Introduction The impact of the Comprehensive Environmental Response, Compensation, and Liability Act, or Superfund, as well as the Resource Conservation and Recovery Act (RCRA) and their state counterparts underscore the intention of the nation's lawmakers to reduce the risk from hazardous substance to American society. The promises and requirements embodied in these laws, together with their prospects for liability, will continue to have a very substantial impact on decision making in the mining industry. These laws present the prospects for staggering liabilities, often of an unquantifiable nature in terms of time and amount. It is therefore necessary to keep them in clear focus. This is particularly true in light of President Reagan's signing into law the Superfund amendments on Oct. 17, 1986, and in light of the Environmental Protection Agency's (EPA) major policy pronouncement of July 3, 1986, regarding solid wastes from extraction of ores and minerals. This article examines the general trends as well as the specific provisions of these laws in an effort to assess the prospects of liability for the mining industry of releases of hazardous substances into the environment. Hazardous substances vs. hazardous wastes The distinction between the terms "hazardous substances" and "hazardous wastes" is important to appreciate for the purposes of assessing the potential for liability for a mining operation. Hazardous substance is a term that appears in and is defined in the Superfund Act. In Superfund, it is defined by reference to other substances that have been declared to be hazardous under other federal environmental statutes, such as RCRA, the Clean Air Act, and the Clean Water Act. Hazardous waste is a term that is less all-encompassing than hazardous substance, as that term is defined by RCRA. Hazardous substances do not need to be wastes to be considered hazardous for the purpose of Superfund liability. A "release" of a hazardous substance into the environment can bring about potential liability under Superfund. Many mining wastes, even though they are not considered hazardous wastes by EPA under RCRA, have been determined by that agency to be capable of bringing about liability under Superfund if they contain chemical substances, such as the heavy metals copper, lead, mercury, zinc, silver, and others. Therefore, it is not sufficient for the mining industry to be able to answer whether one has hazardous waste at a mining site. That question only goes partway in addressing the potential for liability. The next question is, do one's solid or liquid mining wastes contain hazardous substances that could bring about liability under Superfund? Superfund 1980 law: A review Some provisions of Superfund as it existed before its recent amendments must be considered. The law provides that the owners and operators of mining sites, together with those who transport hazardous substances to such sites, can be held jointly and severally liable for the cost of cleaning up the site. The concept of joint and several liability means that one party, as among many, can be held totally responsible for the costs of cleanup. The U.S. Bureau of Mines (USBM) conducted a series of laboratory tests to investigate the effectiveness of using a flooded-bed scrubber with exhaust ventilation in deep-cut faces of up to 12.2 m in length. An experimental test program to determine the impact on respirable dust levels resulting from changes in face airflow, curtain setback distance, operator positioning, and operating parameters of the external spray system on the miner was completed. Gravimetric sampling was conducted in the immediate return and at three sampling locations on the off-curtain side of the entry. Statistically significant differences in dust levels on the order of 0.5 to 1.2 mg/m3 were observed between specific sampling locations and changes in several test parameters. Dust sampling results indicated that a flooded-bed scrubber and exhaust ventilation can be a viable dust control system for extracting deep cuts up to 12.2 m in length. The impact on methane was not evaluated.

Mountain Top Removal (MTR) mining started in West Virginia nearly thirty years ago. This surface mining method can extract multiple coal seams as thin as a few inches thick with total recovery and minimum rock dilution in very steep mountainous terrain. It is highly efficient even if coal seams are in close proximity and small in aerial extent. Consequently, MTR has been widely used in the Central Appalachian Coalfield (mainly Kentucky, Tennessee, Virginia and West Virginia) for the past thirty years with great success. In that respect, there has been no demand for research and little scientific research has been performed to investigate its impacts on the surroundings in the history of MTR mining. However, in the past two years the debate over the MTR mining has grown quickly and in times become very intensely. This paper describes chronologically the issues raised by various parties, legal actions, its impacts on mining permit application and research projects developed to address the issues.

NIOSH’s Pittsburgh Research Laboratory is currently involved in research to identify silica dust generation in underground metal/nonmetal mines. The ultimate goal of this research is to develop control technologies to reduce worker exposure to respirable silica dust. Commodities and job classifications with the highest silica dust exposure have been identified through analysis of the Mine Safety and Health Administration (MSHA) compliance dust sampling database. Dust surveys were conducted in an underground limestone and gold mine to investigate silica dust sources, generation levels, and controls being used. A summary of the mining operations, sampling procedures, resulting data, and suggested methods to improve the dust control will be provided.

