CAREFUL research into the nature of the metallic state has yet to discover, with any certainty, its essential quality. We do riot yet know, for sure, what it is that makes the metallic elements different from, if not actually unique among, all created things. We do know, of course, that metals have certain more or less characteristic properties-they are hard, strong, and tough, and good conductors of heat and electricity, and these so-called metallic properties provide a definition of a sort. How- ever, it is the structure rather than the behavior of the metals which gives the really fundamental information necessary to the understanding of metallicity. But this information is not easily obtained. Nature has a way of keeping secrets. But happily we do possess some knowledge of how a metal is built up, and it is this matter, rather than the presentation of a formal definition, that will be discussed here.

Chromium alloys were coated with silicon, alumi-nuw, and boron by pack cementation. None of these simple coatings provided adequate nitridation/oxida-tion protection for a Cr -0.17pct Y alloy substrate as shown by a substantial Increase in the ductile -brittle transition temperature after air exposure for 100 hr at 2100°F. Iron-modified silicide coatings afforded good protection, holding the transition temperature of air-exposed specimens to 350° F compared to 200° F for uncoated unexposed specimens and 800°F for un-coated exposed specimens. Additional attractive cant-binations of modi-tying elements included Fe-mo, Fe-Mo-W, Fe-,Mo-W-Ti, and V-Mo-W-Ti. THE desirability of increased operating tempera-tures as a mcans of improving the performance of ad-vanced air breathing engines has resulted in emphasis on the development of materials with high operating temperature capabilities. Chromium, because of its relatively low density (7.19 g per cu cm), high melt-ing point (3410°F), and adequate strength upon alloy-ing, is a candidate material for turbine buckets and stator vanes of advanced air breathing engines. How-even, chromium is not without severe limitations, the major one being susceptibility to nitrogen embrittle-ment upon exposure to air at high temperatures.1,2 For example, a 25-hr air exposure of a Cr-5 pct W* * All compositions in wt pct. alloy at 2100°F produces a 600°F increase in the duc-tile-brittle transition temperature.' Although dilute alloying with such elements as yttrium, lanthanum, arid thorium3,4 or strong nitride formers5 has been shown capable of reducing nitrogen embrittlement, it is apparent that some additional form of surface protection, such as coatings or claddings, will be required for long time service in air breathing engines. Studies of aluiminide6 and silicide7 coatings and of nickel-base claddingsl on chromium alloys to date have suggested that these protection systems are inadequate. Of the aluminidc systems Studied,6 a simple aluminum and an Fe-Al coating on a Cr-5 pct W-0.1 pct Y alloy showed the lowest air exposure weight gains. However, the air exposures raised the ductile-brittle transition temperature of the coated specimens to above 1600°F from an initial level in unexposed specimens of about 500°F. A second in-vestigation for protection of Cr-5 pct W-0.1 pct Y employed gas pressure bonded alloy foils as protective claddings.1 An aluminized Ni-20 pct Cr-20 pct W alloy plus an unalloyed tungsten barrier layer gave the best performance with air exposure lives based on appearance and weight gains of over 600 hr at 2100°F. An extension of the thermodynamic theory has been made for the case of irreversible growth processes occurring by the motion of an interface. The theory is applicable to such diverse phenomena as diffusion, growth in recrystallization, continuous grain growth, growth of carbides, etc., growth of eutectoid products, growth in solidification, recovery, "slipless" flow, etc. THE publication of a recent book1 has served to focus attention on a very powerful means of treating certain irreversible processes. This method which has been formally described as the thermodynamic theory of irreversible processes is applicable to processes which involve an approach to equilibrium and for which the deviations from equilibrium are small. The irreversible processes can be classified into three groups: chemical reactions, transport processes (diffusion, heat and electrical flows), and relaxation phenomena involving a degradation of internal energy to more stable states. The limits of applicability of the theory can be precisely defined1,2 for each type of irreversible process. For example, in a chemical reaction at constant temperature and pressure, the Gibbs free energy released per mol in the process should be less than the thermal energy, RT. Another type of irreversible process, which sometimes involves a combination of the first two of the above-mentioned groups, is treated in this paper. This process is one characterized by the motion of an interface separating two regions having different values of free energy and may be briefly described as a growth process. Prigogine2 and Herring3 have treated special cases of this type of process. Previous conscious applications of the theory in metallurgy have been limited to the field of diffusion, one of the transport processes. Darken,4 Bardeen,5 Prigogine2 and others have made significant contributions in this respect. Some other applications of the theory are described in this paper. The Theory The thermodynamic theory of irreversible processes