Public Law 103-426 was signed into law in October 1994. Its provisions amended sections 8(k) and 20(a) of the Outer Continental Shelf Lands Act (OCSLA). The 8(k) amendment provides the Secretary of the U.S. Department of the Interior 001) with new discretionary authority to negotiate agreements for using Outer Continental Shelf (OCS) sand, gravel, and shell resources for certain projects of public benefit (e.g, beach, shoreline and coastal wetlands restoration that are under- taken by a Federal, State or local government agency). The new law also covers construction projects that are funded wholly or in part or authorized by the Federal Government. Under the law, the Secretary may assess a fee for use of the resource by taking into consideration the value of the resource and the public interest served. The law also requires that any Federal agency proposing to make use of OCS sand, gravel, or shell resources enter into a Memorandum of Agreement (MOA) with the DOI. An MOA would promote efficient coordination and resolution of inter- agency scheduling and issues. The law requires that Congress be notified before use is made of these OCS resources. The amendment to section 20(a) of the OCSLA clarifies that obligations concerning environmental studies extend to non- competitive lease situations and includes minerals other than oil and gas. The Minerals Management Service (MMS) is the DO1 agency responsible for interpreting and implementing the provisions of Public Law 103-426. The negotiated agreement approach is distinctly different from the competitive bidding requirements that have applied to all OCS minerals since the inception of the OCSLA. The MMS has opted to implement the new law in a nontraditional manner. Rather than issuinga body of new regulations to cover the negotiated agreement situation, or attempting to amend three sets of existing regulations, MMS is pursuing a less formal approach of providing guidelines. More weight is placed on the negotiation process itself and the legal agreement that consummates the process as the means for establishing ground rules, terms, and conditions under which qualifying projects may be conducted. This process must recognize and adhere to requirements of other laws, including the National Environmental Policy Act.

Investigations of the Gorda Ridge within the proclaimed U.S. Exclusive Economic Zone off northern California and southern Oregon, and the Mid-Atlantic Ridge extending along the center of the Atlantic Ocean, have received new impetus from the discovery of hot black smokers, sizeable polymetallic massive sulfide deposits, and vent animals at the Mid-Atlantic Ridge by the NOAA VENTS Program in 1985. Prior to that time, the oceanographic community focused investigations of seafloor venting at the faster-spreading oceanic ridges of the Pacific Ocean including the East Pacific Rise, the Galapagos spreading center and the Juan de Fuca Ridge because a consensus held that the faster spreading rates at these ridges were necessary to supply the heat to drive black smoker-type venting. As the only oceanic ridge in the Pacific with slow-spreading characteristics, the Gorda Ridge is an outlier of the slow-spreading ridge system that extends through the Atlantic Ocean and western Indian Ocean comprising more than half the 55,000-kilometer-length of the globe-encircling oceanic ridge system. It has been long known that manganese nodules occur more or less in some part of marginal seas in West Pacific Ocean. On the other hand, it is difficult to understand their distribution and the genesis as those nodule samples were collected mostly by dredge from the deep basins generally has much higher sedimentation rate than the open ocean. For example, the sedimentation rate in the South China Sea is about three orders of magnitudes than that in region of the Clarion-Clipperton Fracture Zone. In June of 2013, a small seamount (named as Jiaolong Seamount), consisting of southern part and northern part with a distance of about 3 km each other, was visited by DSV Jiaolong/RV XiangYangHong 9. It is discovered that abundant manganese nodules exist only on the surface sediment in the southern part with a water depth of about 3800 m to 3300m, on the platforms nearby an obvious crater where volcanic rocks exposed on the wall. There are no any nodules be observed on the sediment in the northern part of the seamount (about 100 m deeper than the southern part) and surrounding deep basin (approximately 4000 m in water depth). It is speculated that a source of core for manganese nodule and a dynamic sedimentation environment, are two major governors for the growth and distribution of manganese nodule in the marginal seas.

