Dear Sir: "Sorry not to be able to be with you but since my function in the Institute has been largely along the line of `stirrer up of trouble' (of course always with the aid of Dalrymple), I do not wish to fall from grace now so am sending you a pamphlet on the last page of which is a' tabulation as to accident indices of various coal mining states and it seems to indicate that the states comprising the Rocky Mountain Institute have the poorest accident record of all the states producing coal. "It seems to me that even allowing for possible deficiencies in connection with placing accidents upon basis of hours of exposure, our western states need to `tighten up' as to safety practices, hence I hope that the Safety Committee report will be both drastic and progressive and that western coal mines apply the drastic proposals in addition to approving them as the policy of the Institute. Why wouldn't it be advisable to have a committee appointed to ascertain why the safety record of the states comprising the Institute is so bad as to coal mines? On the back of it is this table; and it is a fact that the Rocky Mountain States are down at the lowest in almost every case, at the lowest point, with the highest accident rate in almost every kind of accident. Looking Down the Road: The Environmental Side of the 1990s and Beyond Environmental Social Responsibility Love Canal, Buffalo Creek, Widow Combs, Bohpal and Three Mile Island are familiar names to all of us-names which evoke memories of environmental tragedies. These memories, as well as memories of other environmental disasters, lead us to pose this question: What is the nature of the environmental social contact between industry and society? The manner in which one answers this question will. in large measure, answer the question of where one thinks environmental issues will go, or should go, in the 1990s and beyond. The history of the evolution of the environmental movement will be helpful in defining and under- standing just what society's environmental responsibility is and, perhaps, what it will be. To Define the Future Start With the Past The common law, which most of the United States adopted from the English system of jurisprudence, traditionally considered pollution control and other environmental issues to be a matter of determining the relative rights of private property owners and of individuals. Legal and equitable theories, such as nuisance, negligence, trespass and the law of riparian rights, were utilized to allocate responsibilities between parties under the common law. The discharge of pollutants into streams and into the air was by and large considered acceptable, at least up to the point that another's "reasonable" use of the same air or waterway was significantly impeded. Further, the judicial decisions interpreting the applicability of the common law to the protection of the environment generally reflected the social and economic pressures of the age. During the Industrial Revolution, the decisions and policies had a marked tendency to favor industrial development. Jobs and industrial growth are deemed as important, and in some cases more important, than the protection of people and property. Additionally, the idea of a social responsibility, beyond that owed to a competing land or water user, was nearly alien to the early common law.' One could even go so far as to say that, had there been a social environmental contract under early common law (which, of course, there was not); but if there were, it would have been to promote actions which facilitated industrial development, even at the expense of the environment. Post-World War LI industrial expansion brought with it a growing awareness of limits on the environment's ability to absorb increasing levels of pollution. Thus evolved an era of social and political adjustment, as society began to shift away from supporting big business and industrial development and toward supporting domestic government programs and limits on industry. States gradually stepped in with efforts to address environmental issues. The Pennsylvania Clean Streams Law and the West Virginia Surface Mining Act of 1939, while lax in comparison to today's standards, nevertheless marked definitive efforts toward altering the balance between industrial development and environmental protection Pollution control continued to be viewed as a state responsibility through the 1950s, until Congress began, for the first time, to allocate funds for federal research on air and water pollution and to implement

I read a book the other day called Opportunity 2000. The book, Opportunity 2000, talks about what's going to happen in the next nine or ten years as we propel ourselves through the 1990s into the 219 century. The book, Opportunity 2000, is a futuristic book, somewhat like Megatrends. It said that by the year 2000, baby boomers will be old people, and when you got here before the baby boomers, how does that make you feel? It said that there will be more women in the American work place by the year 2000 than men. The book, Opportunity 2000, discusses diversity. The big challenge for the 1990s is ?diversity?. We'll have the D-word in the 1990s. We had the G-word in the 1980s ? ?global.? Diversity in terms of more immigrants, more minorities, more females into the American work place, but also value systems diversity. We'll have to deal and adapt to four different generational clusters in dealing and interacting with employees and management in the 1990s-value systems diversity. In the current issue of Link-Belt News is this quotation: "Advancing waves of other people's progress sweep over the unchanging man and wash him out." As we look over the industrial world today we are struck by the many waves which are sweeping over backward industries. Mergers are being consummated in all lines of endeavor. General Motors are making radios and the Bendix Brake Company are making airplanes. Railroads which twenty years ago were called to account by the Federal Government for their efforts to form combinations are today being ordered to combine. But what is of immediate concern to the coal industry is the fact that there is now in existence or in project a total of 3,641 miles of pipe lines to carry natural gas to most of the country's industrial centers. This is the wave of progress which is sweeping toward you and me. If we are to grasp the significance of these many changes, we must widen our vision so that we may learn some- thing from 'the other fellow's experience. The first lesson is that cost of production alone is not a measure of profit. It is an interesting fact that the production of an article represents a definite loss until that article has been sold for a price in excess of its total cost, and the money is in the hands of the producer. If this is true, then the selling price is more important than the production cost.

