He who enters a mining claim within an Indian reservation of the United States of America acquires no rights thereby, because of the fact that the lands within such Indian reservation are not a part of the public domain, and cannot be located or acquired as mineral land. However, where such an entry is authorized as to a particular reservation by an Act of Congress, such claims as may be ontered under such authorization are thereby segregated from the reservation, and the Indian title is oxtinguished. Under the Choctaw Constitution, any citizen of that nation, in other words any Choctaw Indian, who discovered a coal mine, acquired an exclusive right to all coal within a radius of 1 mile. The laws of the Chickasaw nation provided for the formation of corporations to develop coal and other mines, with authority to contract with others to develop and work the mines. Under these laws, leases were made; but Congress subsequently abrogated all existing leases, prohibited all persons from receiving royaltics from such mines, and provided that all coal within the nation should remain the common property of the tribes. , Such leases are now expressly prohibited by an Act of Congress (32 United States Statutes at Large, 655). All leases of mineral lands upon Indian reservations must now be made under regulations promulgated by the Secretary of the Interior, and the royalties must' be paid into the United States Treasury for the benefit of the tribes. In Canada the Indians have no rights to the royal mines and minerals, and the government can make no stipulation with the Indians which would affect the rights of the Province in which the lands are situated. Therefore, while it is true that under our present law no rights can be acquired to a mining claim within an Indian reservation, it seems to be fully within the authority of Congress to make laws, giving such rights to mineral locators as it may deem necessary or expedient. There is a demand for a general law that will permit mining upon Indian reservations, and I am informed that most of the members of both houses of Congress from the Western States are in favor of Congress pass-

INTRODUCTION In the intensive analysis of core samples from oil raservoirs, there is a recognized need for pore sizc distribution data. Such data, if collected with adequate precision and in sufficient quantity, should contribute to a better interpretation of fluid flow phenomena than is now possible from a knowledge of permeability and porosity data alone. It is hoped, for instance, that pore size distribution data may eventually provide a useful aid for predicting whether a water flood, or other secondary recovery methods. will he successful in a given reservoir.' Apparatus tor measurlng pore size distribution by mercury injection at pressures ranging from 0 to 2,000 psi have been described in the literature.2,3,4 All of these apparatus are somewhat complex and fairly expensive. Furthermore, the callbration of some of the apparatus is not always easy. Great difficulty, for instance, was experienced in obtaining reproducible pressure-volume correction data for the mercury pump shown in one of the references. An apparatus was therefore developed which was less complicated and less expensive than those of previously described designs. This apparatus is, in some respects, an improved version of a previously described low pressure apparatus' (maximum pressure 150 psi) which did not cmploy a mercury pump but instead used a precision bore glass tube for measuring the injected volumes. Tests were performed with the apparatus from vacuum to 2,000 psi and it was observed that the apparatus furnished reproducible pressure-volume correction data. In addition. it was noted that the maximum correction was small. precision of measurement was high. and operation of the entirc apparatus was relatively easy. Although the apparatus was designed exclusively for samples of 1 in. diameter and 1 in, length or smaller, it could be modified without much difficulty for larger samples, if desired. IT has been suggested by a number of people that it would be worth while for some one to attempt to summarize or condense the proceedings of this symposium. This task has fallen to me as organizer and co-chairman. Its difficulty will be appreciated by anyone who attempts to read the whole proceedings. It is therefore with trepidation that I offer the following digest. In recent years there has been a renewal of interest in America on this subject of the cohesive strength of materials, and a growing appreciation of the need for a better theory of cohesion failure. The theories of elastic action and plastic action are well developed, particularly the former. The theory of plastic action is still in the course of development, but it is well along. Plastic action is terminated by cohesion failure and what is needed is a theory that will tell us when to expect the cohesion failure. In the past it has generally been assumed that cohesion failure will occur when a critical value of the maximum tensile stress has been reached. Many experiments have shown that this is not strictly true, and this symposium concerns itself with the failures of this simple hypothesis, and with the efforts that have been made to devise a more satisfactory theory. The most active contributor in recent years to knowledge in this field is Dr. McAdam, and he was asked to open the symposium with