is based on the work of Onsager,6 DeDonder,7 Prigogine2 and others. A resume of the theory has been given by Prigogine2 and DeGroot.1 A brief description of the theory follows, although for a complete understanding the reader is urged to read the references. It is first assumed that the change in entropy, even for a system removed from equilibrium, is given by dS = [dU + pdV - Si µi, dn, - Sk Pk dxk]T-1 Using this expression, the irreversible entropy production in the system is calculated by subtracting the contribution to the change in entropy of the system by transfer of heat, work, or matter from the surroundings. Thus, for example, the irreversible entropy production of a system at constant temperature and pressure is given by dtS = — — dG (DeDonder7) Now it has been shown by Prigogine,2 DeDonder,7 and DeGroot1 that the rate of irreversible entropy production diS/dt, when calculated in the manner suggested, can be written as a sum of products of conjugate forces XK and fluxes Jk, i.e., d,s/ = Sk Jk Xk [I-1] dt The assumption is next made that a linear relation exists between a given flux and the forces, obtained from Eq. I-1, i.e., Ji = Sk Lik Xk (i = 1, 2, . . . n) [I-2] Generally, there is a degree of freedom in choice of the fluxes and forces. However, for all the choices consistent with Eq. I-1 the Onsager8 relations, based on the principle of microscopic reversibility, namely, Lik = Lki, are valid. The coefficients Lik, depending upon the choice of the conjugate fluxes and forces, may be more or less dependent upon the parameters defining the state of the system. In general, the proper choice of fluxes and forces utilizing Eq. I-1, makes the coefficients Lik independent of time. Also, because many of the three classes of irreversible phenomena have already been treated,1,2 a proper choice can be made by analogy. In any case, the validity of Eq. 1-2, from whatever choice made using Eq. I-1, must be tested by experimentation. The Mather Mine property is composed of a 5.2 sq km (2 sq mile) area within the Cities of Ishpeming and Negaunee which are located in the Upper Peninsula of Michigan. Production in this mine started in 1943; it ran continuously until its closing in 1979, having produced slightly over 55 million tons of iron ore. This mine was a joint venture between several steel companies and The Cleveland- Cliffs Iron Company (CCI), with CCI being the fee holder and operator. For the first 17 years of operation, the ore was shipped in its natural state directly from the mine to the steel mill. By 1960, iron ore pellets were on the market and they proved so superior to the natural soft Mather ore that the latter became difficult to sell except for the coarser portions. It was decided to develop a pelletizing process for the Mather ore, and this was accomplished by 1965 when the first Mather pellets were produced. From this date, all but the coarse fraction of the Mather ore was shipped as pellets. The geological setting is that of a large east-west trending synclinorium which plunges to the west. The lowest member of this trough-like structure is, for the most part, a quartzite-like graywacke, the upper 20 m of which grades into a softer, fine grained slate. Lying conformably on this graywacke footwall member is an iron- formation member which is over 1,300 m in thickness. This iron-formation is cow posed of thin alternate bands of iron oxides and chert and is intruded by a number of diorite sills - some up to 122 rn (400 ft) in thickness. The north limb of this synclinorium dips at approximately 45' and bottoms out at about 1,000 m from surface in the central part of the mine. There are two sets of faults, many of which are intruded by diorite dikes, which trend east-west and southeast-northwest. Displacements are varied, reaching a maximum displacement of 243 m (800 ft). The ore is found lying directly on the slatey footwall and its position is largely controlled by the faults and dikes, with the bulk of the ore being on the upper side of these structures. The ore is composed of soft earthy hematite and martite with vertical thicknesses up to 122 m (400 ft) although the average thickness would be closer to 46 m (150 ft). The ore averaged 60% iron and 7% silica on a dried analysis. The Mather Mine is located on the north limb of the syncline and was worked from two shafts, the deepest of which. was 1,09 7 m. These two shafts are about 2 km apart and serviced a total of 8 working levels between them during the life of the mine. The level spacing was about 61 m (200 ft). The main haulageways were driven parallel to the ore/footwall contact in the hard cow petent graywacke wherever possible. On the lower levels, deeper into the footwall, naked development was common. This material graded into roof bolting ground towards the upper stratigraphic portion. As drifting progressed further into the upper stratigraphic portion of the footwall, progressively stronger steel sets had to be used. From the main haulageway, cross-cuts were turned into the orebody on 61 m (200 ft) centers and extended as far as needed to recover the ore available to that particular cross-cut. The main haulageways and cross-cuts were driven 3 m (10 ft) high, 3 m (10 ft) wide at the top and 4.6 m (15 ft) wide at the bottom. This configuration would accomodate a set composed of a 2.7 m (9 ft) cap on top of two 2.7 m (9 ft) legs angled out at 18'. A sill plate was used under each leg to prevent its sinking into the ore below. The type of steel used was