Eminent domain overview Eminent domain is the power of the Government or a municipality to take property for public use without the consent or acceptance of the owner. Typically, the agency taking the prop¬erty will make an offer, hoping the owner will immediately accept and allow work to begin. If a mutual resolution regard¬ing its value cannot be reached, how¬ever, the municipality will institute a condemnation action in court seeking possion of the property. This is when the problems begin. The power of the Government to take the subject property is limited by Federal and state constitu¬tional requirements to pay "just com¬pensation" for the property. The exact nature of an owner's prop¬erty has been the subject of much debate and discussion. It is generally under¬stood, though, that property is consid¬ered to be "every kind of right or inter¬est, capable of being enjoyed and recog¬nized as such, upon which it is practi¬cable to place a money value" (US vs. 53 114 Acres of Land). A taking, for condemnation purposes, is considered to occur whenever there is a substantial interference with the free use and enjoyment of the property. Rarely is the necessity for the taking ever challenged and more rarely is the taking ever successfully challenged. When a taking occurs, it is not only the fee owner who is entitled to compen¬sation. Every person holding an interest in the subject property will be recog¬nized. Thus, all persons who at the time of taking have a compensable interest in the property will be made parties to the case (Swanson vs. US). Minerals, like all other interests in land, are recognized as property rights, giving the owner the power to dispose of them as he or she sees fit. Thus, the only remaining considera¬tion is only "just compensation." Ex¬actly what "just compensation" is has been difficult to define. Generally, it is that amount of money that will "put the person in as good a position as the per¬son would have been in had the taking not occurred." The owner must not be forced to sacrifice or suffer by receiving less than full and fair value for the prop¬erty. Every element that effects the value of the land and that would influence a purchaser must be evaluated. Courts have employed a variety of techniques to determine just compensa¬tion but have generally relied on market value as the standard for measuring compensation to the owner. The deter¬mination of market value is based on sales, income, costs, and use. These factors have been employed in various ways but can be summed up as: -The highest estimated monetary price the property will bring if exposed for sale in the open market with a reason¬able amount of time allowed to find a purchaser who is buying with knowl¬edge of all the uses and purposes to which it is adapted and for which it is capable of being used. • The amount the property would bring if it were offered for sale by one who desired, but was not obliged, to sell, and was bought by one who was willing, but not obliged to buy. • What the property would bring in the hands of a prudent seller, at liberty to fix the time and conditions of sale. • What the property would sell for in negotiations resulting in sale between an owner willing, but not obliged to sell, and a buyer willing, but not obliged to buy. • What the property would be rea¬sonably worth on the market for a cash price, allowing a reasonable time to affect a sale. (Michigan Standard Jury Instructions). Special consideration regarding mar¬ket value is given when the taking is only partial, rather than complete. An example of this partial taking is when a state highway cuts across the northern half of a parcel of property, leaving the rest behind for the owner. A variety of problems can be immediately seen. In a partial taking, the owner is permitted to recover not only for the property taken, but also for any loss in the value of the remaining property. The measure of compensation for partial taking purposes is generally the difference between the market value of the entire parcel before the taking, and the market value of what is left of the parcel after the taking (Michigan Stan¬dard Jury Instructions). Determining the partial taking value for mineral bear¬ing lands is the difficult issue.

The objectives of the research were to determine whether a model health and safety program could be defined in terms which would enable its application to mines of all types, and, if such a model program could be defined to determine through evaluations in two mining companies whether it would achieve measurable improvements. This volume describes the model, how it was applied in the field, and how it was evaluated. Anecdotal data to illustrate common kinds of safety problems and their solutions are included. The literature and field research that preceded the model definition is discussed in Vol. 2, which covers the period of September, 1980 to September, 1981.