Bureau of Mines Technical Paper 172, by S. H. Katz and H. C. Porter, entitled "Effects of Moisture on the Spontaneous Heating of Stored Coal", says at the outset, "Spontaneous fires in storage piles of bituminous coal' have been the source of trouble and loss since the industrial utilization of coal began. In Europe the idea arose that spontaneous combustion is more liable to happen during wet weather than during dry. Statements favoring or opposing this idea have crept into the literature. Conflicting conclusions, based on experiment as well as opinions based on observations of various degrees of reliability, are given in most of the recorded discussions of the subject. "Because of the uncertainty of the effect of moisture and its seeming importance among the conditions that affect spontaneous combustion in stored coal, the work described in this paper was undertaken by the Bureau of Mines. The experiments showed that a coal from Illinois oxidized faster when dry, whereas a sample of Pittsburgh coal oxidized faster when moist. These discordant results and similarly inconsistent results from the observations of different investigators may be coupled with the fact that under actual conditions of, storing, both coal and air always contain a considerable amount of moisture." The foregoing report of the investigations of the Bureau demonstrates that the mystery of spontaneous combustion has not yet been solved. This fact adds to the fascination of the subject. I became interested in the matter about ten years ago in observing what was probably one of the best exhibitions of this phenomenon. The old dump at Castle Gate No. 1 Mine contained boney coal and track cleanings generally. In winter when snow fell upon this old dump, the snow was soon melted by the heat of the dump which was comparatively warm at all times. Within 48 hours afterward little blue flames were in evidence on the surface of the pile. Few of the gas feeders were sufficiently constant to maintain a steady flame at any given point, but shifting emissions of gas were ignited one by another, resulting in a continuous popping and apparent running about of the flames. Another interesting exhibition of spontaneous heating was to be seen a few years ago in the storage coal piles of the local sugar factories. This coal was piled in concrete lined pits and the latter were filled with water. However, or this occasion the coal extended above the surface of the water. At every plant where this condition existed the coal was affected heating, and in each case the affected area was in a plane horizontal to and from 8 to 1.4 inches above the water level. The height of the hot area above the surface of the water appeared to be affected by the fineness of the coal. It is well known that oily rags have a tendency to heat when allowed to accumulate in some location protected from free air circulation. For some reason, as yet unknown, this does not apply to petroleum or its derivatives. Now, the most common explanation of spontaneous combustion is that the combustible material oxidizes by being brought into contact with air in the presence of moisture, the theory being that the moisture acts as a catalytic agent. My theory is that spontaneous combustion is due to oxidation of combustible matter by free oxygen carried in solution by a liquid, the oxidation taking place only as, when, and at the place where this oxygen is released from solution by the evaporation of the liquid. Also, this oxidation takes place to some degree regardless of the condition of the combustible-whether it be lump coal, coal dust, straw, wheat flour, coke, or any other combustible but, as the speed of oxidation is directly influenced by temperature, it follows that spontaneous combustion only becomes noticeable or serious in cases where the resulting heat' cannot escape as fast as it is generated.