a summary or condensation of his papers and views. Undoubtedly it is presumptuous to attempt a still greater condensation, but perhaps it will be useful, because even his contribution to this symposium contains no summary, no concise statement of just what his contribution has bees. Dr. McAdam makes two main points. The first is that the cohesive strength is not a single valued quantity, but that it is a function of all three principal stresses and hence must be represented diagrammatically by a surface in a three-dimensional figure. GENERAL GEOLOGIC DESCRIPTION The mineral deposit of this case study can be described as a "typical" porphyry copper deposit of the southwestern USA and northern Mexico mineral province. The copper mineralization is related to Laramide age intrusives of intermediate composition which have been intruded into older, mostly crystalline, host rocks. Post Laramide deformation and faulting have subjected the deposit to erosion, leaching, and enrichment processes, which have created a secondarily enriched chalcocite zone. Later basin and range faulting down dropped the ore zone, resulting in deep burial beneath late Tertiary conglomerates and gravels, thus preserving the deposit from further erosion and oxidation. Lower grade chalcopyrite mineralization constitutes the primary zone underlying the enriched blanket. MANAGEMENT OF SAMPLE DATA Sample data were obtained from exploration diamond drill holes that were collared vertically and drilled with surface rigs. Most of the holes were surveyed downhole and found to deviate significantly from the vertical. The data were keypunched from original drill hole logs to formats as described in Chapter 6. Zone Zone Sample Sample Coordinates Sample Assays Leach InterLength Northing Fasting Elev Total Cu Oxide Cu (etc) face] MINERAL BOUNDARY PROBLEM AND TREATMENT According to the geologic description, at least three mineral zones are present within the ore limits, as well as fault boundaries and a buried topographic surface, each of which have to be considered. The interfaces of the various mineralogical and geological boundaries were identified as accurately as possible in each drill hole by the project geologist, the location of the interface was surveyed in the computer program in association with the nearest sample intercept to the interface (note last field of line 3). Thus, the boundary is represented as a point in 3D space at each intersecting drill hole. The linear interpolation (LINTERP) program then searched the last field of the surveyed record to find the top of each mineral zone, or geologic boundary, and read the coordinates associated with that sample point. The program then used the coordinates to compute an interpolated surface between all existing data points as described in Chapter 11. A contour map was plotted for each of the computed surfaces and reviewed by the project geologist. Where the surfaces were poorly defined due to lack of real drill hole information, the geologist, at times, inserted a "pseudo" drill hole intercept according to his best judgment and feeling for the configuration of the surface, and such points were entered into the data stream for LINTERP. INTRODUCTION Tailings produced by many uranium milling operations consist of fine sands with some silt and slimes. When fine sandy materials are placed by hydraulic methods behind an impermeable dam, they are deposited in a loose state and some portion remains saturated. These saturated, loose fine sands are highly susceptible to liquefaction, the phenomenon in which a monotonic or cyclic disturbance causes excess pore water pressure and, concurrently, a total loss of strength in the sand. Once liquefied, the fine sand flows, causing collapse of supported structures. The potential for such a liquefaction failure was identified and successfully treated at Sohio Western Mining Company's L-Bar Uranium Operations near Seboyeta, New Mexico. The Sohio tailings dam is an earthfill starter dam with tailings raises constructed upstream of the starter dam crest. Beginning with the start of mill operations in 1976, tailings were deposited hydraulically in the impoundment behind the starter dam. As the tailings level approached the crest of the starter dam, beached tailings were excavated and placed in lifts by a dozer to form two raises above the crest of the starter dam. As the impoundment has gradually filled with tailings, the decant water pond level has risen. Correspondingly, the water level in the tailings dam, upstream of the chimney drain, has also risen. By August 1980, the phreatic surface was above the crest of the starter dam and stability analyses indicated that the tailings dam did not have the safety factor of 1.0, under static loading with liquefaction, implicit in the 1980 New Mexico State Engineer's requirements. The problem related directly to the high phreatic surface in the loose sandy tailings behind a dam structure that was not capable of resisting failure which might develop in liquefied tailings. Two methods of stability enhancement were considered for the Sohio dam. One method was reinforcement of the dam using a clay buttress placed against the downstream slope. The other method was installation of horizontal drains through the starter dam to drain decant water and lower the phreatic surface. Either method would increase the stability of the dam. However, the comparative analysis of the