dependent on the expected weight to be experienced. Sets were placed on 1.63 m (5 ft 4 in.) centers; however, in extremely heavy areas, it was sometimes necessary to install sets on 0.8 m (2 ft 8 in.) centers. On the top two levels (5th and 6th), the ore was considerably hard-er and was mined by sub-level stoping and long hole drilling. Very light steel sets were used in the main haulageways and cross-cuts and timber was used in the production drifts. Some con- crete production drifts were installed on 6th level, but proved to be uneconomical. However, as mining reached greater depths, the ore became softer and more massive, reaching its maximum vertical heights on 11th and 12th levels. On levels 7 through 10, yielding steel sets were used extensively in the slusher drifts. While they were satisfactory on 7th and 8th levels, their success diminished with depth and they were

Permeation rates for nitrogen through are-cast tungsten were measured in the temperature range 1800° to 2600°C at nitrogen pressure differentials of 1.0 and 0.1 atm. Gas chromatography was used to measure the quantities of nitrogen which permeated through 0.26-and 0.53-mm-thick membranes. Permeation rates were proportional to the difference between the square roots of the nitrogen pressure on each side of the membrane and inversely proportional to membrane thickness, indicating that atomic nitrogen was the difjusing species and that diffusion was the rate-limiting step of the process. Permeation coefficients calculated from the rates may be represented by the equation: where P is expressed in the units cu cm (stP)-mm per 1/2 sq cm-min-atm"' and 70.0 * 0.8 is the activation energy in kcal per mole of permeating species. In a previous paper' permeation rates were reported for hydrogen and for oxygen through tungsten. The permeation cells used for the hydrogen measurements were suitable for measuring nitrogen permeation under similar conditions, so the study was extended to include nitrogen. Permeation rates of nitrogen through the polycrys-talline arc-cast tungsten membranes were measured in the temperature range 1800" to 2600°C using two membrane thicknesses and two nitrogen pressure differentials. Permeation coefficients were calculated and the activation energy of the process determined. THEORY For diatomic gases which dissociate prior to diffusion, the quantity of gas which permeates through a membrane or wall at an elevated temperature where bulk diffusion is the rate-limiting step of the process is given by the equation: where: q = total amount of gas permeating a membrane, P = temperature-dependent permeation coefficient, A = area of membrane, t = time, p1 = gas pressure of high-pressure side, p2 = gas pressure of low-pressure side, and d = thickness of membrane. When bulk diffusion is the rate-controlling step, and the solubility of the gas obeys Henry's law, a further relationship is that, for any given temperature and pressure, the permeation is the product of diffusivity and the amount in solution. The permeation coefficient, P, is temperature-dependent according to the equation: where: Po = permeation constant, Q = activation energy, R = gas constant, and T = absolute temperature. EXPERIMENTAL PROCEDURES Cell Design and Experimental Apparatus. Two of the permeation cells used for the previous measurements of hydrogen permeation are shown in Fig. 1. Each consisted of a cylindrical chamber divided into two parts by a permeation membrane fabricated from high-purity (>99.9 pct W) wrought tungsten sheet made from vacuum arc-cast tungsten. The membrane in one cell was 0.26 mm thick and the other was 0.53 mm. The fabrication of these cells was described previously.' The permeation cells were mounted vertically in a high-temperature tungsten resistance furnace and the membranes and the center portions heated to test temperatures. Temperatures were measured by sighting an optical pyrometer on the edge of the membrane through a small hole in a tungsten plate which was fastened to the side of the cell. This arrangement provided an approximate black-body condition and eliminated the need for emittance corrections. Appropriate corrections were made for the quartz window through which the temperatures were measured. Argon gas flowed through the 10-liter volume of the furnace at the rate of 4.7 liters per min. Much attention and publicity has been given, during recent years, to grinding, classification, flotation, and thickening. The various technical papers, and symposiums held to discuss these important phases of milling, have contributed to a better under- standing of the fundamental principles and operating variables involved. Another important part of milling- to the flotation operator-is a treatment step to which frequently too little attention is given-" conditioning," or the treatment the ground mineral pulp receives before it enters the flotation machines. Conditioning" is a hackneyed and frequently misused term, commonly employed to describe the pretreatment of surfaces of minerals in ore pulps or mill pr6ducts prior to froth flotation. In general, such pretreatment is for the purpose of changing the flotation characteristics of these mineral surfaces to enable them to respond in some desired predetermined manner when subjected to flotation. Taggartl states that the function of conditioning is "either to insure selective collector coating of one mineral species while another species is not; or to take such steps as will compensate for departure there from."

