly the same lattice parameter. The maximum solubility of aluminum in zinc (B) is approximately 1.0 pct at the eutectic temperature. PROCEDURE Materials. The experimental alloys were prepared from both massive and powdered material. Cast alloys were composed from three zinc-base master alloys containing 8.0 pct Fe, 16.0 pct Fe, and 50.0 pct Al which were made from C.P. zinc, Armco iron, and

A nine-month investigation was conducted into the effect on coke quality and blast furnace operation of the addition of bentonite and southern coal to the northern coal fed to the coke ovens at the Newcastle steelworks.Additions of 0·3 per cent bentonite or 25 per cent southern coal to the northern coal increased the coke strength from 15-20 A.S.T.M. stability to 25-30 A.S.T.M. stability. It is likely that improved mixing and blending facilities would, in both cases, give a coke of over 30 A.S.T.M. stability.For the same coke strength, the use of 0 3 per cent imported Wyoming bentonite was considerably cheaper than the use of 25 per cent southern coal, but the use of Australian bentonite promises the same coke strength for still lower costs. Other additives such as coke breeze, charcoal, iron ore fines, and certain other finely divided materials, gave relatively minor improvements in coke quality.There appeared to be sufficient improvement in blast furnace operation and production to justify full scale addition of bentonite to improve coke quality, although other variables, particularly iron ore physical quality, overshadowed on many occasions the effect of coke quality. Further coke trials with southern or bentonite will be carried out when ore quality has been improved by the introduction of ore sintering at Newcastle.INTRODUCTIONDuring the period of operation of the Newcastle coke ovens and blast furnaces from April 1960 (when No. 3 blast furnace was blown in after rebuilding) to December 1960, a bentonite coke trial was carried out based on earlier research findings (Gregory, 1959a, 1959b; Felton and Gregory, 1960; Gregory, 1960) that as little as 0 3 per cent to 05 per cent bentonite clay added to northern N.S.W. high volatile coking coals gave a significant increase in coke strength. To develop new or improved flotation methods for beneficiating low-grade red iron ores, the Bureau made many bench scale and continuous anionic flotation tests on ferruginous sandstones and calcareous iron ores from the north-eastern part of the Birmingham, Ala., iron district. The ores contained about 21 to 36 percent iron, a to 11 percent lime, and 22 to 64 percent silica. Production of iron concentrates containing 48 to 52 percent iron was technically feasible in batch tests, and the iron recoveries ranged from 85 to 92 percent. In continuous tests 49 to 51 percent iron products were obtained with 80 to 90 percent recovery.

It is shown experimentally that, by making use of the coupled S-O reaction in ionic melts, it is possible to transfer slclJur or oxygen from a lozv to a high chemical potential through an ionic nzenzbrane. This uphill transfer of sulfur is accompanied by a counter downhill transfer of oxygen and vice versa. The Materials balance shows that the amoulits of sul -fur and oxygen lost or gained by one system are the same as those gained or lost by the other systenz — the two systejns being separated by an iofzic membmne. The systems used in these experi?nents were solid Mn-MnS-Mno and liquid Fe-S-0. Sufficient results were obtained Lo study the kinetics of the transfer and the indications are that the counter diffusion of sulfide and oxide iojzs in the membrane is the rate controlling process. WHEN an ionic oxide-melt reacts with an atmosphere containing sulfur and oxygen-bear ing gases the following reaction occurs: 1/2 S2 (gas) +O2- (melt) = S2- (melt) + 1/2 0, (gas) [1] Under the restrictions that i) electric conductance in the melt is purely ionic and ii) each constituent element in the melt does not change valence, the solution of an atom of sulfur in the melt will result in the evolution of an atom of oxygen, so that the electric neutrality is maintained. For a given temperature and melt composition, the equilibrium concentration of sulfur in the melt is determined by the ratio, po2 /ps2 , in the gas phase and not by the individual partial pressures of oxygen and sulfur. This has been demonstrated by a number of investigators, for example by Richardson and withers', Fincham and Richardson,la by St Pierre and Chipman,' and by Turkdogan and Darken.3 In his Howe Memorial Lecture for 1961, Darken discussed the possibility of uphill pumping of sulfur through an ionic membrane at the expense of oxygen. TO test the validity of this concept associated with coupled reactions, experiments were carried out in the following manner. A presintered mixture of Mn-MnS-MnO and prefused mixture of Fe-S-0, contained in platinum and iridium crucibles, respectively, and separated by a thin layer of soda-glass (to act as an ionic membrane), were placed side by side in an evacuated silica capsule and sealed. This was then kept at 1400°K for a required time to allow Reaction [11 to occur via the ionic membrane. When partial equilibrium is reached, the ratios Po2 /pS2, for systems on either side of the membrane, are equal and the flux of sulfur and oxygen through the membrane becomes zero, although the individual partial pressures po2 andp,, in these two systems may differ considerably.

