In 1998, the Concentrator Modeling Center was established within the Coleraine Minerals Research Lab to develop models for simulation of iron ore processing plants, and to assist plant operators in improving performance of their aging plants. The short-term objective was to develop necessary models for reliable simulation using conventional techniques, while the long-term objective was set as liberation-based modeling and simulation of these plants. The short-term objective was achieved in 2002, after the development of models for magnetic separators, hydroseparators and fine screens. A project funded the US Department of Energy was carried out to demonstrate the capability in improving iron ore processing at the Mittal plant. As a result of this study, a 10% improvement in throughput at the plant was obtained, and simulation became a desired tool for plant operators. A significant step in the long-term objective was reached in 2005 with the development of a liberation model. This was followed by incorporation of models capable of processing liberation data into the software. By early 2007, the Center had the capability of performing liberation-based simulation of entire plants.

The Crushed Stone Industry plays an important role in Pennsylvania's mineral economy. During 1965, the total production of crushed and broken stone in the United States reached 780 million tons from which 57 million tons were produced in Pennsylvania (Mineral Industries Surveys, 1966). It is further significant that Pennsylvania is the nation's leading crushed stone producer. Future trends in stone production will quite likely parallel those in the construction industry. Stone and stone products are finding greater and more varied uses each year. Continued record expenditures for structures such as dams, highways and buildings are the prime reasons for this accelerated growth in demand. Completion of the interstate road system and the maintenance of Pennsylvania's already expanded highway system form the essentials for this expanding market.

Over the next several years, the storage capacity of the Metropolitan Water Reclamation District of Greater Chicago?s Tunnel and Reservoir Plan will be increased by 14.8 billion gallons through the addition of two large off-line reservoirs: the McCook and Thornton Reservoirs. The Thornton Reservoir will be constructed at the terminus of Calumet TARP System. The constructed TARP system will be connected to the Thornton Reservoir via connecting tunnels and gates systems. The connecting tunnels will comprise of: an upgradient transition tunnel, steel lined bifurcated tunnel for conveyance and control of flow, downdradient transition tunnel, and energy diffuser at tunnel portal. A large, approximately 250-foot-long, 69-foot-wide, and 40-foot-high, rock cavern will be excavated at an average depth of 320 feet to house the bifurcated tunnel system and associated six large control gates, each 12.5-ft by 28-ft wheel gate. Presented in this article are discussions about the TARP system, the Connecting Tunnels and gates Project, regional rock conditions, evaluation of reservoir?s wall stability for evaluation of tunnel penetration, and design challenges facing during design of the: rock cavern hosting the bifurcated tunnel system and gates and associated tunnels and shaft.

The Manapouri Power Station is New Zealand’s largest hydroelectric facility located on the South Island of New Zealand. Constructed in the 1960’s, it includes a 700 MW under-ground power station and a 9.8 km (6.1 mile), 9.2 m (30 ft) diameter tailrace tunnel. The output of the power station is currently limited due to excessive head losses in the tailrace tunnel. To remedy this situation, the Electricity Corporation of New Zealand (ECNZ) retained Woodward-Clyde to design a second tailrace tunnel and appurtenant facilities and prepare Contract Documents for construction. The Project will involve the construction of a 9.8 km(6.1 miles), 10 m (33 ft) diameter, TBM-mined tunnel, hydraulic control structures at the upstream and downstream ends of the tunnel, an underground dewatering shaft and station, and tailrace channel improvements. This paper summarizes the key design and construction issues addressed during the planning and design phases, outlines the risk management provisions incorporated in the Contract, and overviews the Interactive Tender Process (ITP)that was implemented during the pre-tendering and tendering periods.