methods indicated that horizontal drainage offered significant advantages in cost and could provide a more direct remedy of the source of the problem, the saturated section of tailings. In addition, a drainage system would be more amenable to modification and more quickly installed than a buttress. On the other hand, a clay buttress could be more directly controlled, would involve routine earthwork, and has successful precedent. Therefore, the buttress approach would involve less risk. After weighing the advantages of both methods and the costs versus risks, the horizontal drainage approach was selected. Consequently, a horizontal pipe drain system was recommended and designed (D’Appolonia, 1981a). This paper describes the design and installation of the drainage system and its initial performance. PIPE DRAIN SYSTEM DESIGN Design Criteria and Parameters To increase the stability of the dam to acceptable levels, the drainage system had to lower the phreatic surface behind the dam to the level calculated to give a minimum safety factor of 1.0 under conditions of liquefaction. In addition, the system needed to be essentially self-operating, easy to maintain, and economical. To accomplish these objectives, the following design criteria were established: 1. The pipe drains must lower the phreatic surface at least 4.3 m (14 ft.) at the midpoint along the dam (the deepest section) and by proportionately smaller amounts toward the abutments to satisfy safety factor requirements.

THE type of gas producer in which the ashes are fluxed and run off as slag was among the very earliest made. Ebelmen built the first one in 1840 at Audincourt, France, only a year after the installation of the first gas producer of which we have record. Charcoal was used as the fuel, with blast-furnace slag and clay is flux. My interest in this type of producer began when as a boy I saw the fluxing producer at Chester, N. J., which was invented by W. J.. Taylor, and described by him in 1881.1 This producer was invented independently by Mr. Taylor to meet the difficulties he experienced in making producer gas for roasting sulphurous iron ores. It will be of interest to review briefly his description of his producer. It was built like a small blast furnace, having a hearth 24 in. in diameter and 24 in. high. The bosh angle was 25° from the vertical; the diameter at the bosh 4 ft. and at the top 3 ft.; the total height 12 ft. The producer contained one water-cooled tuyere 12 in. above the bottom, with a 1.5-in. nozzle.. Depth of the coal above the tuyere; 6 ft. Mr. Taylor mixed the coal with from 30 to 40 per cent. of basic blast-furnace slag to flux the ash. Occasionally some limestone was also used, but never limestone alone, as the use of the furnace cinder gave a larger volume of slag and made it easier to maintain a proper fluidity. . The producer was blown with a small Weimer blowing engine, delivering 300 ft. of air per minute, at from 1 to 1.5 lb. pressure. The slag was tapped every 2 hr. and was black and glassy in appearance. Broken or egg size anthracite was used. The fine sizes of anthracite could not he made to work. Mr. Taylor expressed the belief that bituminous coal could be used if not too fine, but no experiments were made with this coal. Runs were made of four weeks' duration, with no stops or changes. THE work of J. E. Johnson, Jr., on the effect of small amounts of oxygen in cast iron in increasing its strength and resistance to shock, is of interest from the technical and scientific standpoints. The following exposition of the theory carries Mr. Johnson's explanation further and, in my opinion, will disclose certain related phenomena and perhaps shed further light on the subject. Some facts, so novel in character as to excite incredulity, have been accepted finally by many metallurgical authorities. One of these is that oxygen to the amount of 0.060 per cent. in cast iron gives it a breaking strength of 3,500 lb. per square inch, compared with a breaking strength 2,500 lb. per square inch in cast iron of the same composition with re-ect to elements other than oxygen, but having only 0.010 per cent. oxygen. The "oxygenated" cast iron, even if made in a coke furnace, has properties equivalent to the best charcoal pig iron. Mr. Johnson has also established the fact that the variations in combined carbon cannot account for the results. By microphotographic evidence he has shown that in oxygenated cast iron the graphite particles are dense and spherical, while in well-deoxidized cast iron the graphite particles are flaky and leaf-like. It is just a matter of common sense that iron of the latter structure is much weaker than the former. The analytical and microscopical work has been done with care and there is no doubt in my mind about the accuracy of the, experimental results. In this paper then, we shall consider it as accepted that small amounts (0.060 per cent.) of oxygen increase the strength of cast iron by producing a structure in which the round and solid particles of graphite are surrounded firmly by a principal matrix of ferrite. The purpose of this paper is to show that the reason why the graphite particles are round is founded on the fact that the particles of any precipitate are made denser and harder by the presence of a reagent having a solvent action on the precipitate. This can be stated as a law, although I have never seen it so given in any textbook.

