AN intelligent discussion of the oil situation and its needs, whether from the standpoint of the prospector, the operator, the engineer, or the public administrative officer, must be founded upon a knowledge of the law under which oil lands are obtained. A consideration of new legislation must be prefaced by an understanding of the present law and its results. This paper undertakes to present no new remedy for the ills of the present situation, no new solution of the problems the oil business is facing. It attempts merely to summarize the present law, its provisions, its origin, its development, and its effects. The discussion does not pretend to be exhaustive from a legal standpoint. It aims to avoid legal intricacies Which tend to confuse rather than clarify. It seeks but to present the essentials of the existing situation. The title to government lands known to contain valuable deposits of petroleum may be acquired only under the terms of the placer law as embodied in Section 2329 et seq. of the Revised Statutes. As a preliminary to considering the desirability of this situation it is profitable to examine into its origin. ORIGIN OF THE LAW Congress has left no room for doubt as to the legal applicability of the placer law to oil lands. The Act of Feb. 11, 1897 (29 Stat., 526), provides: "that any person authorized to enter lands under the mining laws of the United States may enter and obtain patent to land containing petroleum or other mineral oils, and chiefly valuable therefor, under the provisions of the laws relating to placer mineral claims."

Insoluble residues from three sequences of Paleozoic marine evaporates (Retsof salt bed in western New York, Salado Formation in southeastern New Mexico, and Paradox Member of the Hermosa Formation in southeastern Utah) are rich in trioctahedral clays. Chlorite (clinochlore), corrensite (mixed-layer chlorite-trioctahedral smectite), talc, and illite (the only dioctahedral clay) are the dominant clay minerals; serpentine, discrete trioctahedral smectite (saponite), and interstratified talc-trioctahedral smectite are sporadically abundant. These clay-mineral assemblages differ chemically and mineralogically from those observed in most continental and normal marine rocks, which commonly contain kaolinite, dioctahedral smectite (beidellite-montmorillonite), illite, mixed-layer illite-dioctahedral smectite, and, in most cases, no more than minor quantities of trioctahedral clay minerals. The distinctive clay mineralogy in these evaporate sequences suggests a largely authigenic origin. These clay minerals are thought to have formed during deposition and early diagenesis through interaction between argillaceous detritus and Mg-rich marine evaporate brines.

This chapter reviews the steps which should be taken from the time it is decided to consider autogenous grinding in the development of a new ore deposit or the expansion of an existing plant up until the purchase of the new autogenous mills. In this case the term autogenous includes semi -autogenous, secondary pebble mills, and lump milling as well as fully autogenous grinding systems. Also, both wet and dry grinding alternatives have been included. Before the test program it must be decided how many bulk samples are required to properly assess the autogenous grinding possibilities of the deposit. Also, a decision must be made on where and how the samples are to be ground i.e. pilot mill at site or in established location, wet and or dry grinding, etc. In the test program itself, certain fundamental data must be obtained. The testing should include enough work to determine whether fully autogenous or semi-autogenous grinding should be used and what type produces best power efficiency. Also, all the other pertinent data should be collected such as power; tonnages; feed, charge, and product sizing; circulating loads, etc. If a secondary mill is required to produce a final grind the decision on whether a pebble or ball mill should be used may require additional test work. Finally, the concentration of the mineral may play an important part in selection of the circuit and should become a part of the final testing once the grinding has been established.

The year 1942 in Michigan was devoted largely to the development of fields discovered in 1941 but was also characterized by a great increase in prospecting for new productive horizons below the Dundee limestone. Some new fields were discovered but as yet these have shown few signs of being of major importance. Michigan's total production for 1942, of 21,754,000 bbl. of oil, as reported by the U. S. Bureau of Mines, was second only to the record year of 1939 when 22,799,000 bbl. of oil were produced. All important fields were prorated throughout the year, and it is obvious that without proration a new all-time high would have been established for the state this year. Development in Fields Reed City Field.—During 1942 the Reed City field, which ended 1941 with 112 producing oil wells, added 70 new producers to bring the total at the end of the year to 182 wells and 4700 proven acres. A south extension of the field developed during the year was in large part responsible for the increase. Approximately 9,000,000 bbl. of oil was produced from the field during the year, bringing the total accumulated production to the end of the year to roughly 11,750,000 barrels. Headquarters Field.—The Headquarters field, which started the year with ro producing oil wells, ended the year with 41 wells aid 1240 proven acres. Approximately 2,300,000 bbl. of oil was produced in 1942. Kawkawlin Field.—Although not a 1941 discovery, the Kawkawlin field has been actively developed on the 40-acre spacing plan during the last year, 42 producers having been completed, bringing the total number of wells at the end of the year to 77. Nearly 500,000 bbl. of oil was produced during the year.