Critical width Before we go further into pillar design, we should look into the matter of "critical width," because of its effect on pillar behavior. Critical width refers to the greatest width that the rocks above the mine can span before failure or, if there are pillars, the width to which we must mine before the pillars accept the full weight of the overlying materials. There are theories to help calculate that probable width, and they usually boil down to one-quarter or one-third of the depth of cover; but they don't always fit, and it would be better for us to understand the factors that control local conditions. Critical width may be controlled by the thickness or strength of one or more of the strata above the mining horizon. In a gold mine, we might have a thick granite or basalt above us, perhaps capable of bridging across most or even all of a small ore body. In that case, pillars might have to support nothing, or perhaps just the weaker or damaged rock below the strong main roof. Obviously it would be wrong to design for tributary load on pillars based on some lab-determined rock strength. In some coal mining districts in Utah, huge steps can be seen in the mountain sides, with slopes on weathered shales and vertical cliffs 100 or 200 ft high in thick, hard sandstones. The sandstones are capable of bridging across hundreds of feet, often making mining deceptively easy at first, but it becomes more difficult as greater areas are opened. Sometimes such a mining sequence leads to violent bumps and bursts as the wide spans of sandstone sag and bear down on the working faces, like giant nutcrackers, or as bridges eventually fail, releasing much pent-up energy.

The Hong Gai coal field in northeast Vietnam has been the main coal mining area of Vietnam for more than 150 years. Anthracite coal is produced from several open pit and underground mines situated close to the UNESCO world natural heritage site Ha Long Bay. The mining-induced environmental impacts such as dust emissions, acid mine drainage, and visual impairments due to waste dumps resulted in severe conflicts of interests regarding future land use and the protection of the world natural heritage site Ha Long Bay. Within the RAME project (Research Association Mining and Environment in Vietnam), Brenk Systemplanung is contributing to an improved environmental and sustainable planning in Vietnam's mining industry and the reduction of environmental impacts on Ha Long Bay by developing suitable and sustainable technology and planning measures (e.g. for dump construction/rehabilitation, predictive modelling, and/or monitoring) for Vietnam's leading coal producer.

This paper presents the metallurgical results of column and stockpile leach tests with forced aeration to determine the usefulness of this process in the operational leaching at Sociedad Minera Cerro Verde S.A.A. The evolution of the aeration system is presented and also an innovative solution developed to overcome forced aeration’s main problem, which is the early obstruction of the aeration pipes located at the base of the stockpile, causing a decrease in air and oxygen levels and therefore a reduction in the metallurgical benefits.

The telephone rings at 3:20 a.m. An exasperated voice on the other end says, “There has been a mine explosion at Mine No. 5 and we have not heard from three units of men.” Twenty-three minutes later, the phone rings again and another panicked voice says, “There is something wrong at the slurry impoundment, the pool level has just dropped five feet and we are trying to figure out what is wrong” Thirty minutes later, the mobile phone rings. An excited security guard says, “We have reports of thick black water running down the right fork and left fork of Straight Creek and both seem to be rising in the banks.” If this is not enough excitement, the mobile phone rings again. A stressed company official says, “I just heard a report that black slurry is running out of the portals of XYZ Co. No. 2 Mine, which is adjacent to our No. 5 Mine.” Is this all some kind of dream or nightmare? More importantly, though, if this happens, what do you do? Most people think: “It can’t happen to me.” But mine explosions do happen, slurry impoundments can rupture and creeks can flood with black water causing damage to others, including competitors. A mine’s response must be quick, cool-headed, calculated and effective. This article examines the issues, concerns and ramifications of this hypothetical disaster. The authors then present a systematic crisis-management response.