US mine production of iron ore in 1984 showed some improvements compared to 1983. But reduced demand from the iron and steel industry caused temporary shutdowns of many iron ore mines and pelletizing plants. US raw steel production in 1984 was slightly above 1983, but still at a depressed level. Production was 83 Mt (92 million st), compared with 77 Mt (85 million st) in 1983 and 68 Mt (75 million st) in 1982. Two major production trends continued in 1984. They were the increased production from electric furnaces and the growing use of continuous casters. Electric furnace production included 33.2% of the steel poured in 1984, compared with 31.5% in 1983. Continuous casting was used for 39% of 1984 steel production, compared with 32.1% in 1983. Statistical Process Control Statistical Process Control (SPC) has taken on new proportions in the iron ore and steelmaking industries within the last year. This mathematical technique is used to monitor, control, evaluate, and analyze a manufacturing process. The technique charts variability of important quality parameters. Training and adaptation of SPC techniaues for process control have been initiated at Inland, Steel's Minorca, Pickands-Mather's Hibtac, Cleveland-Cliff's Empire and Sherman operations, and at Reserve Mining. One of these operations has requested its bentonite supplier provide SPC charts on quality specifications. Some of the steelmaking operations (Inland Steel, Bethlehem Steel, Dofasco, LTV Steel, National Steel, Stelco, Weirton Steel, and Wheeling-Pittsburgh) have set up SPC programs within their operations. And they also have insisted that some of their suppliers use SPC. Plant Shutdowns The permanent closure of Stelco's Griffith mine at Red Lake, Ontario, has been delayed by one year. This gives employees more time to adjust. The mine is now set to close in April 1986, instead of April 1985. Sidbec (Canadian government) and its other partners (including British Steel Corp., Quebec Cartier Mining, and US Steel) closed its iron mining operations at Gagnon, Quebec. The pellet plant has been leased to Quebec Cartier. New Iron Ore Operations The massive Carajas iron ore project in Brazil is scheduled to come onstream in Jan. 1986. It is to achieve full-scale commercial shipments by July of that year. The 66% iron crude ore requires only crushing and screening before shipment. The product consists of 83% sinter feed and 17% coarse ore. Annual production capacity will be 32 Mt (35 million st) when the project is completed. Principal customer for the ore is Nippon Carajas Iron Ore Co., a consortium of Japanese steel mills. The Arab Iron & Steel Co. (AISCO) has started up a $US300 million, 3.6 Mt/a (4 million stpy) iron ore pelletizing plant built by Kobe Steel Ltd., at Al Hidd-hide in Bahrain. By 1986, this grate-kiln-cooler plant will supply high quality iron ore pellets to feed direct reduction plants in the immediate Gulf area and Far East markets. Iron ore supplied from Brazil, Peru, India, and Mauritania provides the feed to the pellet plant. Hydrated lime (2%) is used as a burden.

During the last 28 years, I have had the very challenging and rewarding experience of working as an engineering professional in a large multinational company, both as a manager of engineers and engineering projects as well as an inventor and generator of new engineering processes and products. Due to the diversified geographic and tech¬nical nature of my employer's business, my responsibilities have taken me all over the world. This has included interactions with people in different industries including minerals, coal, chemicals, petroleum, pulp and paper, agriculture and pharmaceuticals. As diverse as my experience may seem, it has always amazed me how common the basic underlying technology and economic trends are that shape the working environment that any given engineer in any given geographic loca¬tion will experience. I would like to discuss the industrial evolution from micro to macro engineering. One of the basic truths behind how industry must and will operate is "change," including: • the creation of conditions for change, • the anticipation of change, • the resistance to change, • the rewards that being part of a change can bring and • the destruction that change can bring to the unprepared. This fact was well stated by Heractitus around 500 BC.: "There is nothing permanent except change." This simple truth has been valid since the dawn of time and, if anything, is accelerating in nature every decade.

This paper gives a brief overview of impacts of coal blending on coal-fired power plants performance and discuses the preliminary results of an on-going study aimed at evaluating the effect of coal properties on the effectiveness, compatibility and thermal reactivity of coal blends. Plant survey studies reported no significant impacts on an existing plant designed for a high rank coal when switched to a blend of low- and high- rank coal. However, slight modification of some aspects (handling, fuel storage/stockpile, transportation, preparation, and general housekeeping) of plant design and operation may be necessary. The preliminary results of an on-going study at the Mineral Industry Research Laboratory shows that more compatible and better blends could be made from coals where ranks are closer than from those where ranks are far apart.