MR. CHAIRMAN AND GENTLEMEN: To be invited to address the members of The Rocky Mountain Coal Mining Institute on a particular subject is an honor I sincerely appreciate. The subject of this paper is, ?The Advantages of Having Such Men as the Fireboss Under State, Rather Than Corporation Jurisdiction." On the fireboss, primarily, depends the safety of the mine. When all the rest of the mine workers are still comfortably sleeping in the wee small hours of the morning the fireboss steals noiselessly away, from his bed to take up his daily task, a tour of inspection. He enters the mine, he inspects alone they workings that will be filled with men whose safety is in his keeping. Loyal to his fellow men and responsibilities of his position; he seeks for danger in every place, on every road and travelingway; going over caves, through dangerous places where none of the others are expected or allowed to go alone. How many of us give a thought to these dangers and the faithful work that this guardian performs for our safety. After the fireboss has made this round of inspection, he reports all the dangerous places to the foreman and enters them in the book; he is supposed to have performed his duties; he has no authority to enforce his recommendations. He has found a number of rooms that have not been timebered as they should be for the safety of the digger; he has told the diggers to they timber, up better for their own safety; he has kicked to the foreman about these same places. These conditions. continue until there is an accident. The fireboss reports, broken crossbars or bad roof on a roadway or some other danger to the foreman, but the foreman does not have it fixed, making, excuses, as he cannot put any one on that work today; or that it will stand until some idle day, and that is the way things go until the fireboss gets so he wonders what good he really is, is it any wonder it is hard to get good men to take this position of fireboss? The remainder of the shift the fireboss is used as a general roust-about, having to do such, work as building stoppings, help the timberman or track layers, pull rails out of danger in pillars, a trapper is off and he is told to trap that day, when the mine is idle he is laid off to cut expenses. That is the way the fireboss is treated. The fireboss is not merely a merely a necessity to be lightly regarded but a factor whose authority should be unquestioned. The fireboss has made his district and knows just what conditions the workings are in, and sees lots of dangers that the foreman does not. In the morn-

Those who remember the years of patient effort and the slow results obtained in the first introduction of electrical coal cutters and locomotives will, I think, admit that mechanical loading of coal is unquestionably being established at a much more rapid rate than any previous application of machinery to reduce manual labor in mines. There are many operators who consider the progress of the loaders today as slow, but considering the number of years it took to thoroughly establish electrical coal cutters and locomotives, and comparing it with the short time that the mechanical loader has been on the market, and the results that have been obtained today, they will admit, I think, that the progress of the latter is much more rapid. It is about 35 years since the advent of the electrical coal cutter and electric locomotive. Their use has brought about these improved conditions, increased tonnage per mine and other features, which are of assistance to the installation of mechanical loaders. The management and the technical staff in practically all of the American mines are trained in the use of electrical machinery and understand its operation, care and maintenance. . There is frequently, a surplus of electrical power and wiring available to take care of the small requirements of the electrical loader. The mechanical loader, therefore, starts today with the ground prepared for it. Those manufacturing companies who have had years of experience in the design and construction of mining machinery, know in a large measure what to incorporate in their designs to make the parts of the new type of machine effectively strong and to operate with efficiency under the severe conditions encountered in mining service. All these advantages greatly assist the success of a new type of machine such as the mechanical loader. In spite of these advantages, however, there are bound to be some failures. All new types of loaders have to be developed. We hear of some that are a success and some that are set aside. The field of application of each type and its limitations first must be determined by actual operation. The earlier loaders had to be changed and improved in design as weaknesses developed. Not all of the new types of coal loaders have been built by mining machinery manufacturers of long experience, and the lack of experience in this line is responsible for some of the early failures. The coal mining company staffs and also those of the loader companies had to learn what the operating factors were that made mechanical loading a success. The difference in results obtained by loaders in different properties under similar physical conditions indicates that the mine management is a very large, if not the major factor, affecting the efficiency of mechanical loading. Many articles have been written on the question of loading. The subject has been quite fully discussed at recent coal meetings and in the technical press. It is not always as easy or simple a matter to form conclusions as may first appear as to one's own particular loading problem. Mechanical loading is a comparatively new art, and many companies while claiming that loaders are quite successful, do not have an accurate line on the actual saving they are affecting. Many of them have only a few of the factors taken into account in their costs. Many loaders have been generally bought without very careful consideration given to all details and except where extremely favorable conditions prevail, failure resulted. The Primero mine, operated by the Colorado Fuel & Iron Company, is located 17 miles west of Trinidad, Colorado, in Las Animas County. Unusually bad roof conditions, along with heavy side pressure and other conditions causing rapid