This report is one of a series being prepared by the Bureau of Mines on exploration, development, mining methods, and costs at various open-pit mines in the United States. These reports have been prepared in cooperation with various mining companies. A similar program, conducted from 1928 to 1939, was generally conceded to have contributed to improving the efficiency of mining operations. The purpose of these reports is to promote development and conservation of our mineral resources by disseminating technological information on mining methods and practices. This report describes exploration, development, equipment, and mining by open-pit methods of the remainder of an ore body that had been previously worked by underground methods. The Tripp pit of the Consolidated Coppermines Corp. is located at Kimberly, Nev., a small mining company town having an elevation of 7,250 feet, 9 miles by road west of Ely, Nev. (fig. 1). The pit extends over the area formerly mined by underground methods from the Morris and Brooks shafts.

Why A Friction Hoist? B EFORE discussing the equipment, it would be instructive to review the factors that influenced the management of Opemiska Cop-per Mines to purchase a friction hoist rather than a conventional double drum hoist. The mine required that 250 tons per hour be hoisted from a depth of 2,100 feet. They also specified that the top speed should not exceed 1800 feet per minute. As a part of the Bureau of Mines long-range program in asbestos, synthetic asbestiform compounds and minerals were prepared and described. Fundamental structural data on two such compounds are given in this report. Crystallographic data are provided for the synthetic isotypic compounds potassium-lead silicate, K2.Pb4 -Si8021 (I), and lead-aluminum silicate, Pb2. Pb4 .Al2Si6O21 (II). The space group symmetry 14/mmm was assigned provisionally to I and II on evidence of single crystal and piezoelectric measurements. A statistical evalua¬tion of indexed powder diffraction data revealed the cell edtes of I to be a 11.816 and c 7.932A and those of II to be a 11.723 and c 8.044A. The phases are uniaxial with observed refractive indices eD 1.790, an ?D,699 and eD 1.884, cusp 1,807, respectively. The atomic structure of I and II may be based on a complex of chains of silicon-oxygen tetrahedra lying along the c cell edge similar to the type of chain structure postulated by Pauling for scapolite. K2.Pb4.Si8021 and Pb2.Pb4 Al2Si6021 were first described by Geller and Bunting (5, 6)4 as fibrous compounds similar in crystal habit to asbestos. These authors gave powder diffraction data, although no attempt was made to find the cell edges or to index the powder diffraction patterns. Later, Shell and others (9) conducted a crystallochemical study of these fibrous silicates in search of a substitute for strategic asbestos. Their single crystal data revealed K2.Pb4 -Si8021 to be tetragonal body-centered with cell edges a 11.66, c 7.95 A. Pb2.Pb4 Al2Si6021 was concluded to be isotypic with K2.Pb4 -Si8021 on the basis of similar powder diffraction patterns, chemistry, and physical properties. No attempt was made, however, to index the powder diffraction record nor to determine the appropriate space group of either compound.