THE experiments of which the results and significance are set forth in this paper do not by any means cover the whole subject of the heat-treatment of the material referred to, yet they constitute a contribution to that general subject, rather than to the special department of annealing. The material here considered is acid open-hearth steel, containing from 0.50 to 0.80 per cent of carbon, with a nearly uniform percentage of other elements. This class of steel is rapidly increasing in commercial importance. It is even rumored that the rail-specifications of some railroads will hereafter require open-hearth steel. Yet this particular grade seems to have received less study and description from the standpoint of the metallographist than many others. The investigation here described was directed to the following points:-Steel containing about 0.50 per cent, of carbon : 1. The structure as related to the temperature, at the same rate of cooling; 3. The structure and physical properties as related to temperature at different rates of cooling; 3. The structure and physical properties as related to different finishing-temperatures and different rates of cooling; 4. The bearing of these observations upon the statement of Prof. Albert Sauveur.1

W. J. Parton—Those operators faced with the problem of treating fine coal whether in bituminous or anthracite will find this paper most timely. I would like to take this opportunity of discussing Mr. Schiffman's paper and at the same time express certain views relating to our Tamaqua plant. I would like to ask the author what type of impeller and diffuser is used in the Denver cells? Screen analysis of products from individual cells indicate that coarser material resists flotation and only floats after greater retention time in the last few cells. Also, the need for a scavenger screen to reclaim non-floated coal particles further stresses this point. I have always felt that more efficient means of cleaning coal between 10-mesh and 28-mesh existed than flotation. Reagent and power costs are high for the flotation process. When floating +28-mesh particles, cell capacity is lowered and some of the particles are lost with the refuse. The Tamaqua plant of the Lehigh Navigation Coal Co. floats —28-mesh coal and capacity of recoverable coal is 40 tph for 1800 cu ft of Denver cells; or 0.05 tons per cu ft of cell. At Kimberly 7.75 tph for 600 cu ft of cell gives 0.013 ton per cu ft of cell. At Bessie 14 tph for 800 cu ft of cell gives 0.017 tons per cu ft of cell. It would be appreciated if the author would comment on what he feels is the upper size limit of particle to attain most efficient utilization of the flotation process. The dewatering screw is a very interesting development since it offers a simple way to prepare coal sludge for more complete clewatering by drainage or mechanical dewatering on screen or filters. In other words it could be used to accomplish the same thing as a thickener tank. I would appreciate having the author's comment on how he thinks such a screw dewaterer would work on a froth.* The process as used in floating coal at the Bessie and Kimberly plants may be referred to as more of a bulk oil float in contrast to a froth flotation process. Experiments on increasing capacity of cells is most interesting since we are going through such an experi- mental period at the present time. Recently a double overflow was installed on our No. 30 Denver cells. So far results are not conclusive. In reviewing this paper the following comments are made pertaining to investigation of methods for increasing capacity: Supercharging: Supercharged air in matte flotation or for that matter the use of the normal amount of air drawn in by the impeller would in all probability cause such an aeration in the cell as to destroy the buoyant effect given to the coal particles by the excessive amount of kerosine used. In other words, air creates an agitation zone throughout the cell, creating a boiling and thereby giving a lower recovery in the cell. It would be interesting to know whether the 7 pct increase in recovery was with no air being admitted to the stand pipe. Changing Impeller Speed: The speed of a receded disc impeller for a No. 30 cell as recommended by the Denver Equipment Co. is, I believe, approximately 250 rpm. At this speed and using supercharged air in excess of 8-oz pressure, we have observed a boiling action in the cells. In our flotation we endeavor to obtain some degree of froth flotation using pine oil as a frother. The boiling action as caused by increasing the amount of air added to the cells is detrimental to recovery in froth flotation. It is our belief that to obtain increased recovery from a cell in froth flotation, additional air must be introduced but at the same time this air must be dispersed throughout the pulp in the form of small bubbles and this can only be done by increasing the speed of the impeller. Therefore, if Mr. Schiffman decreased the speed of the No. 30 impellers and at the same time continued to use supercharged air, the boiling action may have been increased because larger bubbles developed. The lower recovery as reported could be due to this factor. Decreasing the impeller speed will definitely decrease the power consumed but may have other disadvantages. First, we believe it will permit "sanding" in the cell and this in our opinion will increase the wear on the impeller and diffuser, especially so, if there is pyrite and/or sand present in the feed. "Sanding" in the cell when air is used, as in froth flotation, will effect the dispersion of this air and cause boiling.