Activities of Brazil in relation to deep seabed mineral resources development are carried out in the framework of two main national programmes. They are: (1) the Program for the Assessment of Mineral Resources of the Brazilian Continental Shelf (REMPLAC) and (2) the Programme for Prospecting and Exploration of Mineral Resources of the Area in the South Equatorial and Atlantic Ocean (PROAREA). REMPLAC aim to research and increase knowledge of the seabed and sub-soil, as well as to collect the necessary information to allow integrated management of the Brazilian Continental Shelf. Among the various research projects undertaken or planned on the framework of REMPLAC are: geology of the Brazilian continental shelf and adjacent ocean areas, organized in geological information system; digital bathymetric charts of the inner continental shelf at 1:100,000 scale; systematic research for sands, gravels, carbonates; placers, phosphorites, coal, cobalt-rich crusts, polymetallic sulphides and Gas hydrates. The PROAREA was prepared with three initial projects starting in 2010. One of them, the Project Geology of the South Atlantic and Equatorial organized in a Geographic Information System, aims to collect, collate, integrate and make available in a single environment all geo-referenced data and information available in Brazil and abroad on geology and mineral resources of the South Atlantic Ocean. The other two projects are for the research of cobalt-rich crust and polimetallic sulphides. These programme are developed with the participation of various segments of government agencies, research institutions and public enterprises. Marine scientific research and other activities from REMPLAC and PROAREA are carried out in partnership between the Geological Survey of Brazil, national research institutions from several Brazilian universities and the Directorate of Hydrography and Navigation from the Brazilian Navy.

Texture and geochemical composition of hydrogenous ferromanganese crust from relatively adjacent three seamounts (OSM2 at 157°35'E, 13°55'N, Lomilik at 161°37'E, 11°42'N and Lemkein at 165°05'E, 9°18'N) near the Marshall Islands in the western Pacific (Figure 1) were investigated in order to elucidate their growth history. These seamounts, located in different latitudes, are along a line that is parallel with the direction of Pacific plate movement. Thick crusts commonly have three or four distinct layers (Figure 2): (1) layer 1, uppermost layer, is black, dense, and has a botryoidal, columnar, or laminated texture; (2) layer 2, overlain by layer 1, is Fe-stained, porous to vuggy and filled with sediment; (3) layer 3, phosphatized layer, is black, massive, dense, and impregnated by CFA, (4) layer 4 shows parallel to undulatory laminated texture and cut by CFA-filled veins. Layer 1 and 2, unphosphatized young layer, are observed in crust samples collected from all seamounts. However, lower part of the crust shows different textures in different seamounts. Both layer 3 and 4 are found in thick crust from OSM2 but layer 4 is absent in crust samples from Lemkein and Lomilik. All the uppermost layers (layer 1) from three seamounts have similar textural and geochemical characteristics. Layer 2 is overlain by layer 1, is porous, partly Fe-stained, and sediment-infilled. In previous studies, layers 1 and 2 have grown in different oceanic environment. Textural and geochemical properties show that layer 1 has grown under relatively higher bottom water activity and lower productive environment than layer 2. Carbonate and detrital materials in layer 1 are not abundant compared to layer 2. Layer 2 can be assumed to have grown under equatorial high productivity zone (EHPZ) while layer 1 has started to grow when the seamount left from the EHPZ.