Introduction Froth flotation is one of the most common unit engineering operations in use today. Its aim is to upgrade the quality of coal by removing ash/pyrite and separating selected minerals from undesired gangue materials. Flotation has been successfully practiced at the industrial scale for more than 50 years. Its use is increasing due to the ever decreasing feed grades of the coals and minerals being processed. Flotation has also shown itself to be a flexible process that lends itself well to many solid/solid separations. Thus, with surprisingly little equipment modification, separations can involve very different particle sizes and densities, and relative weight ratios of materials to be separated. In addition, the flotation process is economic, especially when compared to size reduction, its associated precursor process. Flotation also lends itself to continuous operations with a given equipment configuration. The operation must exhibit an ability to vary feed rate of solid to the process by as much as 50% without a total collapse of separating efficiency. In addition, the mechanical flotation cell is scaleable from 2.8 to 57 or 85 m3 (100 to 2000 or 3000 cu ft) with surprising ease relative to other unit engineering operations over the same relative size increase. The separating medium used is water. Most of the chemicals required - pH regulators, frothers, collectors, activators, and depressants - are all relatively inexpensive and common. They are not usually used in large quantities. Froth flotation is certainly one of the most versatile and forgiving unit operations in the chemical, mining, and agricultural industries. The problem with the industrial flotation process is that it is fairly easy to get reasonable results and relatively difficult to get excellent results. Why is it so difficult to fine tune the froth flotation process? There are some obvious reasons and a few not-so-obvious factors. The obvious category would certainly contain the tendency of natural feed materials (ores and raw coals) to have variable physical, metallurgical, and surface properties. This occurs even when special care is taken to minimize such differences with blending. There is another obvious reason for difficulty. An inherent broadness of the feed particle size range to flotation results from using any of the common industrial-scalefine grinding devices - ball-, rod-, or autogenous mills. Research has been done into the chemical reagent and equipment aspects of flotation. It has shown strong interactions (limitations) of chemical reagents and equipment on larger and smaller particles. The point is that current flotation practice works best on average- or medium-sized feed particles. The greater the amount of large or small particles, or of both large and small, the more difficult it is to achieve excellent flotation results. Other reasonably obvious factors include: • variations in mineral type and liberation sizes; • water chemistry variations such as those involving Ca", C03, or Fe", or various soluble metal cations; • the presence of stray organic materials such as returning soluble reagents or partially degraded reagents in reuse water; • the lack of reliable on-line instrumentation for monitoring and control; • frequent equipment malfunctions of all types; • excessive feed rates for installed plant capacity; • poor operator interaction with the process; and • poor reagent dosage control. There are less obvious, but real limitations to flotation. These are inherent in the design and operating characteristics of the most common cell design in use today - the mechanical flotation cell. Individual performance attributes of the chemical reagents used, along with their manner of use, also carry limitations. The bulk of this paper will deal with chemical reagents and their use. Chemical reagents In 1979, the author and his co-workers were asked to invent and implement, at the industrial scale, new flotation reagent chemistry. After reviewing some of the literature (Sutherland and Wark, 1955; Klassen and Mokrousov, 1959; M. Fuerstenau, 1962; D. Fuerstenau, 1976; and Leja, 1982), a series of carefully controlled plant scale tests were set up. These tests were designed to understand existing reagent scale-up from the laboratory to the plant. They were to quantify at the plant level the effect of some of the more important, controllable chemical reagent factors (frother and collector type, frother and collector dosage, pH effects). Coal preparation plant simulators are used to study flowsheet alternatives and determine product quality and quantity that can be produced under various operating conditions for individual circuits. Some simulators also provide an estimate of the cost per ton of clean coal by determining the number and size of different processing units required for a specific raw coal tonnage and by computing both capital and operating costs for individual units. However, to the authors? knowledge, none of these simulators have the ability to optimize plant performance while satisfying multiple product quality constraints and selecting the most profitable flowsheet from many alternatives. A novel coal preparation plant simulator (SIU-Sim) that maximizes the overall plant yield using a robust optimization tool and selects the best plant cleaning circuit configuration based on maximum plant profitability is presented. The simulator also identifies the best operating conditions for individual circuits of a plant to satisfy multiple quality constraints for the overall clean coal product. It uses a genetic algorithms- (GA) based technique to maximize the overall plant yield for each cleaning flowsheet alternative and uses a net present value (NPV) analysis technique to maximize plant profitability for the entire life of a new plant or the remaining life of an existing plant. The step-by-step development of the simulator along with a case study demonstrating its specific features is presented.