AT present the demands of the United States for strontium are met by imports from Germany, England and Canada, which vary considerably in proportions of ore and finished salts, in tonnage and in value. Statistics for the period 1926-1932 are given in Table 1. These deposits are large enough to command interest, par-ticularly in consideration of future cheap power at the Boulder Dam. The deposits described in this paper were examined during an investi-gation of the mineral resources of the Boulder Dam region by the United States Geological Survey for the United States Bureau of Reclamation in the spring of 1934. Mr. D. F. Hewett, who had general charge of the investigation, Mr. W. T. Schaller and Mr. M. I. Goldman contributed many helpful suggestions. Mr. N. H. EVEN before the surrender of Germany, a gradual reduction in output of many of the small mining iseswises in the different countries of South America had occurred. Part of this was due to restricted purchases of strategic mineral supplies, and part to economic conditions. Inflationary tendencies have keen increasing since the war started; out in the past three years they have become serious. The difficulty in obtaining supplies, and labor troubles, has also combined to reduce production in many circumstances. British Guiana The Cuyuni Goldfields, Ltd., operating he Aleck Hill mine, is increasing their yanked mill to 500 tons. This appears be one of the few important new developments in South America during recent years. Brazil The big Volta Redonda steel plant was sported as being ready to start operations. Argentina Political troubles have restricted activities during the past year, and fuel short. ges have been so acute that surplus corn as burned in some instances. The subject " Safe Timbering of Working Places in Mobile Loading" is one that requires an analytical study of the strata both above and below the coal seam as well as the characteristics of the coal seam itself. The projection or mining plan must be based on economic roof control in which the application of timber can be minimized without incurring cost increases in other phases of production. The several types of loading machines in common use today are not adaptable to the same projections or timbering systems. Consequently the type of equipment to be used must also be considered. For these reasons the writer does not believe that the problems of timbering in working places can be discussed without simultaneously considering economic production as well as the safety of men and the conservation of equipment. Prior to the introduction of loading machines as a substitute for the pick and shovel system of loading coal, the care and maintenance of the individual working places were generally the responsibility of the coal loaders who worked in them. Up to that time very few coal companies had developed and applied fixed and definite standards for timbering the working places in the mines they operated. It is common knowledge that mechanical loading of coal has had several false starts in the last twenty-five years and it is only in the last decade that it has developed to the stage at which we now find it. During this twenty-five year period the management of the more responsible companies have come to realize the tremendous importance of roof control in coal mining. From a safety viewpoint, the lack of roof control has been and still is responsible for more than a third of the industry's annual fatality experience. In recent years workmen's compensation and insurance rates have steadily increased while the profit margin has decreased almost to the point of elimination. From an economic operating viewpoint, the failure to properly control roof is quite often the most costly single phase of coal mining. Since the manufacturers of loading machine equipment have so improved their machines that normal care and maintenance can reduce to a minimum the time lost because of mechanical failure the production delays from other causes have assumed a far greater importance. Roof control in the broad sense and in the light of concentrated mining plans or projections that are adapted to mobile loading should be regarded as one of the major problems in the inseparable phases of production and safety of the workman and equipment at the working face. The subject of this paper cannot be treated properly unless what is said here is based upon the broad and fundamental problem of genera' roof control. MINE VENTILATION is an important factor in mine maintenance as well as having direct bearing on labor efficiency. Effective ventilation systems are costly, especially those for the deeper mines, but with intelligent direction the worth of a system is usually greater than its cost. In most mines using mechanical ventilation, and practically all deep mines, it has been found beneficial to equipment, timber, and the ground, to run the fan or fans continuously even though production has been curtailed or entirely suspended. Therefore, economies in ventilation may be overlooked when general cost reductions are necessary. The operating costs of a well-designed ventilation system should be capable of reduction during periods of curtailed or suspended operations. A mine that is ventilated by splits, or that can be sectionized, can reduce its fan-power costs considerably, and provisional divisions can sometimes be made in other mines, in which the air is ordinarily coursed through all the workings, without harmful effects.