Ore concentration processes are a function of the respective particle size distribution; however, most of them do not use an efficient operational method to determine it. From a practical point of view, the surface area can be calculated for any size analysis. The physical principles for determining the size distribution in each method are different, for the results will not be compared directly. During the development of the research project of the sulfide ore flotation method using inert gas, different methods for calculating the specific surface area have been used, such as sieving, sedimentation/X-ray, laser diffraction and BET, i.e. specific techniques to determine the specific surface area of copper and gold ore concentrates. The statistical method of minimum squares was used to achieve practical correlation equations among them. Regarding these two ores, if one knows a specific surface area value using one of the methods above, one can predict the result of the others. Diminution of the reagent consumption was so controlled and it could be even decreased by using inert gas.

To provide an engineering solution to wood crib design and deployment strategies that will ensure safety for underground coal mine workers. This is accomplished by preserving necessary ground control requirements while minimizing support costs or by developing new support strategies to enhance ground support in difficult conditions. A secondary objective is to be able to quantify wood crib support performance to define support requirements for alternative support systems. These objectives have been achieved through a simple-to-use computer program called the wood crib performance model (wcpm).

In this case study we compare the sampling quality of diamond drilling (DD) and reverse circulation (RC) drilling at the high sulfidation Purnama gold–silver (Au-Ag) deposit located in northern Sumatra, Indonesia.There was a systematic bias of 23 per cent gold metal under-call in the diamond drilling based Ore Reserve estimate compared to the mill reconciliation over three years of production. The RC based Grade Control data and mill production data were in much closer accord. Investigation led to quantification of the significantly reduced sampling imprecision (or improved precision) of RC drilling samples relative to diamond drilling samples and the determination of a grade bias between the drill types caused by sample volume and metal distribution in the mineralisation. An infill RC drilling program was undertaken to improve data density across the pit for inclusion in the Mineral Resource estimate. This subsequently increased Au metal in the estimate by 16 per cent.The sampling imprecision of primary diamond drill sampling is rarely tested. Duplicate sampling can be used to quantify sampling imprecision at each stage of subsampling. In diamond drilling it is tested at the primary sampling stage via second half core sampling, while RC sampling is tested with field duplicate sampling at the rig. Duplicate data can be compared in a number of ways to determine imprecision including Thompson-Howarth plots which quantify imprecision to allow comparison between different methods and protocols. Comparing sampling imprecision between data sets and data types allows determination of optimum drilling and sampling protocols and can reflect upon the underlying validity of Mineral Resource input data and estimation outputs.CITATION:Sims, D A, Pocoe, J, Kasnanto, A N and Pulungan, B, 2017. In 1985 at the request of the Bureau of Land Management, personnel from the U.S. Bureau of Mines examined a 27,680-acre portion of the 30,420-acre King Hill Creek Wilderness Study Area (10-19-2) in order to evaluate the mineral resources. The study area, in southwestern Idaho, is underlain by Tertiary tuffs and basalt. There are no known mining claims or prospects in the study area, and no mineral resources were identified. The Volcano mining district is immediately north, but mines there are in granitic rock which does not crop out in the study area. Oil and gas leases were offered for land in the southern part of the area, but no applications were filed, and the lease offering was withdrawn (1985). INTRODUCTION This report describes the USBM (U.S. Bureau of Mines) portion of a cooperative study with the USGS (U.S. Geological Survey) to evaluate mineral resources and potential of the King Hill Creek study area at the request of the BLM (U.S. Bureau of Land Management). The USBM examines individual mines, prospects, claims, and mineralized zones, and evaluates identified mineral and energy resources. The USGS evaluates potential for undiscovered resources based on areal geological, geochemical, and geophysical surveys. Results of the investigations will be used to help determine the suitability of the study area for inclusion into the National Wilderness Preservation System. Although the immediate goal of this and other USBM mineral surveys is to provide data for the President, Congress, government agencies, and the public for land-use decisions, the long-term objective is to ensure the Nation has an adequate and dependable supply of minerals at a reasonable cost.