The Si-0 equilibrium in liquid iron was investigated in some detail by Gokcen and Chipman1 who reported equilibrium constants of the following reactions: In each case the thermodynamic equilibrium constant K was obtained by extrapolating K&apos; to infinite dilution. Their results on reaction [I] were consistent with those of earlier observers, and there seems to be little doubt as to the approximate validity of the equilibrium product determined. On the other hand, the results on reactions [2] and [3] indicated unusual curvilinear relationships between the activity coefficients of silicon and of oxygen and the silicon concentration. Since a linear relation is observed in all other similar instances, it was concluded that some source of error had affected the gas-metal equilibrium relationships. Recently the authors undertook a restudy of these equilibria with the view especially to establishing the equilibrium constant of reaction [2]. Their experiments, however, were discontinued before a tbroughly satisfactory answer had been obtained and consequently have remained unpublished until the present time. Quite recently Matoba, Gunji, and Kuwana2 published the results of a very thorough study of these equilibria. It is the purpose of the present note to Compare these three sets of experimental data, a comparison which leads to Confirmation of the results of Matoba and coworkers. The experimental arrangements described by Dutilloy and Chipman were employed. A controlled mixture of Hz, H,0, and argon was led into the induction furnace over the surface of the Fe-Si melt contained in a silica crucible. On account of the slow approach to equilibrium, runs were continued for at least 8 hr and, in some cases, as much as 12 hr. Samples were taken by means of silica tubes at the start and during the final 4-hr period of each run. Out of twelve runs only seven appeared to have approached equilibrium with sufficient certainty to be reported here. The results of these experiments, all at 1600°c, are shown by the triangles in Fig. 1. Equilibrium was approached from both oxidizing and reducing conditions and the direction of approach is indicated by the shape of the triangle. Attempts to extend the study to higher silicon concentrations were unsuccessful on account of the transfer of silica from the metal bath to the upper portions of the crucible by means of a silicon-monoxide mechanism. Matoba, Gunji, and Kuwana used similar methods and approached equilibrium from both sides. Their results at three temperatures are shown by the solid lines of Fig. 1. A line corresponding to 1600 deg is interpolated from their equations and is shown by the dotted line. The results of Gokcen and Chipman at 1600 deg in the range 0.02 to 2.0 pct Si are also shown. At concentrations up to about 0.6 pct Si, these investigators approached equilibrium from both directions, and their results in this range appear to be trustworthy. Above 1 pct Si, however, all of their experiments involved oxidation only, as shown by a decrease in the silicon content of the bath. It now seems certain that they failed to reach equilibrium at these higher silicon concentrations and that the curvilinear relation shown by their results is incorrect. It is evident that their results in the lower silicon range are in good agreement with those of Matoba and coworkers. In fact, a straight line drawn through their results would parallel the dotted line and would differ from it by only 0.05 in log K. The new data also lie close to that line. It may thus be concluded that the three sets of data are in good agreement and that the equations proposed by Matoba and coworkers for reaction [2] are satisfactory . Continuing a program of thermochemical investigation of compounds of to ferroalloy elements, this paper contains ins values of the heats of formation of two sodium molybdates (Na2Mo04 and Na2Mo207) and three sodium tungstates (NO2W4, Na2W207, and NA2W207, and Na2W4013). The experimental method was solution calorimetry. The solution medium was sodium hydroxide solution, except that hydrofluoric acid solution was used for sodium tetratungstate. The heat of formation values are given with reference both to the constit¬uent elements and to the constituent oxides. These data are of prime impor¬tance in the thermodynamic consideration of these substances, as their accumulation includes the most difficult and time-consuming steps toward evaluating the free energies of formation and thus the potential reactivities and thermal stabilities. Except for values for sodium monomolybdate and monotungstate, no previous similar data were contained in literature sources.

The undercooling associated with the nucleation of the secondary phase from the liquid by the solid primary phase was studied in sixty binary alloys by means of a hot-stage microscope. It was found that in a system of a and ß, a usually nucleates ß at low undercoolings, but ß does not nucleate a, except possibly at undercoolings approaching homogeneous nucleation. This behavior can be explained in terms of relative interfacial energies and shows that crystallographic disregistry is only a minor factor in heterogeneous nucleation from metallic liquids. PREVIOUS experimental work1-6 on nucleation of solids from liquids has shown that normally nucleation is heterogeneous, and that small solid particles present in the liquid are responsible for the nucleation. These experiments and the theory that has evolved from them have made apparent that there is a "characteristic undercooling" associated with the nucleation of the solid from a given liquid by a given impurity. Little is known, however, about the chemical and structural relationships between the nucleating agent and nucleated solid that control the effectiveness of the nucleating agent in catalyzing the nucleation, as measured by the required undercooling. A review of the literature has yielded seventeen undercoolingsL-6 for the nucleation of solid from liquid metals by "known" nucleating agents. All values come from experiments in which the metal studied was divided into a number of particles (10 to 300 pin diam.) much larger than the number of extraneous impurity particles so as to obtain a large number of particles free of foreign nucleating catalysts. Known nucleating agents are then introduced by coating the droplets with particles or a thin film of the catalyst. Six of the seventeen undercooling values referred to cases where, for various reasons, the identity of the nucleating species was not at all certain. Another six cases involved nucleating agents with a crystal structure that was not known. Four other cases involved undercoolings listed as greater than or equal to undercoolings which were very likely those for homogeneous nucleation. One investigation3 involved adding to droplets powdered oxides, carbides, and so forth that were doubtlessly covered with adsorbed oxide or nitride films. The highly variable nature of these films resulted in highly variable undercooling (as was also found in preliminary work in this investigation). It is apparent that the information on heterogeneous nucleation in liquid metals is too limited to give rise to any definite conclusions on the nature of the catalytic process. THIS CHAPTER of the Minerals Yearbook (Volume III) contains overall injury experience for coal mines, both anthracite and bituminous, coke plants, petroleum and natural gas, peat, and asphalt and related bitumens (native); metal mines, their metallurgical plants, including ore-dressing plants and primary nonferrous reduction plants and refineries; nonmetal mines; nonmetal mills; sand and gravel operations; slag (iron blast-furnace) plaints; and stone quarries and their related pants. Volume I of the yearbook contains a chapter showing injury experience and employment data treated separately by metal mines, nonmetal mines, quarries and their related plants, metallurgical plants (ore-dressing plants and primary nonferrous reduction plants and refineries are shown separately), nonmetal mills, sand and gravel plants, and iron blast-furnace slag plants. Volume II contains injury and employment experience in the fuel industries (coal, coke, petroleum and natural gas, asphalt and related bitumens (native), and peat. Injury and employment data are submitted voluntarily for the mineral operations through an industry canvass made by the Bureau of Mines, except for the coal industry, whose reports are mandatory. Information published in this chapter is the result of this canvass. Figures presented in this chapter for 1961 are preliminary except for anthracite, peat, coke, petroleum and natural gas, asphalt and related bitumens, and slag. These preliminary data, with the exception of bituminous coal, are a summation of reports received by May 31, 1962, from the operators showing their injury and employment experience. Estimations of injury and employment experience are not included in these preliminary data.