MeRcuRy is one of the strategic metals of which the supply has been raised from critical uncertainty to more than enough for essential demands. Work by the Bureau of Mines has contributed substantially to increased production of mercury in the United States and to consequent accumulation of Government stocks. Other contributing factors have been higher prices for mercury and Government loans to operators. The Bureau has undertaken 13 exploration projects, 10 of which have been completed. This work has comprised 28,376 ft. of several types of drilling and 23,798 lin. ft. of surface trenching, and has indicated commercial ore containing 34,800 flasks of mercury and marginal ore containing 26,200 flasks, a total of 61,000 flasks; equivalent, respectively, to domestic production for 8 months, 6 months, and 14 months. As Government stocks are now adequate, domestic production (currently at the rate of 50,000 flasks per year) is gradually being curtailed through Government control of labor and operating supplies. Introduction Mercury was one of the seven metals designated as strategic by the Army and Navy Munitions Board in 1939, when Congress appropriated funds for the investigation of domestic sources of supply of war minerals. The Bureau of Mines immediately started a limited search for strategic minerals, but the first mercury project was not begun until December 1940. The U. S. Geological Survey assisted in the search for cinnabar by contributing information on domestic mercury deposits, preparing maps, and making geological studies of exploration projects. The present high rate of production of mercury in the United States was encouraged by the increase in price to $196 per flask at New York (Fig. I) and Government loans to operators for mine development and plant construction. The Bureau of Mines has issued, for restricted distribution subject to wartime controls, 13 War Minerals Reports on individual mercury deposits (listed in appendix A). In March 1942 it also published a Progress Report of the Metallurgical Division, R. I. 3627, Cinnabar-reduction Plants of the Southwestern Arkansas Quicksilver District. Uses of Mercury Mercury and its compounds have more than 3000 uses. Its principal use is as a catalyst in the manufacture of gases for chemical warfare; the next largest is in pharmaceuticals. Mercury is essential also for: (I) certain electrical apparatus, (2) industrial control instruments at many war plants, (3) munitions, including blasting caps, (4) insecticides in agriculture, (5) antifouling paint for ship bottoms, (6) dental preparations, (7) general laboratory use, and (8) amalgamation of free-milling gold ores.

ONE of the major uses of barium in metallic form is as a getter material in vacuum tubes. Because of the high chemical reactivity of the metal, Ba-Al alloys are extensively used. Numerous methods for the preparation of Ba-Al alloys have been published, a few of which1-4 are cited here. Most of these methods were found to be quite elaborate, involving the reduction of BaO, and not too well adapted for the close control of the final composition of small amounts of alloys prepared for laboratory use. A simple laboratory method for the preparation of Ba-A1 alloys in small batches starting from pure metals was devised, so that it was possible to control the desired compositions to within 1 pct. The pertinent features of the alloy system Ba-Al5 are 1) an intermediate compound BaAl, with the melting point of 1050°C, and 2) a eutectic between aluminum and BaAl4 at 98 pct Al. The accompanying sketch shows the experimental arrangement for the preparation of the alloys. Weighed amounts of aluminum and barium were placed in an alumina and a stainless steel crucible, respectively. According to the supplier's specification, the purity of the metals used in the alloys is as follows: a) aluminum rods—99.9 pct Al, and b) barium rods—99.5 pct Ba. The stainless steel crucible, tapered at the bottom and having a 1/16 in. diam hole, rested on top of the alumina crucible. The assembly was placed inside a graphite sleeve which rested on a refractory platform. The platform moved the assembly up and down through the field of a radio frequency coil. A glass bell jar was placed between the crucible assembly and the radio frequency coil to maintain a steady flow of helium around the melt. A small window was cut out on the wall of the alumina crucible to observe the progress of the re- action and to record the temperature with an optical pyrometer. The platform was first raised high enough to move the barium out of the radio frequency coil field in order to allow only the aluminum to melt. The assembly was then lowered so that the barium began to melt and flow out through the small orifice into the molten aluminum. In order to keep the violence of the exothermic reaction under control, the rate of flow of barium was carefully regulated by raising or lowering the crucible assembly. All the samples prepared by this technique were examined by a Norelco X-ray diffractometer using CuKa radiation, The