The primary objective of this study was to establish the fate and distribution of material rejected during marine aggregate dredging, and the extent to which this is associated with spatial changes in biological community composition. Two actively dredged sites in the southern North Sea (Licence Areas 430 and 106) were selected in order to provide a comparison of impacts between sites subjected to different levels of dredging intensity and of contrasting environmental conditions. Dispersal of material rejected during the dredging process was monitored by means of acoustic doppler current profiling techniques (ADCP). Composition of the substratum and benthic invertebrate assemblages were investigated by the analysis of seabed grab samples. It was found that dredging in both areas had an impact on seabed bathymetry in the form of dredge furrows and also led to a reduction of the coarse gravel-sized components of the worked area. Sand sized particles were shown to increase in the surface deposits of both dredged areas. This is likely to reflect both the removal of coarse particles as cargo and the settlement of finer particles rejected during overboard screening. Dispersion and settlement profiles of material rejected by dredging vessels suggested that the majority of the suspended sediment load resulting from overboard screening settles to the seabed within 500 m. Some evidence of suspended sediment loads above background levels were noted at distances of up to 2 km from the working vessel. Analysis of the particle size composition of the deposits, along the axis of transport of material from the dredged sites, suggested that the impact on the sediment composition outside the boundaries of the dredged sites is dependent on the strength and direction of net sediment flux at the seabed. Benthic invertebrate communities within the dredged zones of both areas were found to differ significantly from communities in nearby undredged deposits. A major suppression of species richness and abundance was noted in the dredged sectors of both sites when compared to control locations. A ?footprint? of potential impact on the benthic fauna was noted in samples taken along the axis of sediment transport at distances of up to 1750m outside the boundaries of Area 430. In contrast, impacts on benthic community structure at Area 106 appeared to be confined to the immediate vicinity of the dredged zone itself. This apparent difference in impacts, beyond the boundaries of the dredged sectors between the two study sites, was thought to be a reflection of the smaller quantities of material rejected at Area 106 and the weak seabed sediment flux which is characteristic of this area. These findings, along with those of numerous dredging impacts studies, were then used to make generalised predictions of macrobenthic community recovery following marine aggregate extraction in a variety of seabed habitats.

The United Nations Law of the Sea (LOS) Convention includes provisions (Article 76) for establishing the outer limits of a coastal State's continental shelf and for denoting the seaward extent of sovereign rights over natural resources. Determination of a coastal State's continental margin, according to Article 76, must consider eight factors: 1. The territorial sea baseline 2. The 2,500-meter isobath 3. The foot of the continental slope 4. A line 200 nautical miles seaward of the territorial sea baseline 5. A line seaward of the foot of the continental slope connecting the points where sediment thickness divided by distance to the foot of the slope equals .01 6. A line 60 nautical miles seaward of the foot of the continental slope 7. A line 100 nautical miles seaward of the 2,500-meter isobath 8. A line 350 nautical miles seaward of the territorial sea baseline Figure 1 shows the preliminary limits for each of the Article 76-based definitions for a portion of the U.S. Atlantic continental shelf. The additional areas gained beyond the 200- nautical mile Exclusive Economic Zone (EEZ) are highlighted. The first three factors are baselines from which the distance provisions of Article 76 are measured. Factors 4-8 are distance- from-baseline provisions for establishing the continental shelf limits. Factor 5, also known as the Depth of Sediment Limit or "Irish Formula", was calculated using sediment thickness data from seismic linesand isopach maps. All other factors were determined from digital hydrographic data. The Depth of Sediment Limit is the most advantageous method for the area shown in Figure 1. It is especially useful for introverted coastlines such as the Georgia Embayment and New York Bight areas. The resources and reserves calculation of marine diamond deposits should be based on a systematic sampling grid. The distribution of the sample grade results tends to be very skew and has a large variance. A bias is easily introduced due to the fact that the grade distribution of the samples is very different from the grades of the area of influence. The temptation is always there to extrapolate the highest grade samples simply to their area of influence. If this is done, the higher grade areas will be systematically overestimated, while the lower grade areas will be underestimated. Such a bias should surely be avoided by weighing the sample grades in such a way with their neighbours, so that the estimated grades have a similar distribution as the grades of the blocks. The grade distribution of small mining blocks tend to be lognormal-like. If the coefficient of variation is known, i.e. the standard deviation divided by the mean, then the grade distribution of the small mining blocks is relatively well-defined. The distribution of the diamonds within the deposits can be simulated, based on the histogram of the sample results and on the semivariogram. The diamonds tend to cluster in trapsites. From the semivariogram and the histogram, the average size and spacing between trapsites, and the grade distribution within the trapsites, can be calculated using the model of the General Family of Discrete Distributions. Using such a simulated deposit, the grade distribution for different block sizes can be obtained. The grade distributions become more lognormal-like with increasing block sizes, as the trapsite effect is reduced.