Arthur H. Elliott, New York, N. Y.: We have all been very much interested in the results of Dr. Bone's work, which Mr. Ellis has presented to us this evening. The high temperatures attained by this method perhaps afford us an explanation of the temperatures reached in the puddling-furnace with its crude and almost primitive methods of burning fuel, by means of which we have, nevertheless, been able to melt iron in a comparatively short time, and keep it in a molten condition down to a high degree of purity. No doubt many of us have wondered, as I have done, how such a result could be obtained in such a way; and it occurs to me that, perhaps, Dr. Bone has supplied the explanation in disclosing the effect on combustion of burning gas and air after passing through, and in contact with, a porous refractory body. May not the fettling of the puddling-furnace have, in some degree, an effect upon the combustion like the influence of the porous diaphragm employed by Dr. Bone ?

The increasing number of problems of the modem mine manager has led the author to discuss the art of management. He lists the principles concerning selection of personnel, exploitation and development, new equipment, process improvements, new processes, maintenance, operating cost data and public relations. Application of the principles to problems of mine startup, operation and rehabilitation are described. Since D. C. Jackling was famous for his adeptness at organizing and training teams of operating personnel, the subject of mine management is particularly appropriate for a Jackling Lecture. In fact, it is doubly appropriate because in very basic ways Jackling's career changed the nature of the tasks and challenges facing a mine manager. Management of mines, of course, is the art of finding and winning minerals economically from the earth's crust, and it involves the use of all the engineering sciences. But also of prime importance is a skill which is not yet a science - the area of management often referred to as human engineering. Since expenditures on staff and labor may well involve more than 50% of the direct costs of operating a mine, ability at human engineering is just as important as the ability to plan and put into effect the most efficient operating procedures. In addition to his ability to select and train operating personnel, Jackling possessed, to a degree unmatched by many of his contemporaries, broad, analytical powers covering both the economics and operating phases of large scale mineral extraction. His breadth of vision found its greatest expression at the time he analyzed the Utah copper deposit. Fortunately, Messrs. Penrose and Gemmell had enough faith in his analyses to furnish the capital needed to begin operations. The result, as is well known to all of you, was Kennecott's lucrative Utah copper mine — and the beginning of the open pit porphyry copper era. The Utah copper mine, and Jackling's subsequent similar successes in Arizona, New Mexico and Nevada, had one thing in common —all of these large porphyry deposits were worthless until open pit, large daily tonnage schemes were developed for their exploitation. The successful development of such schemes made vast new mineral resources available for economic exploitation. But at the same time, the trend away from smaller high grade operations in favor of the far more complicated operations required to handle large deposits of low grade ore have greatly altered a mine manager's problems. We are all familiar with the saying "mines make managers." There is still some truth in this statement, but far less than there used to be in the days when high grade properties were the rule rather than the exception. When high grade orebodies prevailed, many managers, superficially at least, could not make a mistake because the profits of their mines