Although once fairly common as a method of coal preparation in the United States, dry cleaning has virtually disappeared. Low-rank coals used for power generation in the western U.S. are suited for dry cleaning because water has limited availability in the American west. Surface moisture added through wet cleaning offsets energy improvement achieved from mineral matter reduction. Information will be presented on the commercial application of dry cleaning in North America, the historic development and current status of the technology, and the introduction of modern processing theory and control technology to the design of dry cleaning equipment and plants.

Sylvite of Canada, a wholly owned subsidiary of Hudson Bay Mining and Smelting Co., operates an 8000 TPD potash mine and refinery located nine miles North East of Rocanville, Saskatchewan. Prior to Hudson Bay's entry in 1968 into potash mining and refining, it was one of the more traditional and conservative Canadian Mining Companies whose principal business had been for many years a successful copper-zinc mining and smelting operation located at Flin Flon, Manitoba. The potash reserves being mined by Sylvite were acquired through the acquisition of Francana Oil and Gas. This acquisition was at the time when several major potash mines were being developed or had recently been brought into production in the Province. These mines are owned by either very substantial Canadian Mining Companies or Multi-National Mining Companies with considerable potash mining experience. At that time, it became very apparent because of the new mines coming into production, potash mining and refining would quickly become a very competitive industry. Because of long term considerations, Hudson Bay decided to proceed with the development of its potash reserves, recognizing the Mine and Refinery would have to be the most advanced available in order to successfully operate. This report deals with the mining operation at Sylvite and the degree of success Sylvite has achieved.

Introduction The term kaolin is derived from kauling, a Chinese word meaning high ridge. This was the name of a hill in China where kaolin was first mined several hundred years ago (Murray, 1976). Other common names used for kaolin include clay and China Clay. Clay technically has a broader meaning and could refer to bentonite and ball clay as well as kaolin. China clay, as a descriptive term, apparently results from kaolin's origin. But it could also be due to a significant historical use in ceramic applications. The terms kaolin and clay will be used interchangeably in this analysis because of the common practice of using these terms in the paper industry. Major reasons for kaolin's wide-spread industrial usages center on kaolinite's physical features of good color, low viscosity, and inertness. Kaolin is described as a hydrous aluminum silicate with an approximate composition of 2H2O • A12O3 . 2SiO2. A new version of the product is calcined clay with modified hydration content. It is gaining widespread use. Components of any particular kaolin, in addition to alumina and silica, are viewed as impurities. The more values deposits and, hence, higher priced kaolin products are those of the highest purity. Kaolin is the most widely used mineral in paper manufacturing throughout the world. Key production centers are located in England and the US. Most of the Tatter's production is located in Georgia. The key markets for Georgia kaolin are paper markets - both paper coating and paper filling. These paper markets extend throughout the world, not just to domestic markets. In fact, export markets are second in size only to domestic paper markets for Georgia's producers of kaolin. Just as the paper markets are important for kaolin producers, kaolin is an important raw material for papermakers. Compared to the other three major pigments - titanium dioxide, calcium carbonate, and talc - kaolin's 1984 tonnage for papermaking represented 85% of the total. Even though titanium dioxide's unit value is much higher, kaolin's estimated total 1984 value still represented 51% of total dollars spent by papermakers for the four pigments. Kaolin grades- are briefly defined using particle size and brightness as principal means of classification. Likewise, grades of papers using kaolin are defined using the American Paper Institute's guidelines. From these definitions, associated kaolin grades used in particular grades of paper are reviewed. Special emphasis is placed on how qualities desired in certain papers are achieved through the use of specialized kaolin grades. World kaolin production World production statistics (Coope, 1979; Table 1) demonstrate that kaolin is produced in many areas of the world. Unique onsite assembly of a 12.43 m Main Beam TBM and back-up system was completed on September 18, 2008 in the remote mountains of the Sichuan province of China. The equipment was assembled onsite, without previously having been assembled and tested in a factory, utilizing a method called Onsite First Time Assembly (OFTA). The Jinping-II hydroelectric project features four parallel headrace tunnels approximately 18 km long, two of which will be excavated by TBMs and two by drill and blast. A nearby fifth tunnel is being excavated by a 7.2 m TBM to draw down ground water in advance of excavating the headrace tunnels. This paper addresses the following topics: ¦Project description including geology and terrain; ¦The decision process leading to onsite first time assembly, the assembly process and logistics, and lessons learned; ¦Design features of the TBM and back-up system; and ¦Operational history from startup to the writing of the paper.