This report describes construction details and methods used in driving the 5490 tunnel at the Kennecott Copper Corp, property, Bingham, Utah. The tunnel will provide railroad access to the world-famous open-pit copper mine at the projected 5490 level. This publication is one of a series prepared by the Bureau of Mines to depict mining operations and techniques in various mining districts in the United States. Utah Construction and Mining Go. (formerly Utah Construction Co.), contractor on the tunnel project, began work during September 1956 and completed the project in February 1959. The tunnel is 18 feet wide, 24 feet high, and about 18,000 feet long, It will accommodate a railroad locomotive on standard- gage track. With the exception of the last 1,700 feet, the tunnel is supported by steel sets embedded in concrete lining. The 1,700-fact segment of the tunnel is supported by timber sets that will eventually be removed as the pit is deepened.

This report summarizes results of bench-scale metallurgical studies by the Federal Bureau of Mines on three composite samples representative of the low-grade manganese ores purchased by the General Services Administration (GSA) and stockpiled at Deming, N. Mex., and Wenden, Ariz. Bench-scale flotation tests at the Salt Lake City Metallurgy Research Center showed that all three composites could be beneficiated by flotation to recover 88 to 90 percent of the manganese in concentrates that assayed from 38.5 to 39.0 percent Mn, 10 to 12 percent insoluble, 5 percent CaO, 3 to 5 percent Fe, and 1.3 to 1.7 percent combined Pb plus Zn plus Cu, Sintering studies indicated that specification-grade material could be made from these concentrates by sintering above 1,000° C, and adding either sodium or calcium chloride to the charge to insure removal of enough lead and zinc to meet the specifications.

This report describes the design, construction, and operation of a low temperature adiabatic calorimeter for measuring heat capacities of solids or liquids from 60° to 300° K. A brief discussion of the basic theory involved in chemical thermodynamics and the problems involved in obtaining accurate experimental data is presented. The operation of the calorimeter was tested by measuring the heat capacity of a sample of benzoic acid obtained from the National Bureau of Standards over a temperature range of 60° to 300° K. The measured heat capacity values of the benzoic acid compared favorably with similar values obtained by the Bureau of Standards, the maximum deviation being 0.5 percent. THEORY A brief discussion of the basic theory involved in chemical thermodynamics will illustrate the applications of heat capacity data and the problems involved in obtaining accurate experimental data.

This report describes the preparation characteristics of the significant coalbeds in Nicholas County, W. Va. It is one in a series describing coals suitable for producing metallurgical coke, either as mined or after beneficiation. Almost 5 million tons of coal were produced in Nicholas County, W. Va., in 1960, of which over 2.6 million tons were cleaned in eight preparation plants. It has been estimated that over 6 billion tons remained in the county as of December 31, 1960, in beds 12 inches and more thick.

THE Flin Flon concentrating and metallurgical plants (Figure 1) of the Hudson Bay Mining and Smelting Co., Limited, lie adjacent to the town of Flin Flon, on the Manitoba-Saskatchewan border, 400 miles northwest of Winnipeg. Since the start of milling operations in 1930, over 50 million tons of ore from the Flin Flon mine have been treated in the concentrator. During the past few years, newly discovered orebodies have been brought into production and their ores processed at the company's main metallurgical plants. All these properties are within a 75-mile radius of Flin Flon and have aided substantially in augmenting plant metal production as well as retarding depletion of ore reserves in the Flin Flon mine. •Current satellite producers are the Schist Lake, Coronation, and Chisel Lake mines. The Schist Lake mine, located 3 ½ miles southeast of the main plant, is a copper-zinc producer. It was brought into production in 1954. The