decay of timbers, all combine to create a very serious timbering problem. The height of the coal averages six feet six inches. It is a heavy coking coal and has a tendency to become easily crushed and broken down in the seam. The seam lies about 35 feet below the sandstone and the intervening formation is composed of loose shaly rock, and as the coal is extracted, the air slackens this rock to such an extent that within 24 hours, roof falls varying from five to fifteen feet in height are likely to occur. Under these conditions it is necessary to use cross bar sets in both rooms and entries, and they must be spaced no further apart than three and one-half foot centers, and be maintained within a distance of three feet of the face. Rooms are spaced on fifty footcenters, and cannot with safety be driven to exceed 14 feet in width, and 200 feet in length. The large pillar must be maintained to protect from side pressure, and the rooms must be driven up and retreated with as quickly as possible to avoid the squeeze caused by the intense side and roof pressure. Best results in extraction have been obtained by driving rooms for only a distance of 150 feet. Under these circumstances, it is readily seen that timbers of small diameters cannot be utilized in timbering any development work of a permanent nature. Entries are driven nine feet wide, and special peeled piling with an average diameter of 12 inches are most commonly used. It, is necessary to use lagging between each set of crossbars . Conditions such as these necessitated an immense expenditure for mine timber. In addition to ordinary seven and eight foot props, we used a yearly average of 65,000 feet of heavy peeled piling, averaging in diameter from 10 inches to 12 inches. Annual expenditures for timber of all classes was in excess of $60,000.00. Timber costs per ton averaged around 29 cents. In view of these exceptionally severe timber conditions at Primero, the company, in 1920, had a survey made with a view of providing some remedy to this problem. A comparison of the life of main entry timber at other bituminous mines was made, and an average life of four years was established. The actual data collected at Primero indicated an average of less than two years in the manway or "return" airways, and up to five years on the haulageways or "intake" airways. While some of this timber will stand up for a much longer period than this, a close inspection will reveal in most cases that its period of usefulness is spent. It is very essential when discussing the life of timber, especially that used on, main haulageways and aircourses, that a distinction be made between the point of service, that is, the point where it is sound, serviceable and able to carry weight, and the point of breakdown or failure, where it is no longer sound and able to carry weight. In figuring the life of timber, the point of service only should be considered as timber will frequently stand for a considerable length of time when it is entirely decayed and unserviceable. The labor turn-over at coal mines has long been a fertile subject for parade by complaining coal operators, the question invariably occupying a place of prominence in the list of disabilities that tend to increase the cost of producing coal, adding likewise to the now startling number of accidents that occur in coal mines. This disability, however, is like the weather question, which some humorist once remarked of by saying, "The weather is something we all talk about, but nobody does anything to improve it." Endless compilations covering the shift of employment by coal mine labor have been made and published, and while the actual loss expressed in cents per ton in cost of coal produced has never been determined, the fact remains that such represents a substantial item, taking the mines of the country as a whole. Efficiency engineers who have made studies covering the cost of breaking in and training each new man employed in certain manufacturing industries, fix same as averaging not less than $100.00 per man, and when the character of mine employment is given due consideration, including its ever-present hazards, the difficulty of close personal super- vision of individual employes, and the, at times, almost impossible ability to transmit to men of many diverse nationalities understandable instructions, it is quite safe to say that the cost of securing and breaking in new men for underground mine work will fully equal that suffered by the factory managements. When we speak of mine labor turnover we must necessarily exclude the enforced shifting about of men who are laid off by the closure of mines due to accident or lack of market, con- fining ourselves to the turn-over occasioned by- (a) the dismissal of individual men or groups of men; (b) the voluntary resignation of the individual workman. It is these two methods of severance that the employer and employe alike suffer from; the item "Unclaimed Wages" carried in the accounts of every large coal company illustrative of the "quit this job, get another one" attitude of many workmen, who frequently, when leaving, fail to claim small sums due them, while others, in turn, leave a train of debts, large and small, behind. PRESIDENT PRYDE: I am sure we have all listened with interest to the presentation of this subject. Anything that promises economy in coal mining today is welcomed by all of us. We will now have a discussion on this paper. If any of you gentlemen want to ask any questions, you may do so. I think we will develop something of interest and along the lines of economy. That is the first consideration of a coal mining man. MR. H. D. RANDALL: It is an interesting fact that in manufacturing we find the greatest economy results from giving a man the simplest possible act to perform, while there is nothing too complicated for a machine. If we want to put up a set screw we find it cheaper to let one man set it up and the other screw it in. The maximum economy is what we are after. Similarly, one of the points of greatest interest which Mr. Ickis has emphasized, is that this automatic equipment not merely dispenses with a manual operator, but also performs certain functions which the operator cannot do. It provides an inherent protection to the apparatus and service not