The existence of a grain size stabilization effect on martensitic type reactions as shown by Scheill in an iron-29 pct nickel alloy and by Troiano and Tokich2 in cobalt prompted a review of other martensitic reactions to determine if this stabilization effect is characteristic of all martensite type reactions. Preliminary work has shown this effect to be present both in the gamma —+ epsilon transformation in an iron-20 pct manganese alloy and the martensite transformation of SAE 4140 and 3 pct Cr-O.40 pct steels. No appreciable effect was found in an SAE 2340 steel. The M, temperature for the gamma —+ epsilon transformation was lowered from 380°F to about room temperature by varying the annealing treatment following cold work as shown in Table I. The effect of austenitic grain size on the M, of three steels is shown in Table 2. M, was deter- mined by the conventional quench-temper method of Greninger and Troiano. In a single crystal the change in external shape concomitant with the homogeneous shear mechanism of the martensite transformation can take place unhindered. In a polycrystalline specimen a restraint of these changes must occur at the grain boundaries. Therefore, the smaller the grain size the greater the shear strain energy necessary for the formation of a martensite crystal. The degree of lowering of M, due to the reduction of grain size is much greater when the change in crystal structure involves only a small energy change, such as face-centered cubic —+ close packed hexagonal (that is, CO and Fe-20 pct manganese alloy). The maximum lowering of M, observed in the steels investigated was 50°F with a change in the ASTM austenitic grain size of 1-2 to 8-9. In comparison, the crystal structure change face-centered cubic —+ body-centered tetragonal involves a considerable energy change. There is little doubt that with much finer grain sizes the increased grain boundary restraint would greatly enhance this stabilization effect. The implications of this phenomenon are multifold. The concepts of nucleation and of growth have adequately described the isothermal phase transformations to which they have been applied.ls2 However, these concepts have not yet been used successfully to describe the kinetics of a number of transformations that are not observed to take place isothermally. A typical reaction of this type is the austenite to martensite transformation in steels, for which the new phase appears only during cooling of the parent phase. If the cooling is interrupted, transformation ceases; yet had the cooling continued, transformation would also have continued. Nuclei of a new phase do not leap into existence all at once by the simultaneous cooperation of a large number of atoms or molecules of the parent phase; rather they are formed at finite rates by gaining or losing atoms one at a time from the surrounding materiaL3,4 Further thermo-dynamic considerations require a finite concentration of small transitory nuclei of all unstable phases to exist at equilibrium in a stable phase.= For steel in particular, nuclei of ferrite (a iron) exist at equilibrium in austenite (y iron) at temperatures where austenite is the stable phase. If a high-temperature phase a be cooled sufficiently rapidly from temperature TI above the a-ß equilibrium temperature To, to temperature T-1 below To where ß is the stable phase, the equilibrium distribution of ß nuclei corresponding to the high temperature will be retained. There are two limiting possibilities of particular interest: I. The steady state rate of nucleation of ß may be appreciable at T_1, and may require a concentration of sub-critical nuclei exceeding that retained from the high temperature. Time will be required then for the concentration of nuclei to build up to the steady state value, and an induction period will be observed during which the rate of nucleation will increase to the steady state value. 2. The steady state rate of nucleation of ß may be negligible at T-l, while the critical size for continuous growth of ß nuclei, which decreases with increased subcooling of the a phase, may reach a value so small that some. of the retained high-temperature nu-

MOULD*—Has consideration been given to the problem of retreating the 4,000,000 ton tailings pile to recover the very considerable amount of asbestos fiber that was lost over the years due to insufficient operation and poor recoveries? Also, what was known about the possible content of chromite and the sulphides of nickel and cobalt? M. J. MESSEL (author's reply)—Consideration was given to the problem but nothing concrete has been done up to this time. W. P. MOULD—I am certain the tail- ings contain a very considerable quantity of fiber, not all of which is in the shortest lengths, because in the milling of talc rock from a neighboring location having a common origin with the asbestos bearing serpentine source of the tailings pile, a concentrate carrying 15 pct Ni and Co in complex sulphides and constituting about 4/10 of 1 pct of the talc rock was recovered. In the belief that the tailings