The Cortez gold mine is located in Lander County, NR, about 130 km (80 miles) southwest of Elko. Cortez Gold Mines (CGM) is a joint venture between Placer Dome US Inc. (60% operator) and Kennecott Corp. (40%). The claims that supply oxide and refractory ore feed to the Cortez milling facility are located in both Lander and Eureka counties. These include the Cortez and Horse Canyon deposits, all operated by the joint venture. Other deposits outside the CGM claim area include Fire Creek, Buckhorn, Gold Bar and Tonkin Springs. These deposits all occur along the Battle Mountain-Eureka Trend. History Mining in the Cortez district began in 1862 with the discovery of high-grade silver ores. Grades in the hundreds of ounces per ton occurred in an area 7 km (4.5 miles) southeast of the current CGM mill site. Underground mining through the Garrison and Arctic tunnels provided the bulk of the ore production between 1864 and 1895. To a lesser extent, the Mill Canyon area also supplied ore until 1930.

The East Bay Municipal Utility District’s Claremont Tunnel is an 18,000-foot long water tunnel that crosses the Hayward Fault zone near Oakland, California. It was originally completed in 1929. This project involved the construction of a bypass tunnel through the fault zone, including an enlarged vault section designed to accommodate up to 8.5 feet of horizontal offset. Ground conditions encountered included sheared and crushed serpentinite and clayey fault gouge, and presented specific challenges for construction. A special excavation and support sequence used concrete-backfilled side drifts as foundations for the vault steel sets. It also allowed for a 20-foot-wide top heading and bench excavation in soft and squeezing ground conditions.

The ability of companies and countries to mine copper and other mineral commodities competitively and in the process to generate new wealth depends on their mineral endowment. Chile, for example, produces and exports copper because it is well endowed with high-quality, low-cost deposits. This production creates wealth that benefits mining companies and their stockholders, the government, local communities, as well as copper consumers around the world. The widespread perception that mineral endowment must largely determine competitiveness, or what economists call comparative advantage, must be true at any particularly moment. Countries with abundant reserves must be competitive. This follows from the definition of reserves — the quantity of a mineral commodity found in discovered deposits that are profitable to exploit under current conditions. As a result, it is a tautology and not particularly interesting. The important question is what causes reserves to change over time, producing in the process new wealth and shifts in competitiveness?

The Piedras Verdes copper mine is a new run-of-mine (ROM), heap leach, solvent-extraction/electrowinning (SX-EW) operation located 21 km (13 miles) north-northwest of the town of Alamos in the state of Sonora, Mexico. The Piedras Verdes copper mine is wholly owned by Frontera Copper Corp. (FCC), a Canadian corporation, through its 100 percent beneficial interest in Cobre del Mayo S.A. de C.V. (CDM), a Mexican registered company. The January 2008, minable reserves were estimated to be 193.6 Mt (213 million st) at a grade of 0.36 percent copper. The overall recovery of total copper was estimated to be 61.9 percent. The property has an additional 17-year life and is designed to produce 31.7 kt/a (70 million lbs/year) of cathode copper. Construction commenced in early October 2005. The first copper cathode was produced 12 months later at a total capital cost of $100 million. Elevations at the site range from 150 to 300 m (490 to 985 ft) above sea level. The area has excellent infra-structure in the form of towns, power, water, roads, rail, airfield and access to the deepwater port of Guaymas (Fig. 1). The surrounding area is also famous for its numerous polymetallic (lead, zinc, copper, silver and gold) epithermal veins. Some of these were mined for more than 200 years and provided the wealth on which the town of Alamos was built. The original village of Piedras Verdes was located in the area of the proposed openpit mine and, consequently, it was necessary to construct a new townsite 6 km (3.7 miles) to the south before project development could commence. The new town site (Fig. 2), complete with power and water supplies, roads, sewer system, schools, clinic and recreational facilities, was completed and occupied by 49 families in September 2005. CDM received its remaining permits from the Mexican environmental authorities on Sept. 20, 2005. This enabled the company to proceed with full-scale development. CDM owns or controls 27 mining concessions covering the resource. Surface rights to the Piedras Verdes project were controlled by four Ejidos (communal agrarian and/or ranching societies) and five individual landowners. CDM has acquired all surface rights necessary for its mining operations and associated facilities either through outright purchase or long term lease agreements.