A new and unique logging tool, called the Borehole Televiewer (BHTV), has been developed to inspect boreholes and to evaluate formations. Even though geologists and engineers have had only about 3 years' experience with the BHTV, the thinking of many of them has been radically influenced by the fascinating and revealing "log-picture" recorded with the tool. The BHTV fills a need for a logging tool that can produce a direct and descriptive record of the physical properties of the borehole environment. Although primarily developed to evaluate fractured reservoirs, the BHTV has been used successfully to solve a variety of problems related to formation evaluation and borehole inspection. Geologists and petroleum engineers have been confounded for many years by the problems of locating and evaluating fractures. Interpretation of the usual resistivity, acoustic or radioactivity logs, as well as the analysis of cores, for evaluation of fractured reservoirs is extremely difficult and often not definitive. This is understandable since analysis of cores from fractured formations has reported variously: (a) low porosity, (b) no effective permeability, (c) lack of any matrix oil saturation and (d) oil stains on fracture planes as the only indications of potential production.14 In recent years acoustic amplitude logs have been introduced and used with varying degrees of success to locate fractures.8'9'11"13 Conventional amplitude logs at best give only qualitative answers where quantitative ones are desired. The logs reveal nothing of the orientation of the fractures. In addition to these logs, various types of cameras, television, and rubber impression packers have been used for borehole inspection. (See Appendix.) The BHTV logging tool supplies both the quantitative and the orientation answers about fractures. The borehole can be filled with any homogeneous, gas-free liquid such as fresh water, saturated brine, crude oil or drilling muds. This tool takes an "acoustic picture" of the borehole wall. The resulting log is a representation of the borehole wall as if it were split vertically and laid flat. The log is oriented with respect to magnetic north. Any physical changes in the borehole wall are seen as changes in picture intensity. In this way, fractures, deformation or pits are reflected on the log. Tool Description The fundamental parts of the BHTV are shown in Fig. 1. A piezoelectric transducer probes the borehole wall with bursts of acoustic energy. The Skorpion process comprises three processing steps, atmospheric leaching in sulphuric acid, zinc solvent extraction and electrowinning to produce special high grade zinc. The major mode of impurity transfer was attributed to crud runs in the solvent extraction circuit. Crud may be described as a heterogeneous, partly inorganic, partly organic mass of material which accumulates predominantly at the interface between organic and aqueous solutions. The paper describes the route causes of the crud formation in the solvent extraction circuit and optimisation strategies which are being followed to prevent impurity excursions in electrowinning. "The triboelectric charge attributes of some silicate minerals (i.e., feldspar, quartz and wollastonite) after contacting different triboecharging medium made of different materials were studied. The charge acquisitions by different size fractions of minerals were monitored and accordingly the energetic work function values, i.e., the main parameter determining the entity of triboelectric charges acquired by mineral grains, of the examined minerals were estimated. Moreover the separation behavior of different size fractions of these minerals through the electric field of a laboratory free-falling separator when the mineral grains are charged by different tribochargers were observed and considered as the electrical separation potential of the examined minerals.Furthermore, the role of adsorption of different chemical species on triboelectric charge characteristics and charge acquisition of mineral samples were described from theoretical point of view and the effects of some chemical reagents on triboelectric charge acquisition of the examined minerals were studied. In addition the separation behavior of chemically conditioned quartz, feldspar and wollastonite minerals, using different anionic and cationic reagents, through the electric field of a free-fall electrostatic separator before and after chemical conditioning were monitored.Finally an attempt was made to translate the findings from single mineral systems to a complex silicate ore, containing mainly of feldspars, quartz, and wollastonite. Different separation tests under various conditions were conducted to this complex silicate ore. Before passing through the separation device, the ore sample was conditioned by different cationic and anionic reagents and then was triboelectricaly charged by different tribocharging medium in order to find the effective reagent and tribocharging medium for separating silicates. "Agglomeration of fine iron ore concentrates is carried out in two steps:Balling, which refers to the production of green pellets by tumbling moist fines powders in drums, discs, or cones, and Induration, which refers to the subsequent thermal treatment of the green pellets in straight grate or grate-kiln systems.This paper addresses computer simulation of balling or green pelletization step. The process of agglomeration from a mechanistic point of view can be described as the transformation of moist feed to well-formed species or pellets. The moist feed is composed of fines of infinitesimal size while well-formed species are of finite size and number. These well-formed species undergo changes in their size and number through different mechanisms of agglomerate formation and growth. Nucleation, coalescence and layering are the three main mechanisms that describe the formation and growth of granules during an agglomeration process. A population balance equation enables quantitative description of the evolution of agglomerate size distribution due to the occurrence of each of the mechanisms.A numerical solution for the population balance model is necessary and is obtained by the use of a sizediscretization approach. The numerical solutions provide a suitable basis for the analysis of the agglomeration process. Also a coalescence kernel has been introduced that is capable of describing the simultaneous occurrence of nucleation, coalescence and layering mechanisms. The effect of feed moisture has been described using a moisture factor with an exponential functional dependence on the moisture content. The effect of the feed to seed ratio is modelled by the introduction of a crowding factor. It was assumed that only the feed particles which are much more in number experience a crowding or restricted in space interactions effect. A computer simulation program has been developed with MATLAB as the simulation language."