diffraction specimens were prepared by placing the finely powdered samples in flat specimen holders. The Ba-Al alloys prepared with a high barium content were found to consist mainly of BaAl4. The structure of BaAl4 has previously been reported by Alberti and Andress.8 They found that BaAl4 was body-centered-tetragonal with an a0 = b0 = 4.530Å and c0 = 11.14Å. An alloy whose composition was found by chemical analysis to be almost 100 pct BaA1, was used to determine the relative intensities. The d-spacings were obtained from the same alloy to which a small amount of tungsten had been added as a calibrating material. Accurate values for a, and c, were calculated according to the method proposed by Taylor and Floyd.' The calculated values are: a, = b, = 4.566Å and c0 = 11.250Å. The measured d-values for BaAl4 are shown in Table I along with relative peak intensities above background and hkl indices. Acknowledgment The authors are grateful to L. J. Approximately 2000 years ago, the Lord admonished the scribes (lawyers) and pharisees (religious leaders of that time) that they had paid the tithe but had omitted the weightier matters of law, judgment, mercy, and faith. (Matt. 23:23) I want to talk about "The Weightier Matters of Law." In a situation where big government is trying to have an effect on even small details of a work activity, otherwise simple situations become complex. Regulations are written to such detail that constant compliance with strict interpretations can be a nightmare-not to mention off the target of the intended purpose for the regulation. One soon recognizes the onerous characteristics of federal statutes. Another admonition the Lord gave those lawyers and pharisees back then was that they tended to strain at a gnat and swallow a camel! He meant that the pharisees were given to devoting themselves to the strict interpretation of law by writing hundreds of subrules or interpretation to law. In doing so they eventually lost sight of the original purpose of the law. I think they were being told, keep the law-but don't neglect to humanize it Keep it simple Recognize the purpose of why the law. "Mix in" a common sense approach. Someone once said, "Common sense is instinct -enough of it is genius." Today, as 2000 years ago, we need more "genius" displayed by legislators in considering the weightier matters of law. First of all true legislature genius calls for a declarative statement about the purpose of the statute and a fair, objective analysis of the ground rules by which it will be implemented. In the Health & Safety Act of 1969, the "findings and purpose" as set forth in Section 2 do define its purpose. I believe most of us affected can be in accord with the reasons advanced for the legislation. However, beyond those well-intentioned few paragraphs, we very quickly run into trouble. Congress complicated the simplicity of the statement of purpose by mandating government intervention into areas that cannot be effectively legislated, nor even should be legislated. The Act provided for broad gaged regulation which is unnecessary, inappropriate, and tremendously costly. Frankly, it detracts from a constructive, cooperative effort by the parties involved. These are strong negatives which characterize inappropriate legislation. Appropriate legislation and subsequent regulation, which is realistically conceived and practically enforced must be born of an honest desire for improvement, based on a working knowledge of common problems which are thoughtfully analyzed. Then the legislation must be written in clear concise language so that there can be little or no doubt as to its literal meaning and intent. To be practically enforced, it must be understood by all who will enforce it and by all who are subject to it. That is to say, an effective law or standard cannot be fixed or inflexible so that it cannot be tempered in human judgment. There must be an elasticity in the statute to provide for consideration of all of the relevant facts of a given situation. Such elasticity makes the compliance effort as meaningful as it can be for the time and dollars invested. Meaningful compliance requires room for common sense. Today, we in business along with our associates in government and labor, urgently need to pause, and assess our current situation. The problems arising from the 1969 Act have been intensified through the Mine Safety & Health Act of 1977. After reading the "findings and purpose" of this legislation, and by process of elimination, we should all clearly see what is and is not the purpose of the Act. 1) It is not to turn the management of private industry over to government. 2) It is not to impair the efficient operation of business. 3) It is not to reduce productivity and profits. 4) It is not to reduce national unemployment. 5) It is not to perpetuate the bureaucracy. 6) It is not to increase the tax burden on an already overburdened people. 7) It is not to increase our balance of payments deficit. 9) It is not to replace management/labor relations in working together to solve problems.