Deep sea tailings placement (DSTP) techniques have been pioneered in Papua New Guinea (PNG): a mining reliant economy in a seismically active region, facing major environmental challenges in the safe handling and storage of mine tailings on land. Scientists at SAMS have researched impacts of DSTP on the marine environment specifically to inform and develop guidelines for the use of DSTP to reduce environmental impact, thereby lowering risk and increasing private sector investment. Guidelines have been established as regulation by the PNG Government providing reassurance to private investors, facilitating an increase in mining exports to 60% of total export. Researchers investigated the effects of DSTP at 2 PNG mines: Lihir Gold Mine which has been actively discharging tailings since 1996 and Misima Mine, closed in 2004 after discharging tailings for 15 years, allowing an assessment of the recovery of the marine environment after tailings placement. Research involved investigating ocean currents and mixing, the behaviour of metals and the effect of tailings on benthic communities including the risk of elevated metal contents entering the food chain. The research established a metal ?fingerprint? of tailings compared to natural sediments, which enabled the transport of fine tailings within the deep ocean to be ascertained.

The purpose of this presentation is to review the history of offshore non- fisheries resource development since World War II, as an introduction to a planned symposium on offshore resources scheduled for the 1996 UMI Conference. After World War II the United States became the leader in offshore oil and gas production, deep ocean drilling technologies, offshore terminals, platforms and production systems, and natural gas recovery and transport. Wartime skills in acoustic profiling and antisubmarine warfare were transferred into commercially important geophysical exploration techniques. The application of ocean drilling and geophysical techniques permitted the recognition and elucidation of plate tectonics patterns, development of seafloor spreading theory, and the transformation of our knowledge of seabed and subseabed strata. After John Mero's studies and recommendations for developing marine manganese nodules in the late 1950's interest in nonfuel minerals grew rapidly. The formation of international deep sea mining consortia in the 1960's was accompanied by a flurry of ocean engineering development, minerals prospecting and associated environmental studies The Santa Barbara Oil Spill of 1969 resulted in a moratorium on both offshore energy and minerals leasing by the Depart- ment Interior, and catalyzed the development of new Federal legislation in 1972. In 1973 the offshore energy moratorium was lifted in response to the Arab oil embargo, and offshore energy activities surged for a time. Germany?s industry heavily depends on the continuous import of mineral commodities such as manganese, copper, nickel, and molybdenum. Due to the strong increase in metal prices since 2002 Germany?s federal geological survey, the Bundesanstalt für Geowissenschaften und Rohstoffe (Federal Institute for Geosciences and Natural Resources, hereafter called BGR) applied for a license area for the exploration of deep-sea manganese nodules in the Pacific manganese nodule belt between the Clarion and Clipperton fracture zones. A 75,000 km2 covering license area was eventually granted to the BGR by the International Seabed Authority (ISA) in 2006. It is separated into two parts: ?W1? (17,000 km2) and ?E1? (58,000 km2; Fig. 1). The BGR obtained initial information on the abundance and grade of nodules in the license area from samples collected during three cruises with R/V Valdivia and one cruise with R/V Sonne between 1976 and 1978 (Rühlemann et al., 2009). Since the accuracy of navigational data obtained during these cruises is outdated and sample coverage is unevenly distributed and sparse in many parts of the license area, BGR has started a new exploration program to investigate the German license area according to the rules, regulations and procedures issued by the ISA for the exploration of Mn nodules in the Area.