Shafts into coalbeds usually produce the most methane, so the information in this chapter applies primarily to shafts at coal mines. Nevertheless, much of the information is relevant for noncoal mines that have methane in the mine or in the overlying strata. The Miranda Pine Roadless Area Review and Evaluation (RARE II) study area (No. 5114) comprises 12,600 acres (5,100 ha) in Los Padres National Forest in Santa Barbara County, California, about 15 mi (24 km) east of Santa Maria (fig. 1). Mineral investigations are made by personnel from the U.S. Bureau of Mines on National Forest lands identified as Further Planning Areas in the RARE II program. The Bureau of Mines reviewed literature, mining claim records, and production files; examined the study area; and sampled mineral properties where appropriate.

In 1983 the U.S. Bureau of Mines conducted a mineral survey of the Golden Valley Wilderness Study Area (WSA), CDCA-170. The 29,887 acre WSA, located in the western Mojave Desert near Ridgecrest, California, is underlain by pre-Tertiary plutonic rocks and volcanic and sedimentary rocks ranging in age from Miocene (?) or Lower Pliocene (?) through Pleistocene and Recent. No mines were operating in the WSA in 1983, nor is any mineral production known to have come from the WSA. Two mining claim blocks, portions of which are within the WSA, and seven isolated prospects, four inside the USA, were examined and sampled. No mineral resources were identified. Widespread propylitic alteration, with localized argillic and alunitic alteration, occurs along the southern boundary of the study area. Samples from claims and prospects within the altered zones are anomalous in gold, silver and arsenic, and some contain antimony, tungsten and mercury, indicating gold resources may exist. Alluvial sample results suggest recent claims in the northwest corner of the study area may also have gold resources. Portions of the study area are within the Randsburg Known Geothermal Resource Area while other segments are considered prospectively valuable for oil and gas and for sodium.

Energy and the conversion of potential energy into alternate forms is becoming a topic of household conversation for a larger segment of the world's population as mankind's desire for products derived from the vast array of technological developments continues to expand. The world's use of steel and the high energy consumption related to the production of steel promotes an awareness of the limitations of existing technology and a search for more economical alternates. Terminology such as (BF) Blast Furnace, (BOP) Basic Oxygen Furnace, (EAF) Electric ARC Furnace, (DR) Direct Reduction, (DRI) Direct Reduced Iron and (FC) form coke is becoming commonplace as alternates are being sought to alleviate the energy crunch. Coke production by various methods was developed as early as the seventeenth century in Europe to replace the disappearing hardwood forests that supplied the initial blast furnace fuel in the form of charcoal. In 1880, the Semet Solvay by-product coke oven design was introduced to the United States at Syracuse, New York, to supply coke for use in the production of soda ash, coke oven gas and its by products as the primary source of many organic processes. Although the Semet Solvay coke oven has not been marketed for decades, these coke oven batteries are in use today producing metallurgical coke, coke oven gas, and related by-products.