Competition from foreign coal producers could displace as much as 9 Mt/a (10 million stpy) of US coal bound for power plants located near waterways. But, according to a Maryland-based coal consultant, it could be worse. Theoretically, about 52 Mt (57 million st) of domestic coal could be vulnerable to imports by 1990, said Forrest Hill, of Hill & Associates of Annapolis. Hill was speaking to about 150 coal industry executives and experts at the third annual Coal Marketing Strategies Conference in November. Most were at the Denver, CO conference to pick up tips on how to sell coal in an oversupplied market. Imports threaten domestic markets Of the 200 utilities studied by Hill and his staff, 119 are situated near major waterways, he said. However, most of those waterways are not equipped to handle coal from the shipping lanes. Good news for US coal producers. But don't breathe too easily. Foreign coal still poses a major threat to domestic markets, Hill continued. The strength of the US dollar is an obvious factor. But easy access to US utilities located on waterways combined with low rates for ocean vessels give foreign producers another edge. And foreign mines are typically low cost producers. For example, Hill said Colombia's huge Cerrejon mine can deliver coal to an Illinois power plant for $47.87/t ($43.39 per st). That compares to $52.85/t ($47.95 per st) from a Kentucky coal mine. Also, Colombian coal producers can generate a cash flow even if the coal sells for $27.50/t ($25 per st). The main competition US producers face from abroad, as Hill sees it, comes from Australia, Canada, Colombia, Poland, South Africa, and, perhaps, from Venezuela. Domestic producers, however, do have some things going for them. Most US coal buyers, Hill said, "are not wild about the idea of buying foreign coal." A 10% price advantage or pressure from public utility commissions would be needed to force some of them to buy foreign coal, he said. Some of the utilities contacted said they would not commit to more than one-third of their stockpiles to a foreign source. Another advantage for US producers is that they have room in their long-term contracts to cut prices and still maintain a profit, Hill said. Railroads, too, have high profit margins written into their rate structures. They are also aware of the import threat. Therefore, they may reduce their rates accordingly to keep their markets. Marketing's role The energy price shocks of 1972 and 1976 caused major adjustments in world economics. Coal was no exception. High oil prices caused many utilities to look at less expensive coal. As the market improved, coal prices began to respond, said R. Gale Daniel, of Anaconda Minerals Co. But clean air legislation and the strengthening dollar caused havoc in the coal markets, he said. The price of oil crashed, taking with it predictions of record coal use. The result is an oversupply of coal that has led to price cutting. Now, coal marketing must be recognized in its "true leadership role," Daniel said. Marketing people must know when to use spot sales to balance production objectives and maintain cost-effective-

The National Institute for Occupational Safety and Health (NIOSH) has continued study of the Personal Dust Monitor (PDM) developed by Rupprecht & Patashnick Co. Inc. through a CDC contract and currently being commercialized by Thermo Fisher Scientific. This report examines the effect of oversize particles, cyclone inversion, and cleaning procedures. Clean and exposed filters were examined using light microscopy and particulates counted before and after various instrument manipulations. The data presented show that the dry cleaning procedures do not cause significant (greater than limit of detection) sample contamination by respirable or oversize particulates and that the cyclone is resistant to particulate carry over during inversion.