Manganese nodules on deep ocean floors have continuously received attention as potential sources for strategic metals such as Co, Ni, Cu, and Mn, due to their vast distribution and relatively higher metal concentrations (Mero, 1965; Cronan, 1980). Several registered Pioneer Investors have already identified promising sites in deep-sea regions for manganese nodule mining (ISA, 1998), and appropriate mining technologies have been developed during the last thirty years by the international consortium and several nations (Welling, 1981; Kaufman et al., 1985; Bath, 1989; Charles et al., 1990; Yang and Wang, 1997; Yamada and Yamazaki, 1998; Hong and Kim, 1999; Muthunayagam and Das, 1999). The mining feasibility for manganese nodules, including an economic evaluation, has been examined in detail by some researchers (Andrews et al., 1983; Hillman and Gosling, 1985; Charles et al., 1990; Soreide et al., 2001).

The Atlantic Continental Shelf (ACS) of the United States includes about 391,000 km2 extending from the shoreline to the 200-m isobath. It varies in width from a fraction of a kilometer (offshore of southern Florida) to about 150 km (offshore of Cape Cod, MA). The contained volume, of sand and gravel is estimated to be on the order of 3-7 x 1.011 m3. Concentrations of potentially commercially important heavy minerals (HM) exist locally, particularly in high-energy depositional environments (for example in channels, tidal deltas, ridge and swale areas, and submerged former shoreline complexes). Recently completed and ongoing studies of HM assemblages in vibracore samples from the south shore of Long Island Sound, NY, offshore of Ocean City, NJ, offshore of Cape May, NJ, offshore of the mouth of Chesapeake Bay, VA, offshore of Myrtle Beach, SC (grab samples), and the ACS offshore of Florida provide the information base for this presentation (Table 1). Studies of benthic recolonization in the aftermath of marine aggregate dredging in the U.K. and elsewhere are limited and are largely confined to experimental circumstances. Investigations of the physical and biological status of licensed extraction sites in the U.K. at various times following cessation of commercial dredging are very limited, and so judgments as to the likely progress towards environmental restoration and the time-scales involved continue to be based on predictions rather than real data. This field-based research programme was commissioned to enhance the understanding of processes leading to physical and biological recovery of the seabed following dredging, thereby aiding the identification of practices to minimize environmental harm at licensed sites, and to promote rehabilitation on cessation. The outcome of survey work will have the notable benefit of allowing questions about the present status of locations hitherto subject to commercial exploitation to be answered directly, rather than by inference.

A unique concept for a self-cleaning filter system has been designed and constructed which utilizes acoustic energy, coupled hydraulically with a subject liquid media, and a fine mesh screen to perform the following: 1. separation of solid suspended particles from a host liquid through the breakdown of surface tension; 2. enhanced filtration of liquid fraction from the solids fraction to specified limits, retaining a specified size range of solids, and; 3. continuous cleaning of screen, preventing screen blinding and promoting a continuous filtration process. The concept is the product of a cooperative program between the Marine Minerals Technology Center, Continental Shelf Division, and the Moscow State Mining University. The physical principals involved in the separation, filtration, and screen cleaning processes primarily relate to the characteristics and properties of the applied acoustic energy and the influence of this energy on the solids/liquid mixture. The acoustic energy introduced to, and acting on and throughout, the whole volume of the solids/liquid mixture, within the vessel body at any given time induces hydraulic pressure waves, which may be further described in simplest form as positive and negative semiperiods (which may or may not be equal in amplitude or period) of the basic wave forms. The processes involved may be considered in two phases. The first phase relates to the process of separation in which the acoustically induced force of acceleration manifests as vibro-agitation (thresh- old of cavitation) and possibly cavitation is the primary factor in the breakdown of surface tension between the solid particles and suspending liquid; i.e. water. In the case of compressible organic solids, the separation of liquid by squeezing may also be a factor.