In this National Institute for Occupational Safety and Health (NIOSH) investigation, numerical modeling is used to evaluate the degree the pillar strength is increased with a rectangular pillar over a square pillar. Three-dimensional models are developed with pillar sizes and geometries typical of underground limestone mines in the United States. Physical properties for the models are based on geotechnical surveys of nearly 30 underground limestone mines. To examine the effects of pillar length on pillar strength with the modeling, a parametric study was conducted where the pillar width was held constant while the length and height were varied resulting in width-to-height ratios ranging from 0.5 to 1.5 and width to length ratios ranging from 1 to 6. There are two aspects to pillar strength and failure. At relatively low stresses, pillars can fail as a result of geologic structure. At greater depths and sufficient extraction ratios, the pillars can also fail as a result of the vertical stresses exceeding the pillar strength. The effects of increasing pillar length regarding both strength aspects are presented in this study. Equations were developed for the increase in pillar strength with both height and length based on the model results. The results from these equations were compared to those from previously developed empirical equations for rectangular pillars. For the more slender limestone pillars with a width-to-height ratio below one, there is little increase in pillar strength for length-to-width ratios above 2 and almost no increase with length for a width-to-height ratio of 0.5. Only with the more squat pillars is there a significant improvement in strength with length. The gain in pillar strength with length for the pillars is explained by the change in the ratio of the area of the pillar affected by the ends to the area of the pillar. For the squattest pillar, the change in strength is also affected by an increase in pillar confinement along the central length of the pillar as the pillar transitions from a square to a long rectangular pillar. With geologic structure, added pillar length can significantly improve the pillar strength, depending on the strike of that structure with respect to the long pillar axis.

"Breakwater Tunisia S.A.’s Bougrine mine is located in a semi-arid region of Tunisia characterized with Triassic salt domes. Due to extensive agricultural land-use in the mine area, a zero-discharge tailings facility design and high water recycling rates to the concentrator were chosen to minimize the environmental impact to the surrounding area. The process water supply has an accumulation of naturally occurring salts due to high evaporation rates and the need to recycle 70% of the process water. The elevated salt content of the process water had an adverse effect on the efficiency of the flotation reagents, which led to the production of lower quality zinc concentrate.The impact of the water salinity on the zinc concentrate quality was documented by extensive laboratory testing. A feasibility study was prepared and a decision was made to install a reverse osmosis plant for desalination of the process water. A plant was constructed during 2000 which currently supplies up to 85 m3/hr of de-mineralized water, equal to approximately 45% of the total process water requirement. The salinity of the process water decreased from about ten to twelve grams per litre before installation to less than three grams per litre. Together with minor modifications to the concentrator circuit, Breakwater Tunisia has increased the zinc concentrate grade from 50% zinc to 55% zinc without compromising the zinc recovery rate of approximately 84%.This paper discusses the successful installation of a reverse osmosis desalination plant that allowed Breakwater Tunisia to improve the grade of the Bougrine mine zinc concentrate and thus increase the net smelter return.INTRODUCTIONBreakwater Resources Ltd., through a wholly owned subsidiary, Breakwater Tunisia S.A., acquired the Bougrine underground mine and related assets in September 1997. During the winter of 1997/1998, the company rehabilitated the mining equipment, modified the concentrator circuit, developed a new mine ventilation system and prepared a new mining production program. The mine was reopened on May 2, 1998 and was in commercial production as of June 1, 1998."