The Department of Health and Human Services (HHS), National Institute for Occupational Safety and Health (NIOSH), Office of Mine Safety and Health Research (OMSHR), with the assistance of cooperating underground mining operations and state agencies, has conducted research exploring devices and technologies that could be used to assist miners navigating through smoke and dust resulting from a fire or explosion. Recent events in mines confirm that smoke and dust can enter and contaminate mine escapeways creating an atmosphere with severely reduced visibility. This reduced visibility results in substantially increased escape times, possible disorientation or confusion, and increased stress levels, and may prevent evacuation altogether. Tools or devices that assist miners in navigating through smoke-filled areas void of lifelines could make the difference in successful escape from the mine. This paper presents the results of OMSHR research to identify and evaluate tools and devices that could provide meaningful information to evacuating miners in areas with limited visibility and without the benefit of a lifeline.

Because of the lack of a universally accepted definition or standard for RCA, we are left to our own conventions in the marketplace as to what is most ?effective? or a ?Best Practice? for our own facilities or organization. This lack of uniformity in the application of RCA produces an equal lack of uniformity in the measureable outcomes of RCA on the bottom-line from site to site and industry to industry. What is the definition of success for an RCA? Is it regulatory compliance? Is it some quantifiable measure of bottom-line performance? Is compliance and bottom-line performance the same thing? Can we measure the ROI we receive by doing compliant RCA? These questions must be adequately addressed if any definition of RCA is to be effective on the bottom-line. Like our various Corporate Vision and Mission Statements, what would be our Vision and Mission for RCA? When pondering the answer to this question, we should consider: ? What Key Performance Indicators will the Success of RCA be Linked to? This provides a direct correlation to the corporate dashboard and therefore garners support for the RCA effort when implemented at the sharp end. Not until we know what KPI?s will effectively measure our maintenance and reliability objectives can we begin to establish which opportunities will afford the greatest returns1. ? What Bottom-Line Metrics will be Tracked to Measure the Effectiveness of Our RCA Effort? Will it be increased production, profitability, regulatory compliance, etc.? Will it be decreased injuries/fatalities, claims, customer complaints, risks, etc.? We should be specific about these metrics and their correlation to the metrics on our corporate dashboard. ? What Will Trigger an RCA Investigation? Normally companies will establish quantifiable thresholds to be surpassed before an RCA will be conducted. Examples may be an OSHA recordable injury, a failure event in which production losses exceed $250,000, an equipment failure in excess of $50,000 or a regulatory violation. This is the norm. However, we should realize this is using our RCA skills totally on a reactive basis. High Reliability Organizations (HRO) strive for proaction and they also use RCA proactively. Why can?t we use RCA to analyze why unacceptable risks from an FMEA are so high? It is perfectly applicable yet rarely implemented in this fashion.

DESIGN AND DEVELOPMENT OF A MOBILE MINING MACHINE INTRODUCTION Until recently, developing tunnels in hard rock has been accomplished either by the drill and blast method or by using large tunnel boring machines. Combining the flexibility of drill and blast with the safety, efficiency and productivity of a TBM has been the objective of mining machinery producers for many years. In 1979 The Robbins Company began developing a new type of tunnel boring machine called the Mobile Miner to meet these objectives. The development and testing of the Mobile Miner is the subject of this paper. CURRENT MINE DEVELOPMENT METHODS Both the drill and blast method and the use of a TBM have notable advantages and disadvantages. The drill and blast method, for example, allows much more flexibility, requires less setup time and has a lower initial cost than a TBM; however it requires the use of high explosives and blasting has a disrupting effect on the rock surrounding the development. A TBM, on the other hand, is safer to operate, more efficient, more productive and produces smooth tunnel walls without disturbing the surrounding rock. In longer straight drifts it will easily out distance the drill and blast method. The TBM, however, is limited to boring a circular cross section tunnel which must then be modified if a flat floor is required. It also has a higher initial cost and an extended setup period.

The traditional method for training personnel in the mining and other heavy industries has been face-to-face, either via a lecturer in a classroom or through an apprenticeship. With the advent of applications tools such as video, computers, and the Internet, however, a much broader range of training delivery methods is available. Especially exciting are the broad capabilities of multimedia packages that combine the best features of numerous delivery methods. Applying multimedia environments in training holds great potential, especially when there is considerable difficulty in reconstructing real training environments. The authors discuss various delivery methods currently used in training employees, including perceived advantages and disadvantages of those methods. The authors then discuss and evaluate current computer-based training efforts of the mining industry and present an example of a multimedia training tool.