also contained an appreciable content of chromite (then in demand, 1937) it was suggested to the management of the asbestos company that a truck load of the current tailings be sent to the flotation plant of the talc company where it would be put over the concentrating tables in an effort to discover the presence and roughly the percentages of chromite, nickel, and cobalt. Preparations for the test were woefully inadequate and the test was completely snarled up by the surprisingly large quantity of asbestos fiber from 1 in. long down to very short fiber, all of which matted up and plugged launders and pumps with disastrous effects and practically the total loss of the sample. If anything was indicaded by the test, it was that a wet process for milling asbestos was worthy of very serious consideration. M. J. MESSEL—A wet milling process for tailings retreatment only, is at present under study at our plant. One asbestos mining company in Canada has constructed a fairly large test plant for this purpose, but as yet no definite results have been obtained other than in a small test unit plant which were in some respects quite encouraging.

TO determine the optimum inside dimension of an airshaft, it is necessary to strike the proper balance between the cost of power for air friction and turbulence losses within the airshaft, on the one hand, and the cost of sinking the airshaft, on the other. An airshaft larger than necessary is extravagant because the increased amortization rate exceeds the reduction in power cost. Conversely, an airshaft smaller than is needed wastes more power than can be justified by the corresponding reduction in amortization rate. The airshaft power is a function of the air volume Q cu. ft. per min. and the air- pressure drop p in. water gauge across the airshaft The airshaft pressure drop is calculated by the formula: [ ] wherein R is the air-friction coefficient for the portion of the airshaft 1 ft. deep, 0 ft. in perimeter and A sq. ft. in area, when passing an air volume of Q cu. ft. per minute. THE present method for the ultrapurification of boron involves the formation, distillation, and decomposition of boron tribromide.' However, the boron tribromide prepared contains several impurities in the ppm range, even after distillation. Some of these impurities, notably carbon, can be reduced after decomposition by zone refining. In this study, a comparison of the purity of boron tribromide at various formation temperatures is presented. The apparatus employed consisted of a bromine flask connected to a 22 mm ID horizontal quartz reaction tube packed with amorphous boron powder, which was in turn connected to a receiving flask cooled with an ice bath. Argon was used as a carrier gas. The approximate rate of passage of bromine to the reaction tube was 25 g per hr. The reaction was first investigated at several temperatures in order to determine the lowest temperature necessary to produce a colorless product which was assumed to be an indication of complete reaction of the bromine. The lowest temperature found in this study was 420oC. The amount of impurities found in the boron tribromide at various formation temperatures is shown in Table I. The data presented are emission spectroscopic results of boric oxide produced by the hydrolysis of 2 to 3 g of boron tribromide in 10 ml of distilled water. After hydrolysis, the samples were dried several hours on a hot plate. Assuming equilibrium conditions in the reactor, one can make approximate thermodynamic calculations estimatling the completeness of reaction of bromine with boron and its impurities at various temperatures. Data for these calculations were taken from Rossini,3 and must be taken as approximations since the T?S factor was not included in the calculations. The results of such calculations indicate that, with the exception of carbon bromina-tion, all impurities would react almost to completeness (> 99 pet) at all temperatures between 400" and 900oC. In the case of carbon, which cannot be accurately analyzed spectroscopically, it is estimated that only about one sixth as much carbon tetrabromide would be formed at 400" than at 900°C. Drilling in Central Texas during 1933 was confined, for the most part, to the search for new serpentine plugs. Bastrop County led in this particular activity, with 50 completions during the 12 months' period, 12 of which were productive. Only one new field was opened in Central Texas during the year, it being known as "Hilbig" (Bastrop County) and was discovered by the Humble Oil & Refining Co. The finding of commercial production in the serpentine at 2500 ft. led to further search in this and surrounding counties, but without success. Bexar County actually provided the greatest amount of drilling but the activity was limited to shallow development from 400 to 2000 ft. The Edwards limestone pay, which has been such a factor in past years, received but slight attention during 1933. Unsuccessful exploration was carried on in Lee and Burleson counties. With the exception of Freestone County, the