Introduction Argyle is located in the Kimberley region in northwest Australia (Fig. 1). It is a significant diamond discovery by world standards and is the first major diamond find in Australia. The deposit consists of a pipe and associated alluvial deposits. Before the 1970s, diamonds were known to exist only sporadically in Australia. They have been found occasionally in association with gold deposits in Western Australia. There is a small deposit near Copeton in New South Wales. Some alluvial occurrences have also been found in Victoria, South Australia, and New South Wales. The first indicator minerals in the Kimberley region of Western Australia were discovered in January 1973. Production from the alluvial deposits at Argyle began in 1983. A $430-million construction program to develop a mine and treatment plant capable of producing 25 million carats per year was completed in December (1 carat = 0.2 grams). Ownership and management Participants in the project are known as the Argyle Diamond Mines Joint Venture. The group consists of CRA Ltd., 56.8%; Ashton Mining Ltd., 38.2%; and the Western Australian Diamond Trust (formerly Northern Mining Corp.), 5%. The project is managed by Argyle Diamond Mines Pty. Ltd., a wholly-owned subsidiary of CRA. Marketing is undertaken separately by the Western Australian Diamond Trust and by Argyle Diamond Sales Ltd. (for CRA and Ashton Mining groups). History Ownership of the Exploration Joint Venture has changed over the last 12 years as various parties changed their shareholdings. The original Kalumburu Joint Venture was formed in 1972 with five participants, each holding a 20% interest. By 1983, a number of ownership changes had occurred. The end result is that two original participants have sold out. CRA now holds a 56.8% share and the Ashton Mining Group holds 38.2%. CRA also assumed project management in January 1977. Table 1 demonstrates the long lead times involved in developing a project.

"Understanding ground control problems continues to remain a focus of the mining engineering community. To aid mine operators and engineers in identifying and responding to ground control issues, the Ground Observation System (GOS) is being developed. The GOS is an integrated, web-based graphical user interface that displays ground response data collected wirelessly from an underground mine. It presents data in an intuitive manner to assist mine personnel, who are on- or off-site, in quickly identifying hazardous areas. Geotechnical instrumentation will be connected to wireless transmitters that will relay data in real-time to a surface computer that stores the information in a database. The GOS website will then display the geotechnical data in graphical and tabular forms, as well as in conditionally formatted mine maps. Data from each measurement device will be able to be viewed in its entirety or within a time interval, and can be downloaded for further analysis. The ability of the GOS to quickly interpret and communicate mine hazards to personnel of varying technical ability should prove to be a useful tool in understanding ground control and thus improving mine safety.INTRODUCTION Computer-based data information centers that convey operating parameters and conditions are prevalent in modern underground mines. Today’s systems are popular in showing ventilation controls and monitoring equipment performance (Jyothi & Meena 2013). In ground control monitoring, Conover, Ross, and Bigby, 2010 have installed a wired telltale roof monitoring system that sends roof displacement data every ten minutes to a computer on the surface. The computer receives, stores, and displays the data in real time. Data can also be viewed remotely through a password protected internet connection. Additionally, an internet connection allowed for remote updates to the system which streamlined software development and maintenance by eliminating travel (Conover et al., 2010). Currently, no such system beyond Conover et al.’s design has been accomplished. The Ground Observation System (GOS) is being developed to fill the void of real-time geotechnical monitoring in underground mines. A wide array of data will be transmitted wirelessly and broadcasted to on- and off-site mine personnel through the internet. The GOS will incorporate geotechnical data from roof deformation, borehole scratch testing, photogrammetry, and seismic monitoring into one interface, all while achieving permissibility for the use in gaseous mines. As a result, a comprehensive view of rock movement due to mining will be available. The overall purpose of the GOS is to deliver warnings; to ensure reliable data is relayed to personnel for the identification of potential ground failures, provide mine engineers information to design more stable mines, and assist with further geotechnical research."