In highwall mining, once a sufficient number of web pillars are developed, they can fail catastrophically in a domino-type failure, posing a safety hazard to highwall miners and sterilizing mineable reserves. Three recent case histories of catastrophic web pillar failure in U.S. and Australian mines are documented and analyzed with two design approaches. The conventional design approach uses only a strength criterion, while the postfailure design approach uses both strength and stability criteria to insure an acceptable failure mode should strength failure occur. Catastrophic highwall web pillar failures can cost money through equipment losses, production losses, coal reserve sterilization and lost opportunity costs. Coal recovery may be higher. but the benefits of higher recovery must balance the potential costs of failure. Application of the conventional or postfailure design approach will decrease coal recovery and revenues, but the risk of potentially costly failure is much less.

Waste materials caused by mining activities are an important environmental problem. Paste technology is a good alternative for waste management because it has many benefits in the aspects of environment, cost and safety. Disposal of process wastes in paste form is an attractive option for waste management, as it eliminates or reduces the risks associated with conventional methods. Due to the geotechnical characteristics of the paste, it is very similar to soil materials. So determining the geotechnical properties of the paste material is essential to durability of the paste. The some important geotechnical properties are compressive strength, porosity, shear strength, hydraulic conductivity, water content, consolidation, etc. In this study, the important parameters and the relation between them were investigated and obtained some results which will affect for optimum design of waste management.

The year was 1974. The event - the United States Congress was embroiled over what issues should be included in the proposed national surface mining law. The question - what should be done with underground mines? The leading bills ultimately addressed the environmental impacts associated with underground mines including provisions to protect the surface from subsidence impacts. Amid the fears that this subsidence language might discourage underground mining, sponsors of the bill were asked to explain the meaning of the provision that read "to prevent subsidence to the extent technologically and economically feasible." Was this an attempt to limit mining that caused planned and controlled subsidence? Former Deputy Director of the Office of Surface Mining, Dean Hunt, reviewed some of these historical events in a 1985 presentation before the Eastern Mineral Law Foundation. He reported that in 1974 Congressman Morris Udall took the floor to respond to these concerns expressed by other members of Congress and the industry. Mr. Hunt cited Congressman Udall's July 10, 1974 Congressional Record statement: "The House bill contemplates rules 'to prevent subsidence to the extent technologically and economically feasible.' The word prevent led to fears expressed by the Secretary of the Interior Morton, that the effect would be to outlaw longwall mining, with its obvious subsidence ... in fact the bill's sponsors consider longwall mining ecologically preferable and it and other methods of controlled subsidence are explicitly endorsed." Further, the report that accompanied the front-running bill, HR11500, provided the following clarification on the issue of subsidence prevention: "It is the intent of this section to provide the Secretary with the authority to require the design and conduct of underground mining methods to control subsidence to the extent technologically and economically feasible in order to protect the value and use of surface lands. Some of the measures available for subsidence control include: (1) leaving sufficient original mineral for support; (2) refraining from mining under certain areas---or (3) causing subsidence to occur at a predictable time and in a relatively uniform and predictable manner. This specifically allows for the uses of longwall and other mining techniques which completely remove the coal." It is clear from the preceding statements that Congress considered the removal of all the coal and causing subsidence in a predictable and uniform manner to be equal to or better than leaving support coal and causing no subsidence. While the actual provision in the bills talked of preventing subsidence, a subsequent exception made it clear that the real intent was to control it. This is evidenced in the specific planned subsidence language that appeared in the bills and ultimately in Section 516 (b) (1) of PL95-87, the Surface Mining Control and Reclamation Act. It reads: "...adopt measures...to prevent subsidence ... except in those instances where the mining technology used requires planned subsidence in a predictable and controlled manner..." In spite of this historic record that supports controlled subsidence, something has been lost in the implementation. The primary focus by many regulators over the past few years has been on the "prevent" aspect irrespective of mining method being used. This has appeared to change the original intent of Congress from one of controlling subsidence to one of minimizing damage. The objective of this report is to review some of the current regulatory issues that impede full extraction mining and offer some suggestions on possible ways to deal with these issues.