Woodbine sand area was given even less consideration. This county, because of its close proximity to Anderson and Leon counties, saw a very active leasing campaign and several important tests drilled. In Central Texas, 252 wells were completed in 1933, and of this number 52, or 21 per cent, were productive. Hilbig Field The discovery well, Humble Oil & Refining Company's Annie Hassler No. 1, was completed Feb. 16, 1933, for an initial production of 65 bbl. the first hour, through tubing and 1/2-in. choke. The production was found in serpentine at 2468 ft. and tested 37.2" A.P.I. gravity. Twelve producing wells were drilled during the year and served to indicate that not more than 300 acres would comprise the entire field. Daily production at the end of the year was 775 bbl., although the field potential was 18,240 bbl. daily through 1-in. choke. The field adapts itself to pressure maintenance, and this scientific handling is being undertaken by the Humble Oil & Refining Co. through one injection well. It is the only area in the district where work of this nature is under way. Proration of Oil The more stringent application of proration in 1933 did not affect materially the producing fields in Central Texas. This is accounted for

He who wishes to be acclaimed a good master therein must be a good universal master in several arts, for the different kinds of work that come to his hands to be done are infinite. Those who work in gold and silver must outdistance all other craftsmen in learning and achievement to the same degree that their materials outdistance other metals in nobility. Therefore, it is necessary first of all to be a good designer, because design is the key that opens the doors not only to the goldsmith's craft but to all others. Then it is necessary that he understand melting and that he know well how to work with a hammer and how to use flat gravers and burins in engraving, as well as files and chisels. He must also possess certain secrets that are needful to the art, which in truth are parts of alchemy, such as softening gold when it is brittle and raw, coloring it when it has little color, soldering, enameling, working in niello, blanching, gilding, and an infinite number of things which must all be known in detail. But above all he who wishes to do this art well must be very patient in working, must know how to mould and how to proceed with the melt and with the file, hammer, chisel, or other implements for bringing his gold or silver work to the final state which he plans. He must also have good judgment in gems and know well how to recognize every [134v] good or defective quality they possess, and to distinguish the false gem from the true, either when set or when unmounted, as there is need; also how to value them both in buying or selling and in satisfying others who seek his appraisal. One important means of reducing steel consumption in grinding mills is not mentioned in S.G. Malghan's paper. It is simply to reduce the oxygen content in the mill and pulp. While oxygen dissolved in pulp is not readily reduced without additives, reduced aeration and reduced ventilation of grinding mills are often feasible. It is not necessary to completely eliminate the oxygen to achieve substantial benefits, since corrosion rates vary with oxygen content in a manner analogous to combustion rates as oxygen content increases. It is difficult to generate indisputable quantitative data on the relationship of oxygen reduction in a milling system to changes in consumption of grinding steel. Perhaps this accounts for the absence of technical papers on the effects of reducing oxygen content in grinding mills by reducing aeration of pulp and ventilation of grinding mills. One qualitative observation is that mills operating at a lower percent of critical speed will tend to have lower media consumption for similar fineness of grind without necessarily having an equivalent reduction in power consumption per ton of product. Reduced mill speed would also tend to reduce both ventilation of the mill and entrainment of air in the pulp. Larger grinding mills tend to be more media efficient because they operate at a greater ratio of charge volume to pulp surface area, which will tend to reduce the aeration per unit of pulp volume. The mechanical steps required to reduce aeration of grinding mill pulps depend on the configuration of the grinding circuit and related process. Reply by S.G. Malghan Mr. Locher stated that my paper did not mention the reduction of oxygen content of the pulp as a potential method of decreasing the steel consumption. I would like to bring to the attention of Mr. Locher that an indirect reference was made to the fact that pulp oxidation potential controls the corrosion wear of steel. Though dissolved oxygen is one of the factors that controls oxidation potential, additional discussion was deliberately avoided for the reasons mentioned by Mr. Locher. The most important reason being the difficulty of decreasing and controlling the oxygen concentration of the pulp in a commercial mill.