If one can embrace the medical analogue, much of the mining industry currently suffers from a massive bacterial infection. When pyrite-bearing or sulfide-bearing rock formations, tailings, or mine wastes are infected by Acidithiobacillus ferro-oxidans, the likelihood of forming acid rock drainage (ARD) is almost guaranteed. The ?pharmacy? of antibiotics available is extensive, ranging from solid alkaline amendments like limestone to liquid ?medicines? such as sodium lauryl sulfate, sodium thiocyanate, waste milk, and bipolar lipids. Unfortunately, the ?geo-medical? teams of geochemists, microbiologists, engineers, and mine managers lack the tools to surgically apply these active ingredients where they are needed most with a minimum of waste. Distribution of fine grained limestone on the surface of an acidic mine waste dump is analogous to applying a bandage soaked in antacid to treat an upset stomach. The implementation of up-to-date best management practices has not healed the patient; an equivalent combination of hypodermic needle, cyber knife, and arthroscopic probe is clearly needed. Using an engineered, flow-able or pumpable foam or pHoam? as the medicinally analogous ?dextrose delivery solution? for solid and/or liquid ?geo-antibiotics?, the authors have combined off-the-shelf technologies that have been previously applied in solving geotechnical problems in the mining industry. A patent for the innovative process is pending. This paper discusses method concepts and the advantages it could provide over conventional BMPs.

INTRODUCTION Countries that are currently developing their mineral potential have unique information systems requirements to support these activities. The mining laws usually grant the State considerable authority over the process. In many instances, the mining laws give a government agency the responsibility for granting and controlling exploration permits and development concessions. This is the case in Costa Rica. The Direcion of Geologia, Minas, y Hidrocarburos (DGMH) of the Ministerio de Industria, Energia y Minas (MIEM) is responsible for the management and operation of the National Mining Register. This paper describes the results of two studies of the information system requirements to support the National Mining Registry as well as those supporting some of the other function of the DGMH. The first of the studies reviewed the situation before the installation of computer equipment. The second study evaluated the installed systems. BACKGROUND Historical Perspective Mining in Costa Rica is at present a relatively minor part of the economy. It consists primarily of industrial minerals and gold production. Gold production is largely by small-scale miners and may be more substantial than reported. There is considerable interest on the part of the Government in both having a better understanding of the existing mining industry and promoting future development. Mining law was first provided by the Ordinanza de Mineral (of 1830). This was replaced by the first Mining Code of 1953. Apparently, one of the first problems caused by the 1953 law was the granting of concessions which were not worked. A 1968 agreement with ALCOA also resulted in political conflict. The Government worked on a new Mining Code for many years and in 1982 the current Mining Code was enacted. Draft implementing regulations were prepared in April 1984. Mining Code of 1982 The Mining Code of 1982 addresses most aspects of mining in Costa Rica including the declaration that all mineral resources are to be the property of the State. The State may grant exploration permits and exploitation permits. The exploitation of hydrocarbons, radioactive minerals and certain water resources was reserved to the state. The DGMH was given authority to settle placer claim disputes, maintain a registry of exploration permits, and exploitation concessions. and generally supervise mining activity. Towards this, the Mining Code of 1982 includes rather detailed requirements for the processing of application for permits and concessions. Mining Code Application Requirements The following briefly describes the requirements to give the reader a feeling for the complexity of the process. Currently, over 1,000 active applications, exploration permits and exploitation concessions are being monitored under the process. The number remains relatively consistent in that the number of new applications is usually about the same as the applications that are put aside. The time and date of the filing must be certified by the DGMH. The application must include all the information specified in the Mining Code. If incomplete, DGMH must notify the applicant of the deficiencies or omissions and direct that the applicant correct the deficiencies or omissions within 8 business days (a single 30 business-day extension is allowable). If the applicant does not respond as directed, the application is deemed as not having been filed and the pertinent information is placed in the files. The DGMH must reject the application outright and direct it be placed in the files in the following cases: (a). If the new application covers the area of a previous permit or concession, either being processed or already granted.