Exposure?response relationships between the relative risk of lung cancer and quantitative measures of exposure to asbestos are available from a number of epidemiological studies. Meta-analyses of these relationships have been published by Lash et al. (1997) [Lash, T.L., Crouch, E.A.C., Green, L.C., 1997. A meta-analysis of the relation between cumulative exposure to asbestos and relative risk of lung cancer. Occup. Environ. Med. 54, 254?263] and Hodgson and Darnton (2000) [Hodgson, J.T., Darnton, A., 2000. The quantitative risks of mesothelioma and lung cancer in relation to asbestos exposure. Ann. Occup. Hyg. 44, 565?601]. In this paper, the risks derived in these meta-analyses have been compared. Lash et al., concentrated on process and found that the risk of lung cancer increased as the asbestos is refined by processing. Hodgson and Darnton concentrated on fibre type and found that the risk was highest for exposure to amphibole asbestos (crocidolite and amosite), lowest for chrysotile and intermediate for mixed exposure. Some of the differences between the conclusions from the two meta-analyses are a consequence of the choice of studies included. The range of asbestos types included in the studies in the analysis of Hodgson and Darnton was wider than that in Lash et al., enabling differences between fibre types to be analyzed more readily. There are situations where occupational exposure to chrysotile asbestos has shown no detectable increase in risk of lung cancer. Our objective was to develop a transfer function model of phosphate heap leaching for design, optimization and control. The procedure included analysis of time-lapse photography of a laboratory heap. Our experimental results confirm the predicted system transfer function kinetics. Our conclusion was that the transfer function and z transform that we have developed will allow us to control flow rate and pH online.

The Western Mining Training and Translation Center is a consortium of four universities devoted to developing educational and training projects to reduce the incidence/accident rates in the mining industry. The center consists of Missouri University of Science and Technology, Montana Tech, the Colorado School of Mines and the University of Utah. It is fully funded by the National Institute for Occupational Safety and Health (NIOSH). The center manages 15 educational projects and one translation project. Hazard Identification and Risk Assessment (HIRA) for Small Mines is an educational project managed by the University of Utah. The objectives of this project are to identify critical mine hazards, assess risks; outline procedures to reduce accident/incident rates in small mines in the western United States and to train mine workers and super-visors on HIRA in each participating mine. To accomplish these objectives, the HIRA personnel visited 15 small mines in Utah, Colorado, Nevada and California. At these mines, most operators were employing independent contractors to perform several tasks ranging from drilling, blasting and mucking of rock at the work site to hauling ore to a processing plant. The operation of diesel-powered equipment was one of the major tasks performed by the contractors. This article presents three case studies in which contract workers performed a number of tasks with no reportable incidents but did so unsafely. It also highlights the training received by most contractors, the constraints imposed upon them and the safety hazards to which they are exposed most frequently.

"The close vicinity of mining companies to other sites that are used for commercial and residential purposes or to areas under conservation as well as the fact that the people become more and more sensitive to emissions have led to a negative attitude towards mining operations in the neighborhood. It is above all the use of drilling and blasting techniques that give rise to objections, in the course of which demands for more environmentally-friendly production methods have been voiced. It is in this context that production methods without the use of explosives are considered as an option. After all, the use of such production methods is the only alternative for some quarry operators. The question is what are the true benefits of these techniques and what is the relation between a possible improvement of the environmental effects on the one hand and the technological potential as well as the costs on the other. It is intended to assess the mining techniques for solid rock in their entirety. This paper will therefore look at the aspects for assessing mining techniques in the context of their environmental impact and the costs."

INTRODUCTION The Norad Expansion Project was located 10 miles southwest of Colorado Springs, Colorado, within Cheyenne Mountain. The expansion areas to be excavated would be adjacent to the existing underground Norad complex, which would remain in operation during the work on the expansion. The original complex had been constructed approximately eight years earlier and had been in full operation for approximately five years. Phase I, Excavation was awarded the Tiro Construction Corporation, a subsidiary of Harrison Western Corporation, Denver, Colorado, in the fall of 1970. Notice to Proceed was given to Tiro on 28 December 1970. The project owner was the U. S. Air Force, design was performed by the U. S. Corps of Engineers, Omaha District, who would also serve as the construction agency. [ ]