A chemical and geological study of beach samples from the Mexican North Pacific was undertaken in order to evaluate the chemical composition of the beach sediments and it s association to lithology, climate, topography and weathering. The North Pacific Mexican littoral is characterized by arid weather with wide coastal plains and three geological provinces. The sands from the area are mainly finer, well sorted and show high maturity because of the high wave regime and the high energy conditions produced by the California Current in the coastline. The provenance index reflects that the region has a source of deep seated rocks, now exposed and dissected. Factor analysis made using the chemical composition showed the samples can be differentiated by five factors: 1) SiO2, 2) Al2O3; 3) Cu; 4) Sr and P2O2 and 5) Na content. Samples located in the northof the study area showed the highest values of Fe2O3 (17.72%), TiO2 (2.43%), V (576 ppm) and Zn (141 ppm) associated to methamorphic rocks present in the area.

Mode of occurrence and compositional variations of iron-manganese deposits from seamounts around the NW Pacific submarine island-arc area are described on the basis of on-site description during the Moana Wave Cruise MW9507 and other Japanese cruises, as well as geochemical and mineralogical analyses and dating on collected samples. Hydrogenetic and hydrothermal iron-manganese crusts occur at more than 80 sites out of 150 dredge hauls within a small area of 200x 200 km in the back arc region. The hydrogenetic crusts may have grown continuously at slow rates, but 2-3 times faster than those from the Central Pacific, associated with depletion of Co, Cu, and Ni contents. The site-maximum thickness of the hydrogenetic deposits trends to increase with the increase of distance from the active volcanic chain or the age of substrate volcanic rocks. Also the observed great local variations in thickness within single sites and on small scales may be resulted from post-depositional geological activity at the seamounts such as calcareous sedimentation, collapse of volcanic body and mass wasting,. On the other hand, the rapid hydrothermal manganese mineralization has occurred in place and time during arc volcanism and rifting and is still in progress at modern active areas. The ninety ICP/ES chemical plus XRD analysis show that these deposits are of distinct composition by origin or topographic provinces, but small-scale variation of the deposits of each origin and micro-scale depth variation are not clear.

Analysis of the relationship between environmental parameters and the content of Mn, Ni, Co, Cu, Fe and Zn in ferromanganese crusts permits improved identification of locations to prospect for crusts with commercially valuable concentrations of these metals. In this study we asked whether a statistically significant relationship exists between primary productivity of the overlying surface waters, the concentration of O2 in and depth of the O2 minimum layer on the metal content of non-hydrothermal ferromanganese crusts in the Pacific Ocean between 130o W and 175o E and 0o to 30o S (the study area). To further develop the interpretation of the results of the statistical analysis and to assess in detail the geographical expression of these parameters in terms of metal content in crusts, a geostatistical technique (kriging) was used to generate contoured values for metal content, primary productivity and O2 concentration in and depth of the O2 minimum layer in the study area.

Marine mining on the continental shelf was first attempted in 1900 for gold off the beaches of Nome, Alaska. Attempts continued until 1990 with cutter-suction, airlift and bucket-ladder dredges. Offshore Thailand profitable production of tin resulted from clamshell, bucket-ladder and trailing suction hopper dredges. Today in Indonesia numerous bucket-ladder dredges continue to mine tin. Off the coast of Namibia and South Africa nearly a dozen large and medium sized vessels are engaged in diamond production. The obvious risk results from the working environment. Vessels and lives have been lost in the past. At best the availability of mining equipment is reduced. Leaving aside the marketing and financing aspects, otherwise the most important risks are technical. They manifest themselves as diamond production short-falls with obvious financial consequences. Bias and deficiencies in sampling equipment and procedures may result in misleading grade estimates, even serious under-estimation. Inadequate sampling in terms of sample support and density may result in over-optimistic grade determinations, especially if under-sized mining blocks are outlined. Quantitative measurement of the geotechnical characteristics of the sediments to be mined is an essential stage in a feasibility study. Without a full understanding of the bedrock profile and the overlying sediments the ease, completeness and speed of excavation during the mining process cannot be properly estimated. Both historically and at present the greatest negative discrepancies from production estimates result, not from grade shortfalls, but from significantly lower mining rates than thought possible by the operators. The learning curve in marine, production mining is steeper and longer than is generally recognised by newcomers to the industry. Examples are provided from tin, gold and diamond mining experiences.