The various methods of by-product coke-manufacture have been quite thoroughly discussed in a number of papers recently published, and I think it would possibly be of interest and value to discuss the growth and probable future of the byproduct coke industry, rather than details of manufacture. The first by-product coke-plant in the United States, consisting of 12 ovens, was put in operation at Syracuse in January, 1893. This installation was followed by one at Johnstown, Pa., in 1895; one at Dunbar, in 1896, and one at Glassport, in 1897. The plant at Syracuse was primarily intended to supply the owners with ammonia for their alkali-works. At Glassport, for the first time, gas was sold for illuminating purposes, although it was mixed with water-gas to make it marketable. The New England Coke & Gas Co. started the plant in Boston in 1899, which was destined to change the whole trend of the establishment of by-product plants, since it manufactured for the first time illuminating-gas suitable for sale without enrichment. This was accomplished by dividing the gas on the battery into two portions. One portion, consisting of the richer part of the gas, was saved for sale, while the remaining, or leaner, portion was used in the battery. This idea was originated by Dr. Schniewind, of the United Coke & Gas Co. The coke was used for domestic, industrial, and locomotive fuel, as its sulphur-content was too high to make it suitable for use in the foundry. The successful operation of this plant led to the building of additional plants at points where the production of illuminating-gas could be sold to advantage and where there was a fair market for the coke-output. The following list of illuminating-gas plants in order of construction will give a good idea of the rapid growth of this method of combined gas- and coke-manufacture: Hamilton, Ohio; Detroit, Mich.; Camden, N. J.; Baltimore, Md.; Chester, Pa.; Milwaukee, Wis.; Duluth, Minn.; Geneva, N. Y.; Chicago, Ill.; Indianapolis, Ind. In addition to these there are now under construction plants at Muncie, Ind.; Joliet, Ill., and Waukegan, Ill., all of which will produce illuminating-gas and metallurgical coke.

In recent months, public hearings held by the Senate Subcommittee on Minerals, Materials and Fuels on the Stillwater copper-nickel complex in Montana have been reviewed at great length in the press. Although the meetings were well managed by the Subcommittee and questioning was kept in line with the aim of the hearings-namely, how can re- sources be developed in a manner compatible with the preservation of the environment-it was alarming to read the apparently uninformed and questionable arguments presented by some witnesses who were attempting to prohibit mining in the area altogether. One spokesman even went so far as to urge that mining of the area be rejected be- cause, even if the mining operation did not pollute the areas, the effluent and waste produced by the people themselves could constitute a hazard to the environment and to themselves. This, of course, would be true to a point. However, if this or similar types of reasoning were used to reject mining of a large number of orebodies in the future, how is the United States going to meet its future mineral demands and what effect could this have on the economic strength of the country? Fall of the Roman Empire An interesting article in a recent issue of Time magazine came up with a new theory to explain the fall of the Roman Empire. Claire Patterson of CalTec, during a recent study of air pollution, investigated the historical worldwide distribution of lead. As lead was a by-product obtained from silver mining during historical times, he turned his attention to studying the production of silver during those eras. He discovered a very interesting fact-that, I unless the stock of metal is continually being replenished from the mines, accidental loss diminishes a country's stockpile of silver at a rapid rate, as much as 2 per cent per year. Patterson, a geochemist, theorized that with an accidental loss rate of 2 per cent per year, if the country's silver supply dried up, the entire existing stockpile could disappear in about a century.