possible under manual operation. We very rarely have cases of failure with these automatic equipments, .and consequently have the advantage not only of having eliminated the operator's salary, but also his mistakes. We have had a large number of these equipments in use for several years, so that their practicality is now thoroughly proven, and the trend of practice now indicates that the automatic idea will be further extended and will become universal for such classes of service. MR. D. C. McKEEHAN (Union Pacific Coal Company) : My notion of an automatic sub-station is one that does not necessarily require new equipment beyond the control equipment; so that any of you that are interested in it can take up with the manufacturers and find out how much it would cost to change any equipment. The greatest point I think is the fact it eliminates the several nationalities from operating the set, either on day shift or night shift. They can so lock the control as to make it impossible for anyone to start or stop it, except the one who has the authority. Another point I do not believe was brought out very clearly: It would be particularly advantageous to people who buy power, and if you could have several sets in parallel, it would allow you to start the shift with one set and cut in the additional sets as the shift progresses. There are various operations that stop at the end of each shift, and-one or two or three sets can be cut out, leaving the load on one set, providing the size of the copper is sufficient to supply all the points of the mine. Another point I want to bring out: In case you have quite a number of sets distributed along transmission line, the switch trips, the operation restores the service, and you may have several hundred-or in case with us, we would have several thousand-K. V. A. of Motor Generator Sets and Rotaries, that would be starting at once, and the switch would automatically trip out again. MR. RANDALL: Another form of control was described as the so-called supervisory control. This control could be started up so the starting would not be synchronous, but could be spread out over a sequence. MR. McKEEHAN: I think that is rather a theoretical consideration for coal miners. They are standing at the controller ready to shut it off unless there is some selective method of starting various sets- MR. RANDALL: I had in mind this supervisory control, one man, a central operator who would determine which station should start and he would take time enough to have his load come on gradually. He would not permit all the installations to come on simultaneously, but come on in succession: MR. McKEEHAN: You misunderstand me. ?Twowinters ago, what had been a mediocre safety record at West Virginia?s Sago Mine grew dramatically worse. Over 23 months beginning in February 2004, two dozen miners were hurt in a string of accidents, some of them caused by rock chunks falling from the mine ceiling. Federal safety inspectors slapped the mine with citations 273 times, or an average of once every 2 ½ days. Despite this record, the price paid by Sago?s operators was light. Government regulators never publicly discussed shutting down themine and never sought criminal sanctions. The biggest single fine was $440, about 0.0004 percent of the $110 million net profit reported last year by the mine?s current owner.? -Washington Post, January 8, 2006

Thank you for inviting me to come here and be your keynote speaker. Texas also thanks you for being included as part of the Rocky Mountain Coal Mining Institute. We'll kind of think of Texas as Baja Rocky Mountains. I've always wondered why coal miners were the only people to go to the mountains in the summer time-and now I know why. The program committee should be given a big hand for selecting this RESORT. And the golf course is stimulating to say the least. This is a very beautiful location. I was asked to talk about CHALLENGES, OPPORTUNITIES and INNOVATIONS as they affect the coal industry. I am going to do that from a Texas perspective. But first, since Texas is the newest state to belong to the Institute, I would like to give you a little background on how our coal industry got started and where we are at today. The vast majority of our coal is called lignite-it has a little lower heating value than most other coals and ranks somewhere between buffalo chips and sub- bituminous. Lignite is found In three geological formations running Northeast to Southwest through South and East Texas. In-place reserves lying within 200 ft. of the surface total 14 billion tons. This slide shows the lignite formations with cur- rent mine operations colored in RED. Mines that are planned to be built in the next 10 years are shown in BLUE. Lignite was used mostly by settlers in Texas during the 1800s. It was used as a fuel to fire locomotives during the Civil War. Between 1900-1930, about 100 mines, mostly underground, were operating in Texas producing lignite for home heating and as a boiler fuel. Here are some slides showing underground access, [lie tipple used to process the lignite, and the underground workings. This is the "BIG LUMP COAL COMPANY" as shown here. The typical underground mine was 100-150 ft. deep and each miner produced 7-10 tons per day-all by hand. In 1926, the Texas Power & Light Company built the Trinidad Power Plant and began using lignite as a boiler fuel. The lignite was mined by the McAlester Fuel Company at the nearby Malakoff Mine. Here are some slides showing a stripping shovel at Malakoff uncovering lignite. The lignite was loaded into railcars in the pit for transport to the power plant. This is a picture of the Trinidad Plant which had two 20 MW units and one 32 MW unit. At the time, Trinidad was the largest power plant in the United States using lignite exclusively as a fuel. Trinidad operated until 1942 when it was converted to natural gas that was sold to the plant for 3 ½ ¢ per MMBT'U. The mine closed after having produced 7 million tons. Lignite was mostly forgotten about until 1953 when Alcoa started an aluminum smelter. Our Company formed a subsidiary called Industrial Generating Company to operate the power plant that furnished electricity to the smelter. We also operated the nearby Sandow Mine that supplied lignite as a fuel to the power plant