ACCORDING to the traditional definition,1 re-x crystallization is a process taking place upon annealing of cold worked metals, characterized by the appearance of new strain-free grains, growing at the expense of the cold worked grains until ultimately the new crystals completely replace the cold worked structure. In metals like brass this process was observed long ago to take place simultaneously with the return of the mechanical properties to those characteristic of well annealed material. The above definition implicitly assumes that the matrix in which the new grains are growing is essentially still in the cold worked condition at the time it is absorbed by the new grains, i.e., that the energy stored in the metal during cold working is not greatly decreased by recovery, prior to recrystallization. Accordingly, the bulk of this energy is assumed to serve as the driving force for the process of recrystallization. Recently, a great deal of evidence accumulated, indicating that the traditional concept may be considerably in error. Suzuki' found that by far the largest portion of the stored energy of cold work in compressed polycrystalline copper is released in the early stages of annealing, well in advance of recrystallization. Thus, the new recrystallized grains are undoubtedly growing in a matrix which is, at least energetically, no longer in the cold worked condition, but has nearly returned to the annealed state. It is true that in Suzuki's experiments the major hardness changes due to annealing were observed to take place concurrently with the formation and growth of the new grains, but this process apparently involved the release of only a minor residual fraction of the stored energy of cold work. Confirming in this respect the views of Wood," several recent investigations by various techniques lead to the conclusion that the grains of many, if not all, metals in the cold worked condition consist of small, slightly disoriented "crystallites" or "sub-grains".* (After appreciable deformation at room temperature, the subgrain size in copper appears to be about 7.104 cm and in high purity aluminum about 2.10-4 cm.) Recent investigations which demonstrated this phenomenon most convincingly are those of Heidenreich8 with hammered high purity aluminum, of P. B. Hirsch and collaborators7,8 with cold worked polycrystalline aluminum, copper, nickel, iron, gold, etc., and of Warren and Averbach9 with a rolled copper plus 2 pct Si single crystal. In addition to the existence of slightly disoriented sub-grains, the cumulative evidence from these investigations also shows that in the cold worked condition the subgrains themselves are severely strained. With regard to the early stages of annealing, Heiden-reich's results indicate that within the subarains of hammered high purity aluminum the strain gradually disappears, without discernible migration of the subboundaries. This recovery process presumably accounts for the major portion of the energy release

The developments in the Russian oil industry during 1935 marked a very definite turning point from the time when the industry was being educated to the modern methods of oil-field finding and development, refining, transportation and marketing, to the time when the industry has thoroughly assimilated the modern technique and is now firmly standing on its own feet, as is shown by the remarkable qualitative, if not quantitative, progress in 1935. The oil industry promises that 1936 will be a record year in every respect with both quantity and quality approaching the desired high levels and standards. More particularly the Soviet Government is beginning to be successful in the development of new fields and such new production in geographically strategical points of the country will be in the coming years a factor of great importance in the industrial life of the country. The most notable achievements of the last year have been: the very successful development of the Ishimbaevo oil field in the Lower Oural-Permian Basin; the discovery and development of several promising oil fields in the Puta district of Azerbaijan, while large flush production of Baku area was extended 50 miles due southwest into the Saliani-Aliat district, where a 3000-bbl. well was completed early in 1936 at Pirsagat. Also, an apparently important discovery was made at Zikh, on the Apsheron Peninsula proper. These discoveries, as well as several important strikes in the deeper producing sands in the older fields of the Apsheron Peninsula, have greatly augmented the proven reserves of Russia and made them available either at the points where transportation facilities were already present or at points not too far distant from major industrial centers of the country. Of course, not all objectives were achieved during the past year, and several major difficulties remain to be solved in the coming years, the more important of which are: (1) supply of equipment and of parts; (2) the unavailability of competent technical men in sufficient numbers, which more particularly affects the distant fields; and (3) the problem of distribution of oil products throughout the country, especially the question of handling the needs of small consuming areas, which, while individually unimportant, in the aggregate require huge distribution.

DISCOVERY of new ore in the Eureka district, Nevada, as a result of bold and persistent exploration based on a geologic interpretation of structure has recently aroused wide comment in mining circles. It may therefore be of interest to the profession to have a summary of the historical background and an account of the recent program of development. The mines of Eureka, discovered in the late 1860's, were the first important silverlead mines in the United States. They have a production record of more than fifty-one million dollars.1 After the ore bodies were apparently bottomed in the 1880's, repeated attempts to find new ore were unsuccessful until 1940, when a diamond-drill hole cut a 40-ft width of sulphide ore 1409 ft below the 841-ft level of the Locan shaft. The next hole cut 30 ft, of ore and three additional holes drilled in 1943 and 1944 showed the ore body to be continuous, Shaft sinking to reach and open up the ore body has been in progress since 1945. GEOLOGY Stratigraphy The ore in the Eureka district occurs in a series of Cambrian sediments which is exposed through a thickness of over 6000 ft. The stratigraphic column is as follows:2 [THICKNESS, FI ORDOVICIAN Pogonip limestone (upper part). Thin bedded limestone with some chert. UPPER CAMBRIAN: Pogonip limestone (lower part). Greater, emphasis is being placed on recovering nickel from laterite ores by ammonia leaching techniques. New methods are required for lower cost, non-polluting techniques to separate more efficiently the metals of interest. Liquid ion exchange techniques meet these requirements with the added advantage of producing salable electrowon nickel cathodes at the plantsite. A complete solvent extraction- electrowinning process is described, including preliminary engineering and cost data for a typical plant producing 50 million pounds of nickel per year.