Some two years ago the Petroleum Division of the A. I. M. E. organized a special study of unit operation. That method of handling oil pools had been urged as the remedy that would save the United States petroleum industry from the crisis that even then loomed as more than a small cloud on the horizon. Today it is only one of several remedies vigorously advocated. Proration, regulation of imports, unit operation, constructive marketing and interstate compacts all have their earnest proponents, but the advocates of each have been disposed to look with indifference on the other respective proposals, with the result that none has had united support. Meanwhile the industry has drifted rapidly toward a serious crisis, the imminence of which in itself may bring the solution. The gravity of the situation tends to force study of the merits of proposals that a short time previously were brushed aside as impractical; and to the surprise of most of us we now find merit where previously we thought none existed. Irrespective of what might have been the result had any single proposal being adopted years ago, it is now apparent that under present conditions no one of the remedies—unit operation, proration, regulation of imports or constructive marketing—standing alone would be of much benefit. On the other hand, it is becoming evident that a well balanced program comprising all four of these remedies might save the United States petroleum industry; also that some such comprehensive program might be necessary to save it. It is even becoming evident that the despised interstate compact might be an appropriate type of machinery in which to group and coordinate all these remedies. We have progressed beyond the belief that either the industry or the government working alone can correct the situation, and have arrived at the more healthy realization that the task will require most sympathetic cooperation between government and industry, backed by an equally sympathetic public understanding. If we were functioning under a Mussolini or a Stalin, stabilizing the petroleum industry would be a much simpler task. However, in the

THE second operation in the art of casting, and one of the greatest importance, is that of melting and thoroughly liquefying the materials of which you wish to make your casting. On this operation depends the whole outcome of your intentions and the perfection of your work. Without it, even though you had a great abundance of moulds and vast quantities of bronze, your desires, labor, and expense would all be in vain. In this operation I find on consideration that, in addition to experience, there are three necessities-perhaps indeed four-that must be provided without fail. The first is the furnace or other agent which contains the fire and the metal brought together. The second is the wood or charcoal which is the necessary and proper nutriment of the fire, from whose virtues are derived the greater or lesser forces which, according to their kind, are ready to effect what is required. The third is to have the materials disposed to easy fusion by means of corruption, alloying, or by their own nature. The fourth, as the motivating cause of the whole, could perhaps be listed as the first-this is the ingenuity and good judgment of the worker, together with the bodily exertions not only of himself but also of his helpers in addition. For, besides a certain ordinary caution, it is necessary to pay particular attention, first, to see that the furnaces, machines, ladles, hearths, refineries, and other kinds of instruments or similar vessels be made so as to dispose the metals for melting, and, when melted, that they easily maintain them so. These should also be prepared in such a way that they cannot be injured by the fire, for if they should be damaged the operation would fail. In order to do this, it is first necessary that you arrange the instruments with forethought and action so that the power of the fire can operate. Fire operates on things only when brought together with them in long-continued operation, or when driven by a great force of wind. It burns many things and softens others, but it makes the metals as liquid as water.

MINING taxation is a subject which bears definitely upon-the welfare of the mining indus-try. Every government must have a revenue but that revenue should be raised in such a way as to hamper as little as possible legitimate enterprise or industry. A mining tax should be fair, and one which appeals to the natural sense of justice. Our present system is a tax on net- profits after all expenses are met. On profits in excess of $10,000 the Mining Tax Act takes three per cent., one-half of which goes to the Govern-ment and one-half to the municipality in which the mines are situated, to meet local needs for roads, schools, etc. On profits from one to five million dollars", the tax is five per cent.; over five million, six per cent., and so on. The first $10,000 profit is exempt. The result is that if a mine is worked at a loss, it pays no tax at all; if it makes a small profit, it pays a small tax; if profits are large, the tax increases accordingly. It is difficult to imagine a fairer or less onerous method of taxation, or one better adapted to meet fluctuating conditions from year to year as profits rise or fall. A just and fair tax should be levied on profits, never on capital. There is, one branch of the mining industry upon which is levied a higher tax than upon other branches, namely, the nickel industry. I see no good reason why any branch of the mining industry should be discrim-inated against on a profits tax basis. A mining tax should not discourage development. The present tax meets this requirement. In the early years of a mine, when it is all outgo and no income, the mine pays no tax. Not until it reaches a productive and. profitable stage does the tax take effect, and then the mine can afford to pay it. Further, a tax on profits does not operate against the opening up of low-grade deposits, or those in which the chance of success is to a certain extent speculative.