PROBABLY no greater world traveler has ever been Chairman of one of the Institute's Divisions than Henry Frederick Hebley. To begin with, he was born almost as far away as possible-in Christchurch, New Zealand, Dec. 15, 1893. There he grew up, studying mechanical engineering at the local Seddon Memorial Technical College. Then he went over to Sydney, Australia, for a bit of work before sailing for the U.S.A. in 1915. After a few months as draftsman in a San Francisco office he moved over to Clarkdale, Ariz., in the engineering department of the United Verde copper smelter, which had just gone into operation. But the war was on, and Henry thought he belonged in France with the Canadian Engineers, the United States still remaining aloof from the conflict, and that was the last the copper industry saw of him. After almost two years in France he was wounded, convalesced in England and Canada, and then went back to his native New Zealand to design concrete factory buildings. But soon the United States called again, and this time he landed in Salt Lake City with the Oregon Short Line R.R. Co. Then to Chicago in 1920. where he really got into the coal industry for good, working for the Allen K Garcia Co. on the design and operation of coal mines, beneficiation plants, and combustion equipment; and joining the Institute.

J.-I am so thoroughly convinced of the growing importance of underground work in the production of limestone that I had the author make a detailed study of limestone mining for the Bureau of Mines and prepare a report on the principles of limestone mining. Many limestone operators, long accustomed to open¬pit work, are being forced to mining. About 6 months ago I thought there were twenty-five or thirty underground limestone operations in the United States but the author has been finding new ones until his list now runs nearer sixty. Some of these are very extensive; one at least has 4 ½ miles of underground workings. There is an ever-expanding field for the engineer in the operation of limestone mines and quarries. Some of the larger companies realize the need of skilled engineering advice, but many of the companies regard the engineer as an unnecessary expense. Although almost every metal mine, even those handling only a few hundred tons of ore per month, employs a mining engineer, many limestone operations ten times as large employ no mining engineers. What would be the, effect on the formation of sulfates of an increased water vapor content in the roasting gases? CHARLES H. FULTON.-I cannot answer that from our experience. The question of the formation of sulfate in the roasting of zinc is mainly one of temperature and the concentration of S02 and S03 in the gases. We found we could roast almost completely to sulfate if the concentration was kept at the proper point. We, however, did not care to do this because we wished to make a 5 to 6 per cent. S02 gas for sulfuric-acid work. The sulfating of the zinc oxide in the proper concentration of gases goes on very rapidly. BOLIVIA still remains among the oil countries that have proved oil acreage but no production which is being marketed. No steps have been taken during the past year to provide facilities for transport of Bolivian oil to market nor are any known to be contemplated for 1930. The only active operator to date is the Standard Oil Co. of Bolivia, subsidiary of the Standard Oil Co. of New Jersey. The potential production from completed wells is practically unchanged from the 1928 figure of 6000 bbl. daily. As far as is known, there has been only one completion during the year 1929. This is the Machareti well, which is about 50 km. north of Villa Montes along the road to Charagua. The well is reported at about 250 bbl. daily initial production. The gravity of the oil is not known but is presumed to be about 40" Bé., the average for the region. The Standard Oil Co. of Bolivia has five strings working on various parts of its concession. No new locations have been made definitely. Company Activities There was no change in the situation of American holdings in Bolivia during 1929. The oil rights of an English company, acquired under a special colonization contract with the Bolivian Government, are being negotiated in New York and may mean the entrance of another of the large American oil companies in Bolivia. The Sucre Syndicate sold its holdings to the Standard Oil Co. of Bolivia during the past year. .A local company called the "Aguila Doble" was formed during 1929 to drill a well or wells near the town of Cochabamba on structures mapped by a local geologist. It is reported that the Government is buying about one-fourth of the capital stock of this company for 500,000 Bolivianos (about $180,000). The company has not yet raised sufficieht funds to buy drilling equipment so that no operations have been started. According to the statements published in La Pas, this company has acreage on seven anticlinal structures near Cochabamba. This area lies about 8500 ft. above sea level on the eastern Hank of the Andes Moun-
